Before committing to it, check not just identical names but also similar marks, related goods and services, state records, and real-world use. A clean search is useful evidence—not a guarantee that the name is available, registrable, or safe to use.
Start with what the name will identify
A trademark is assessed in relation to particular goods or services, so begin by describing what your app does and what you will offer under its name. Consider the app itself as well as connected offerings, such as services or other products marketed under the same brand. A candidate cannot be meaningfully assessed in isolation from those offerings.

This guidance is U.S.-focused and explains a screening process, not the clearance of any particular name. The right analysis depends on the candidate wording, the goods and services, and where you intend to use or register the mark.
Choose a distinctive, usable name
The USPTO groups fanciful, arbitrary, and suggestive marks as stronger; descriptive marks are weaker, and generic terms for the goods or services cannot function as trademarks for those goods or services. The category depends on how the wording relates to the app’s actual offerings, not simply how unusual the name sounds in isolation. See the USPTO guide to strong trademarks.

- Fanciful: A coined term with no established meaning before it is used as a brand.
- Arbitrary: An existing word used in a context unrelated to its ordinary meaning.
- Suggestive: Wording that hints at a feature or benefit but requires some imagination to connect it to the offering.
- Descriptive: Wording that directly describes a feature, purpose, or characteristic of the offering.
- Generic: The ordinary name of the goods or services themselves.
Adding a generic app descriptor to a descriptive brand does not automatically make the brand distinctive. Alongside legal strength, assess whether people can remember, pronounce, and spell the name. If you expect to market outside the United States, consider what the wording means in relevant foreign languages.
Compare candidates on two separate questions
Do not collapse distinctiveness and clearance into one score. A distinctive name may still conflict with an earlier mark, while a name that appears less distinctive may not have an obvious conflict. Consider each axis separately:

| Question | What to assess |
|---|---|
| Distinctiveness | How the wording relates to the app’s actual goods or services: fanciful, arbitrary, suggestive, descriptive, or generic. |
| Clearance risk | Whether similar marks are live or still in use, and whether their goods or services are related closely enough that consumers might assume a common source. |
| Practical usability | Whether people can remember, pronounce, and spell the name, and whether its meaning works in the markets where you plan to offer the product. |
Use the comparison to identify names that merit further review, not to declare a candidate legally cleared.
Search for more than an exact spelling
Search the candidate and meaningful variants in the USPTO’s federal trademark search system. Look beyond identical spelling: similar sound, appearance, meaning, or overall commercial impression can matter. Review the status of potentially relevant records and the goods and services they cover. The USPTO advises focusing mainly on live marks, while not entirely disregarding dead records because a mark may still be in use.

International class numbers can help organize records, but they do not determine whether offerings are related. Goods or services in different classes may still be related in consumers’ minds. The key question is whether the marks and offerings could lead consumers to believe they come from the same source. The USPTO explains this in its guidance on likelihood of confusion.
Expand beyond federal records
A federal database search is an essential step, not a complete clearance search. Also check state trademark databases and internet use for the candidate and relevant variants. The USPTO describes why these broader checks matter in its guidance on searching for similar trademarks.
Rank #4
A domain-name or business-name check alone does not establish trademark clearance. Those checks answer different questions and cannot replace searching trademark records and real-world use.

Know what a search can—and cannot—tell you
A search result is not a promise of registration or permission to use a name. The USPTO conducts its own federal search during examination; a conflict may lead to refusal or suspension. Disputes can also arise through opposition, cancellation, or infringement litigation. The agency recommends a comprehensive clearance search and understanding how to assess the results before applying; see its comprehensive clearance search guidance.
When relevant conflicts appear, the search is difficult to interpret, or the launch has significant consequences, consider asking a U.S.-licensed trademark attorney to conduct or review a comprehensive search and advise on the results. USPTO guidance on federal trademark searching discusses professional help. An attorney’s assessment can inform a decision, but no quick database check—or search by itself—guarantees registration or non-infringing use.
