Choose a U.S. crypto exchange by verifying the exact legal entity and the specific service you plan to use—not by relying on its brand, a general claim that it is “regulated,” or a single database result. The right checks differ for securities, derivatives, and spot crypto, and state licensing may matter for spot services. Registration is one part of due diligence; it is not a guarantee against fraud or loss.
Start with the company and service you will actually use
Before checking a regulator’s records, identify the entity that will take your account, hold your assets, execute your trades, provide custody, or offer derivatives. A platform’s brand name may differ from the legal name of its operator, and a parent company’s status may not establish the status of an affiliate that provides a particular service.

- Find the legal entity named in the account agreement and terms for the product you want.
- Note your state of residence; state registration or licensing is a separate question from federal registration.
- List the services you expect to use: spot trading, securities-related trading, custody, or derivatives. One company may offer several services with different regulatory implications.
If the exchange makes a compliance claim, ask which entity, service, registration category, and jurisdiction the claim refers to. “We are registered” is not specific enough to verify on its own.

Match the service to the right regulatory check
The word “exchange” in an app or company name does not establish that the platform is registered as a securities exchange. The SEC’s guidance on potentially unlawful online trading platforms explains that a platform trading crypto assets that are securities and operating as an exchange generally must register as a national securities exchange or qualify for an exemption. An alternative trading system (ATS) operates under a different framework and has a broker-dealer operator and Form ATS requirements.

| Service you are checking | Records and regulator to check | What the result does—and does not—tell you |
|---|---|---|
| Securities trading, including a platform that may operate as an exchange for crypto assets that are securities | SEC active national securities exchange and ATS lists; SEC and Investor.gov information; FINRA BrokerCheck for broker-dealer firms and relevant individuals | Check whether the entity and activity match the applicable registration or exemption framework. An ATS is not the same thing as a national securities exchange. Depending on services, broker-dealer, transfer-agent, or clearing-agency registration questions may also arise. |
| Futures and other derivatives | CFTC and NFA records; NFA BASIC for registration, disciplinary history, and financial information | Specified intermediaries for virtual-currency commodity futures need the applicable CFTC/NFA registration. Check the intermediary and product, rather than assuming a spot-trading status covers derivatives. |
| Cash or spot virtual-currency trading | FinCEN MSB Registrant Search and NMLS, plus state regulator information relevant to your residence | CFTC guidance says spot platforms are not required to register with the CFTC, although the CFTC retains general anti-fraud and manipulation authority over spot markets. FinCEN MSB registration is not an approval or endorsement of a business. |
These checks are not interchangeable. For example, finding a business in FinCEN’s MSB search does not establish that it is authorized to operate a securities exchange, and a record for one affiliate does not automatically cover another entity’s service.
Consider what the platform lists—and how the asset is treated
Do not assume all tokens on one platform have the same legal status. The SEC’s March 17, 2026 crypto-assets interpretation describes categories including digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. The SEC’s educational page, “Crypto Assets and the Federal Securities Laws,” dated April 22, 2026 and reviewed May 15, 2026, explains that some stablecoins may be securities depending on their features, and that a tokenized security represents a financial instrument meeting the legal definition of a security.

For an asset or product you intend to use, check the current agency guidance and the platform’s description of the transaction. A token’s label, ticker, or availability on an app does not by itself settle its legal classification. Likewise, a platform’s listing standards or visible order book do not prove that it operates like an SEC-registered exchange.

- Search the legal name. Use the operating entity shown in the relevant customer agreement, then check any affiliate that provides the service. Search relevant people as well as firms where BrokerCheck or NFA BASIC applies.
- Use the database for the activity. Check SEC exchange and ATS records for securities-related exchange activity, BrokerCheck for broker-dealer firms and people, NFA BASIC for derivatives intermediaries, and FinCEN and NMLS/state sources for applicable money-services or state status.
- Compare the record with the claim. Confirm that the name, affiliate, service, jurisdiction, and registration category align. A company claim and an official public-record result are different kinds of evidence.
- Ask about gaps or discrepancies. If a search does not return the name—or does not match the company’s claim—ask the firm to identify the relevant entity, service, registration category, jurisdiction, or exemption. A missing result alone is not proof of wrongdoing; the firm may use a different regulated entity or rely on an exemption.
- Recheck before acting. Registration records, interpretations, asset classifications, and product availability can change. Use current official records for the exact service and your state.
The SEC’s “Broker-Dealers” guidance, published September 4, 2024 and reviewed April 24, 2026, explains broker-dealer concepts and points investors toward verification resources. For securities services, checking only a platform’s marketing page is not a substitute for checking the firm and, where relevant, its associated individuals.

Ask how the exchange works beyond its registration status
After identifying the relevant regulatory records, assess the platform’s actual operating terms. The SEC’s investor questions are useful prompts:
- Do you trade securities on this platform?
- Does the platform operate as an ATS?
- How does the platform select digital assets for trading?
- What are the trading protocols, and how are prices set?
- What fees apply, including any spread or withdrawal charge?
- Does the platform hold users’ assets? If so, how are those assets safeguarded?
Also compare which assets are available to customers in your state, who can access the service, whether orders are treated equally, how withdrawals work, and what the platform says about cybersecurity and protection of personal and trading information. Check whether its other services—such as custody or derivatives—are provided by the same entity or a related firm.

Interpret a clean record cautiously
A registration or a clean disciplinary record does not establish that an exchange is safe, financially sound, or suitable for your needs. The CFTC’s consumer guide, “Be Smart: Check Registration & Backgrounds Before You Trade,” warns: “Registration and a clean disciplinary record won’t protect you from fraud.” Treat public records as a way to verify relevant status and history, then assess the specific product, custody arrangements, fees, access, and operational risks separately.
