Self-custody gives you control of the private keys—and responsibility for protecting and recovering them. With third-party custody, a provider controls access to the keys, which may simplify account use but makes its security, policies, legal obligations and withdrawal process part of your risk.
Start with the question: who can move the crypto?
Private keys authorize transactions. The key question is not what a service calls itself, but who holds or controls the authority needed to transfer assets—and whether the provider or another party can initiate, block or override a transfer.

- Self-custody: You control the keys and take responsibility for securing them and maintaining access.
- Third-party custody: A provider, such as an exchange or specialist custodian, controls or administers access to the keys.
- Shared-key arrangements: Authority may be split among multiple parties. Determine who can combine the required approvals or otherwise bring about a transfer; a “multisig” or “self-custody” label alone does not answer that.
Hot and cold describe how a wallet connects to the internet or stores key material, not who controls the assets. Either self-custody or a third-party provider can use hot or cold storage, or a combination. A cold-storage claim therefore does not establish that you control the keys or that a provider has adequate legal or operational safeguards.
Compare the main custody models
| Arrangement | Who controls key authority? | What you take on or need to verify |
|---|---|---|
| Self-custody | You control the private keys. | You must set up and maintain the wallet, secure keys and recovery information, and plan for device loss or damage. A lost or compromised key can mean permanent loss of access. |
| Exchange-based custody | The exchange manages access to the keys. | Account convenience for trading comes with dependence on the provider’s security, asset-use policies, account controls, solvency and withdrawal process. Practices vary; verify the specific terms. |
| Dedicated third-party custody | A specialist provider holds or administers assets for a client. | Review its technical controls, contract, legal status, asset segregation, insurance and withdrawal procedures. Calling a provider “professional” does not establish these protections. |
| Shared-key or multisignature | Control is divided; the effective authority depends on how approvals can be combined. | Identify each party’s role, the number and combination of approvals required, and whether any party can independently or indirectly initiate a transfer. |
Assess security and asset-use practices
Ask the provider for specific answers rather than relying on labels such as “secure,” “insured,” “regulated” or “cold.” The SEC’s investor bulletin on crypto-asset custody recommends questions about key access, security, asset use, fees, privacy and provider failure.

- Genuine Check: confirm your signer is authentic during setup with the Ledger Wallet app.
- Protect your signer: keep it in mint condition at all times with a bespoke Pod or Case to avoid scratches and everyday wear and tear.
- Key access and storage: Where is key material held? Who can access it? Does the provider use hot wallets, cold wallets or both, and does it subcontract custody?
- Operational controls: What physical and cyber procedures protect keys and assets? Who approves transfers, and how are unusual transactions and incidents handled?
- Use of customer assets: Can the provider lend, pledge, rehypothecate or commingle customer assets? Is explicit consent required, and what does the contract say?
- Supported assets and networks: Confirm support for the exact asset and withdrawal network you intend to use. A token appearing in an account does not by itself establish that it can be sent over your preferred network.
- Insurance: Ask what assets and events are covered, who is insured, what limits and exclusions apply, and whether coverage protects customers against the risks you are concerned about. Do not assume that an insurance claim means your specific balance is protected.
- Privacy: Find out what identity and holdings information is collected, how it is used, and what privacy protections apply.
- Incident response and support: Check how the provider communicates during a freeze, breach or service outage and what escalation route is available.
A proof-of-reserves statement alone does not establish a provider’s liabilities, your ownership rights or protection in insolvency. Evaluate it, if offered, alongside the contract, applicable law and the provider’s other disclosures.
Check ownership and insolvency protections in your jurisdiction
The legal treatment of customer assets depends on the jurisdiction, service and contract. A provider’s statement that assets are “segregated” or “protected” is not a substitute for understanding what the relevant rules require and what happens if the provider fails.
European Union: MiCA requirements for covered providers
For crypto-asset service providers covered by MiCA, Article 75 sets requirements that include a client agreement describing the service, custody policy, authentication, security systems, fees and applicable law; a client position register; procedures to safeguard assets or access means; and procedures to return assets or access means as soon as possible. It also requires client assets to be segregated from the provider’s holdings, including through legal and operational segregation. Position statements must be provided at least quarterly and on request.

Article 70 requires covered providers to make adequate arrangements to safeguard clients’ ownership rights, especially in insolvency, and to prevent use of client crypto-assets for the provider’s own account. These are EU rules for providers and services within scope; they are not a universal guarantee or a description of protections in other jurisdictions.
United Kingdom: technical control and consultation guidance
The UK FCA Handbook’s PERG 18 describes safeguarding control by whether a firm can, by any means, bring about a transfer of the benefit of an asset. A firm presenting a service as self-custody must genuinely lack the means to bring about a transfer; a contractual promise not to exercise control does not settle the technical question. The relevant sections are marked as updated on 16 September 2026.
The FCA’s GC26/2 is consultation guidance, not a global rule. In its UK context, it identifies barriers such as hidden fees, complex withdrawal processes and opaque extended holds as poor practices, and discusses access to private keys, transaction records, switching and withdrawal to self-custody.

United States: distinguish investor education from proposals
The SEC investor bulletin is educational staff material, not a rule, regulation or Commission statement. Separately, the SEC’s Crypto@SEC entry dated October 1, 2026 describes proposed amendments for investment advisers and regulated funds, including conditional options involving adviser or fund self-custody and state trust company custody. As of that entry, these were proposed rules, not final rules. Neither source establishes the insurance or insolvency status of an individual retail customer’s exchange balance.

An account balance or display of assets is not the same as an assured ability to withdraw promptly. Before depositing, find out how an ordinary withdrawal works and what could delay or prevent it.
- Which assets and networks are available for withdrawal?
- Are there minimums, daily limits, transfer charges or asset-specific fees?
- What authentication, address allowlisting or waiting period is required?
- What processing time does the provider describe, and when can it impose a hold or restriction?
- Are there lockups or redemption periods for staked assets?
- How do you escalate a delayed withdrawal or account freeze?
- Can you export transaction history and move assets to a wallet you control?
Test the process and review its terms before committing an amount you may need to move quickly. Do not assume that an advertised processing time is a guarantee unless the applicable terms say so.

Compare total costs, not just the headline fee
Costs may arise at several points. Compare the full schedule for the assets and services you plan to use, including:
- asset-based custody charges;
- trading or transaction fees;
- withdrawal and network-transfer charges;
- setup or account fees; and
- closure or account-exit fees.
Also check whether fees change by asset, network, transfer size or service level. A low custody charge may not be the lowest-cost arrangement if withdrawals, transactions or account closure carry additional charges.

- Choose the control model. Decide whether you can reliably manage key security and recovery yourself or prefer a provider to administer access.
- Verify actual authority. Identify who holds or can combine the keys, who can authorize a transfer, and whether anyone can override or block your instructions.
- Read the provider’s terms. Look for asset-use permissions, commingling, segregation, insolvency treatment, applicable law, insurance limits and fee schedules.
- Confirm the operational fit. Check supported assets and networks, withdrawal steps and limits, processing expectations, lockups, support and incident escalation.
- Match the arrangement to your needs. Consider how much control you want, your ability to protect recovery information, how often you need access, and what legal and operational risks you are willing to accept.
If you choose self-custody, a physical hardware wallet is one possible cold-wallet device and typically has an upfront purchase cost, as the SEC bulletin notes. Buying a device does not remove the need to protect private keys and recovery information; no particular model is endorsed here.
