To check whether an industrial facility’s Title V air operating permit is current, identify the authority that issued it, find the latest final permit and later amendments, and verify the renewal record. Do not rely on the expiration date printed on an older permit alone: a timely, complete renewal application can extend a Title V permit while the agency processes it. The facility’s name and physical location are essential; without them, a site-specific status cannot be determined.
This guide covers U.S. Title V operating permits. A facility may also need separate preconstruction or other air authorizations, which must be checked independently.

What “current” means for a Title V permit
A Title V permit is an operating permit that brings together applicable Clean Air Act requirements, including operating terms and monitoring and reporting duties. EPA describes it as a legally enforceable document. Finding a permit PDF online, or seeing that its printed expiration date has passed, does not by itself establish whether it is operative today.

Most Title V permits are issued by state or local permitting authorities under approved Clean Air Act Part 70 programs. EPA administers Part 71 in specified settings, including Indian Country, the Outer Continental Shelf, some territories, and certain cases where an approved state or local program is absent or has not resolved an EPA objection. See EPA’s Part 71 information and EPA’s permitting-authority information to identify the appropriate jurisdiction.

What to gather before searching
- The facility’s legal or commonly used name.
- The physical street address, county, and state or territory.
- A known permit number or EPA facility identifier, if available.
- The specific facility or source: a company may operate multiple locations, and one site may have multiple permits or permitted units.
Search by both name and location where possible. If the facility identity or permit number differs across records, ask the issuing authority to confirm that the documents refer to the same source.
Where to find the permit record
Start with the state or local permitting authority
For a Part 70 permit, search the state environmental or air-quality agency’s permit database, facility page, or public docket. Some jurisdictions delegate permitting to a county agency or local air district, so check whether a local authority issued the permit. Search using the facility name, address, and permit number.
Search EPA’s Permit Hub as a second source
EPA’s Permit Hub displays permit-action documents submitted through CAAPS. Records can include applications, draft permits, statements of basis, responses to comments, and final permits. Its coverage depends on submissions by participating authorities; it is not a complete inventory of every state, local, or tribal air permit. An empty search result therefore does not prove that a permit does not exist.
Use the petition deadline table only for its intended purpose
EPA’s Title V public petition deadline table helps track proposed state, local, or tribal permits submitted for EPA review, including review and public petition periods. It is not a general register that establishes the current status of every final permit. The table’s displayed data was last updated September 17, 2026, when reviewed.

How to identify the operative permit
- Open the latest final permit issued by the responsible authority. An application or draft shows a pending or proposed action, not an issued final permit.
- Match the facility or source name and address, permit number, and issuing authority to the facility you are checking.
- Record the issue or effective date and the stated expiration date.
- Look for subsequent final actions in the agency docket, including renewal, administrative amendment, significant revision, transfer, revocation, or superseding permit.
- Check the permit’s cover page and renewal or expiration provisions, then ask the authority to resolve any conflicting identifiers or unclear status.
EPA’s Title V FAQ describes the usual permit term as five years and says the permit must state its expiration date. The facility’s actual permit and the issuing authority’s record determine the status of a particular permit.
How renewal can affect an expired date
A Title V permit may continue beyond its printed expiration date if the facility submitted a timely, complete renewal application. EPA’s FAQ describes a timely filing as at least six months, but not more than 18 months, before expiration. The date passing is therefore not enough to conclude that authorization ended.
Find the renewal application and related agency record, then confirm with the permitting authority whether the application was received on time, deemed complete, and remains under processing—or whether a later action reissued, amended, revoked, or superseded the permit. EPA’s 2026 renewal guidance says authorities may allow applicants to reuse prior application material when permit terms and applicable requirements have not changed, and may permit cross-reference or incorporation by reference when the referenced materials are available for public review. The format or brevity of a renewal filing alone does not establish whether a particular application qualifies for continuation; the agency record does.

- What is the latest effective final permit, and what effective amendments apply?
- What expiration date does the permit state?
- Was a renewal application received, filed timely, and deemed complete?
- Does the facility currently have authorization to operate under this permit, or has a later action changed or replaced it?
- Can the authority provide or point you to any relevant docket documents that are not posted online?
EPA’s Part 71 page and regional permitting information can help identify the appropriate EPA contact when EPA is the permitting authority.
Keep the status finding within its limits
State your conclusion as of a specific date and identify the facility and permit type—for example, whether a named facility’s Title V operating permit appears operative based on the issuing authority’s current record. Do not extend that finding to every authorization or to compliance. A Title V permit does not necessarily replace preconstruction approvals that may be required for construction or modifications, and permit status alone does not prove that the facility has met every applicable emissions, monitoring, recordkeeping, or reporting condition. See EPA’s Title V permit overview.
Members of the public may petition EPA to object to certain state, local, or tribal Title V permits under defined conditions. EPA generally requires petition issues to have been raised during the permitting authority’s public comment period, subject to limited exceptions. EPA’s petition information explains the process. This is relevant when following an active permit action, but it is not necessary for a routine check of whether a final permit remains operative.
