An ALPR alert is a lead, not proof that a vehicle or its driver is connected to a crime. Whether a court excludes evidence depends on the facts, the evidence’s connection to the challenged conduct, and the law in the jurisdiction where the case is pending.
This is a general U.S. legal overview, not advice about a particular case. State constitutional protections, discovery rules, suppression standards, and filing deadlines vary. If you have an active criminal case, speak promptly with a criminal-defense lawyer in the relevant jurisdiction.

What an ALPR hit does—and does not—show
An ALPR system uses cameras and software to read license plates and compare them with lists associated with matters such as stolen vehicles or investigations. A system may also retain scans with time and location information for later searches. An alert means the system found a possible match; it does not, by itself, establish that the plate was read correctly, that the source record was current, or that the driver committed an offense.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteThe first task is to identify what kind of use occurred. An immediate alert from a vehicle on a current list raises different questions from a later query of stored scans to reconstruct where a vehicle traveled. A stop based on an alert is also analytically separate from a later vehicle search, arrest, or warrant.

Start by finding out what police did and what evidence followed
Ask counsel to reconstruct the sequence from the first plate scan through the stop, any search, and the discovery of evidence. The key question is not simply whether an ALPR was involved, but what each officer knew at each point and how the evidence at issue was obtained.
- When and where did the camera read the plate, and what did the system return?
- What list or database produced the alert, which agency supplied the entry, and what was its status at the time?
- Did an officer visually compare the plate with the image or check the alert’s current status through dispatch or another system?
- What did dispatch communicate, and what did the officer observe independently before the stop?
- When did a frisk, vehicle search, arrest, or other search begin, and what justification did officers give for that separate action?
- Was stored ALPR data queried? If so, who requested it, for what purpose, and what time span and geographic area did the query cover?
- Was a warrant or other legal process obtained for a later query or search, and what information supported it?
A stop’s justification does not automatically answer whether a later search was lawful. Likewise, a concern about a stored-location query does not by itself establish that the initial stop lacked a valid basis.
Investigate a possible misread or bad database entry
Compare the original camera image with the machine-readable plate text. A character may have been misread; an alert may have concerned a stale stolen-vehicle or warrant entry; or a correct plate match may have been associated with the wrong vehicle or person. Those are different factual problems and may affect the justification for police action in different ways. An error does not automatically invalidate a stop: the legal result depends on what officers reasonably knew and the governing law.
Discuss preserving or requesting these records with counsel, where available under local rules:

In Green v. City & County of San Francisco (Ninth Circuit, 2014), the court’s account described occasional false hits and practices that included visually confirming a plate and checking current status. It also noted that the agency lacked a policy assigning verification responsibility at that time. That record can help frame questions about a particular system’s procedures; it does not establish one nationwide legal requirement.
Assess whether the stop or a later search had a lawful basis
For a challenge to the stop, the issue generally turns on the facts officers had before they acted and the legal standard that applies in that jurisdiction. Counsel will need to examine whether the alert was tied to the exact plate and an active, relevant record, what was verified, and what additional information officers had. Do not assume that an ALPR alert always authorizes a stop—or that an alert can never contribute to the basis for one.
For a frisk, vehicle search, home search, arrest, or warrant, identify the separate legal basis police relied on. A court may find a stop justified yet still need to consider whether a later search had its own lawful grounds. The sequence, reports, recordings, and warrant papers can matter to that analysis.

In United States v. Porter (Fifth Circuit, 2026), the court rejected the ALPR-related Fourth Amendment challenge in that case and addressed the alert as a basis for reasonable suspicion under the circumstances, including a collective-knowledge analysis. Its ruling does not decide every ALPR stop; its precedential reach depends on the applicable circuit, the facts, and the case’s posture.

Consider a separate challenge to stored location searches
If police searched historical ALPR records, investigate how much data they obtained: the time period, number of records, geographic coverage, query terms, purpose, and agencies or officers involved. Also determine whether police obtained a warrant or other legal process and what the application disclosed. These details help distinguish a targeted lead from a broad effort to trace a vehicle’s movements.
Arguments based on Carpenter v. United States have been raised in ALPR cases, but courts have not treated every ALPR query as equivalent to the historical cell-site records at issue there. In United States v. Yang (Ninth Circuit, 2020), the court affirmed denial of suppression in a case involving historical ALPR data for a rental vehicle not returned by its contract due date, distinguishing the circumstances from Carpenter. Porter also rejected the challenge before it. These decisions do not resolve how a different query, state constitution, or jurisdiction would be treated.

State statutes and local policies may govern permitted ALPR uses, access, logging, audits, and retention. They can help identify records to seek or a possible statutory argument. A policy or statutory violation does not automatically require suppression under the Fourth Amendment; counsel must determine what remedy, if any, local law provides.

- North Carolina: General Statutes §20-183.32 generally limits preservation of covered law-enforcement ALPR data to 90 days, subject to statutory exceptions. The statute also addresses preservation requests, updates, confidentiality, and disclosure limits.
- Virginia: Code §2.2-5517 lists permitted law-enforcement use categories and provides retention treatment for data or audit trails relevant to ongoing matters.
Ask counsel to check the version of the statute and policy applicable to the agency and the date of the scan. The rules in one state should not be assumed to apply elsewhere.
Preserve evidence and act promptly on discovery
Camera images, hit details, query histories, and system or vendor logs may be subject to deletion schedules or statutory retention rules. Ask counsel promptly to assess preservation and discovery options before relevant material is lost. The National Association of Criminal Defense Lawyers’ practitioner primer advises detailed discovery requests when it is unclear how law enforcement located a vehicle and notes that counsel may pursue a motion to compel; access and remedies remain subject to local rules and the case record.
Give a local defense lawyer the stop or search date and location, charging document, police reports, any warrant papers, and anything that mentions a plate-reader hit or vehicle-location query. Ask about preserving the records, obtaining discovery, the deadline for any suppression motion, and state constitutional or statutory grounds. There is no single national filing deadline established for these cases.

What the cases can—and cannot—tell you
| Decision | What it addressed | Limit to keep in mind |
|---|---|---|
| Green v. City & County of San Francisco (Ninth Circuit, 2014) | False-hit risks and verification procedures described in the record. | It is useful for investigating system practices, not proof of a universal verification rule. |
| United States v. Yang (Ninth Circuit, 2020) | Historical ALPR location data concerning a rental vehicle not returned by its contract due date; the court affirmed denial of suppression. | The court distinguished the case from Carpenter on its facts; it does not settle every historical ALPR query. |
| United States v. Porter (Fifth Circuit, 2026) | The court rejected the Fourth Amendment ALPR challenge in its case and considered an alert in its reasonable-suspicion analysis. | Its application depends on circuit, facts, precedent, and procedural posture. |
| State v. Simonson (Washington Court of Appeals, 2026, unpublished) | A Flock-derived lead and suppression arguments that included verification and preservation issues. | It is unpublished and Washington-specific, limiting its use elsewhere. |
| Robinson v. Commonwealth (Virginia Court of Appeals, 2026) | A suppression challenge involving Norfolk’s fixed-camera system and stored vehicle information. | It is Virginia-specific authority. |
| Commonwealth v. McCarthy (Massachusetts Supreme Judicial Court, 2020) | A limited fixed-camera configuration under Massachusetts and federal constitutional law; the court discussed how broader coverage could raise different privacy questions. | Its analysis is tied to Massachusetts law and the configuration before the court. |
These decisions illustrate why the jurisdiction, system, scope of data collection, and case facts matter. A lawyer should identify controlling authority where the case is pending rather than rely on a decision from another circuit or state.
