How to Challenge a GST Order That Ignores Your Reply

If a GST order does not address your filed reply, preserve proof of submission, identify the omitted points, and get prompt advice on the statutory appeal deadline and possible remedies.

If a GST adjudication order does not address a reply you filed, you can challenge the order by showing that the officer failed to consider material submissions, give reasons, or follow a required hearing procedure. Preserve proof of filing and the complete case record, then act quickly: under the central CGST Act, the ordinary first-appeal deadline is three months from communication of the order. A writ petition may be relevant in some cases, but it is not an automatic substitute for the statutory appeal.

This guide concerns India and the central CGST Act and rules. State and Union Territory GST laws are parallel in many respects, but confirm the law and procedure applicable to your order. It is general information, not case-specific legal advice.

What should you do first?

  1. Record the communication date. Keep the order and reliable proof of when and how it was communicated. The ordinary Section 107 appeal period runs from communication, not simply from the date printed on the order.
  2. Secure proof of your reply. Save the exact reply and every attachment as submitted, along with the portal acknowledgement or other receipt and date/time records. Keep later correspondence too.
  3. Compare the reply with the order. Identify each material argument or document that the order omits or disposes of only with a bare conclusion. Explain why that omission matters to the demand or the decision.
  4. Check hearing records separately. Preserve written hearing requests, hearing notices, adjournment requests, and attendance records. A failure to consider a filed reply and a failure to provide a required hearing are related but distinct grounds.
  5. Get prompt advice on the route and deadline. Appeal limitation, the amount payable before appeal, the demand breakup, and any possible writ remedy depend on the case and applicable enactment.

Why can an order that ignores a reply be challenged?

An adjudication order should show that the authority considered the taxpayer’s material submissions and reached a reasoned decision. Section 107(12) of the central CGST Act also requires the written appellate order to state the points for determination, the decision on them, and the reasons. In a challenge to an adjudication order, show concretely what you submitted, where it appears in the record, and what the officer failed to address; a general assertion that the order is unfair is less useful.

A bare statement that a reply is “not satisfactory” may be significant if the order does not engage with the substance of material points. Whether the omission warrants relief depends on the order, record, procedural history, and court or appellate authority considering the case.

How do you build a clear record of the omission?

Assemble these materials before preparing appeal grounds or consulting an adviser:

  • The full adjudication order, its date, and proof of when and how it was communicated.
  • The show-cause notice and all attachments, including any DRC summary and the underlying notice.
  • The exact reply as filed, all submitted documents, and the portal acknowledgement or other proof of delivery.
  • Written hearing requests, hearing notices, adjournment requests, and records showing attendance or non-attendance.
  • The demand breakup, admitted and disputed components, payment details, and any recovery communications.

A comparison table can make the alleged defect precise:

What to compare What to record
Reply point or document The argument or evidence submitted and where it appears in the filed reply or attachments.
Final order The finding that addresses it, or the passage that omits it or gives only a conclusion.
Why it matters How considering the point could affect an issue, finding, or part of the demand.

What is the ordinary statutory appeal route?

Section 107 of the central CGST Act provides a first appeal to the prescribed Appellate Authority against an adjudicating authority’s order. The Act generally allows three months from communication of the order. If sufficient cause prevented filing in time, the Appellate Authority may allow a further period of no more than one month. Confirm the applicable enactment, amendments, communication date, and current filing procedure before relying on these periods.

Section 107(6) requires full payment of admitted tax, interest, fine, fee, and penalty, plus 10% of the remaining disputed tax amount in relation to which the appeal is filed. Payment under that subsection deems recovery proceedings for the balance to be stayed under Section 107(7). Calculate the admitted and disputed components against the actual demand and verify the current law before filing.

The central appeal rules provide for Form GST APL-01 and supporting documents. They generally restrict additional evidence, subject to specified exceptions, including evidence refused below, inability to produce it for sufficient cause, or insufficient opportunity. Admission requires reasons to be recorded in writing; an appeal does not automatically let you introduce new material.

Section 107(8) provides for an opportunity of hearing before the Appellate Authority. Keep your hearing request and related notices as part of the record. Section 112 provides a further appeal route from specified Section 107 or 108 orders; verify current official notices and arrangements applicable to the particular order before relying on that route.

When might a High Court writ petition be relevant?

A taxpayer may ask a High Court to address a procedural or jurisdictional defect, including an alleged denial of natural justice. That possibility does not establish that a writ petition will be accepted instead of a statutory appeal, or that the court will set aside the order. The relevant facts, jurisdiction, limitation position, and available remedy matter, so obtain jurisdiction-specific legal advice promptly rather than allowing the Section 107 deadline to pass.

Route What it does Key point to assess
Section 107 statutory appeal Challenges the adjudication order before the prescribed Appellate Authority under the Act. Track the appeal period and assess admitted amounts, disputed tax, and the statutory pre-deposit.
Constitutional writ petition Asks a High Court to address an alleged procedural or jurisdictional defect. Relief is fact-specific; do not assume it bypasses the statutory remedy or guarantees a particular outcome.

Before choosing or pursuing a route, an adviser will need to assess the order and its communication date, applicable state or central law, proof and contents of the filed reply, omitted findings, hearing history, demand composition, and the relief sought.

What did the Delhi High Court decide in a close example?

In Delhi High Court W.P. (C) 8105/2023, signed on 30 May 2024, the taxpayer had submitted a detailed reply with supporting documents. The order called the reply unsatisfactory and confirmed the demand without substantively addressing it. The Court said the proper officer had to consider the reply on its merits and form an opinion. It set aside the order and sent the show-cause notice back for re-adjudication, a personal hearing, and a fresh speaking order. That result illustrates relief on those facts; it does not predict the outcome of another taxpayer’s challenge.

A separate Delhi High Court decision, W.P. (C) 15726/2024, signed on 14 May 2025, concerned a taxpayer who had not filed a reply and said there had been no effective opportunity to reply or be heard. The Court directed an opportunity to file a reply, a personal hearing, and consideration of submissions in a fresh order. It provides context on hearing opportunities, but it is not an example of an authority ignoring a reply that was filed.

What should you avoid assuming?

  • An order that fails to discuss your reply is not automatically quashed; the result depends on the record and applicable law.
  • A writ petition is not a guaranteed way to avoid the statutory appeal process or its deadline.
  • Filing an appeal does not, by itself, establish that new evidence will be admitted.
  • The central Act and rules may not resolve every state-specific procedure, amendment, notification, or current forum arrangement.
