1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesAudit the full path from data and vendor relationships to recommendations, human overrides, prices offered, and customer disclosures. For antitrust risks, investigate whether competitors share a pricing provider or sensitive information and how recommendations affect their decisions. For fairness risks, distinguish market-wide price changes from individual personalization, examine data and proxies, and test outcomes against the harms and legal standards relevant to the product and jurisdiction. Similar prices or unequal outcomes are signals to investigate—not proof, by themselves, of a violation.
Start by defining what the audit covers
Set the boundary before reviewing model performance. A pricing decision can involve more than a machine-learning model: rules, vendor software, business policies, human approvals, discounts, fees, and customer-facing explanations all affect the final price.

- System: identify the models, rules, software versions, vendor services, and any manual steps that influence a price.
- Scope: specify products, markets, customer groups, operators, locations, and the period under review.
- Decision authority: document who receives a recommendation, who can approve or change it, and what happens when the system is unavailable or challenged.
- Comparison basis: define which prices, transactions, customers, competitors, and time periods are relevant to the question being tested.
- Applicable rules: identify the jurisdictions and sector-specific requirements that may govern the business. U.S. agency positions and the OECD’s comparative review of G7 jurisdictions do not establish the law for every company or product.
Preserve the evidence needed to reconstruct decisions: data lineage and feature definitions; training and validation materials; model, rule, and prompt versions where relevant; input and output logs; recommendations; actual offers and transactions; override records; vendor contracts; and customer notices. Record the collection period and any gaps before analysis begins.
Run the audit as a traceable sequence
- Map the decision path. Diagram where each input comes from, how it is transformed, which system or person acts on it, and where the resulting offer is recorded. Include discounts, fees, and other adjustments that change the amount a customer pays.
- Inventory data and relationships. For each input and vendor, record its source, owner, refresh schedule, permitted use, retention, access controls, and whether it contains personal information or nonpublic information about competitors.
- Reconstruct recommendations and outcomes. Link recommendations to the prices actually offered and, where available, transactions. Track model and rule versions so a price can be tied to the system state that produced it.
- Test competition and customer-impact hypotheses separately. Use evidence suited to each question: information flows and participant conduct for competition concerns; individual data use and price outcomes for personalization and fairness concerns.
- Challenge the stated rationale. Compare the business explanation for a price difference with the inputs, rules, and observed outcomes. Investigate unexplained discrepancies rather than assuming they are unlawful or benign.
- Document findings and controls. State the evidence examined, the test performed, its limitations, the risk identified, the accountable owner, and the action or monitoring needed.
Test for coordination and sensitive competitor information
Competition analysis should examine the arrangement around the tool as well as its code. The OECD’s 2025 review of G7 jurisdictions identifies shared pricing software, hub-and-spoke arrangements, and exchanges of competitively sensitive information as recurring enforcement concerns. A shared tool or parallel prices alone do not establish an infringement; the relevant facts and legal elements depend on the jurisdiction.

Map shared providers and information flows
Determine whether one vendor or platform serves competing businesses in the same market. Trace what each participant supplies, what the provider can see or combine, what recommendations are returned, and what other participants could know or reasonably anticipate about the arrangement.
Pay particular attention to current or planned prices, discounts, costs, capacity, occupancy, inventory, and other nonpublic variables that could affect competitive decisions. Review contract terms and actual practices—not only vendor descriptions—to assess data isolation, aggregation or anonymization, access permissions, retention, and reuse. Ask whether the provider can use one participant’s information to shape another’s recommendation.

Trace recommendations into business decisions
Establish whether the system analyzes public information, aggregates nonpublic competitor data, suggests price floors or margins, sets starting prices, or executes prices automatically. Compare recommendations with offers and transactions, and examine what happens when a participant departs from a suggested price or a competitor changes its conduct. Record whether staff can override a recommendation and whether they actually do so.

Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →In its March 2024 statement of interest in a hotel-room pricing case, the FTC and DOJ argued that direct communications between competitors need not be shown at the pleading stage when a pricing intermediary is alleged to act in concert; they also said that user discretion over final prices does not automatically resolve the issue. That filing presents the agencies’ position in a particular case, not an adjudicated finding about every shared pricing tool. Deputy Attorney General Lisa Monaco put the DOJ’s position in the RealPage matter this way: “Price coordination using AI is still price coordination.” Her remarks concern government allegations in that matter, not a universal finding.

Separate market-based variation from individual personalization
Not every price difference is personalized. Prices may change with time, location, supply and demand, taxes, regulation, product-specific risk, or other market conditions. The audit should determine whether a price is set for a market or transaction generally, or whether information about a particular person—or an inference about that person—is used to set it.
Inventory personal data, inferences, and customer controls
List information collected directly, obtained from other sources, or inferred by the system. Include sensitive or intimate information and proxies that could produce unequal impacts. For each item, record its purpose, quality, consent or notice basis, retention, access, and role in the pricing decision. Check whether a customer can correct inaccurate information, understand why a price was personalized, and use a meaningful route to question or avoid that treatment.

Assess disclosure in context
The FTC’s proposed enforcement policy statement of 19 August 2026 is not a categorical ban on personalized pricing. It proposes that, where consumers reasonably expect prices not to vary based on personal information, a business should clearly and conspicuously disclose that a price is personalized, the basis for personalization, and the types of data used. The statement distinguishes individualized retail pricing from variation driven by shared market conditions and from individualized insurance or credit characteristics. The FTC’s policy-statement index identifies the August 2026 item as proposed. Treat it as a proposed U.S. enforcement position, not a final universal rule.
Test outcomes using measures suited to the risk
Choose measures only after defining the potential harm, affected population, and relevant legal or business question. There is no single fairness metric or protected-class standard established for every pricing use. A parity statistic alone cannot determine whether a price difference is lawful or fair; the relevant outcome, population, justification, countervailing benefit, and legal test vary by sector and jurisdiction.

Analyze price distributions and effective prices after discounts and fees, changes over time, recommendation acceptance and overrides, and outcomes across customer groups relevant to the product and governing rules. Test whether results are sensitive to input changes, and use representative edge cases as well as typical cases. Record the sampling method, uncertainty, exclusions, and data limitations so readers of the audit can distinguish a measured effect from an inference.
For competition concerns, examine whether recommendations and actual decisions move together, how firms respond to deviations, and whether shared inputs or a common provider plausibly explain the pattern. For customer-impact concerns, investigate unexplained group differences and compare them with the system’s stated rationale. Neither price similarity nor disparity, on its own, proves unlawful conduct or unfair treatment.
Use an evidence matrix to keep the review concrete
| Audit question | Evidence to inspect | Useful test | What a signal means |
|---|---|---|---|
| Can a provider combine competitors’ sensitive information? | Vendor contracts, data-flow diagrams, access logs, retention rules, and input definitions | Trace which participant can supply or receive each data category; verify isolation and permitted reuse in practice | A possible information-sharing or governance concern to assess under applicable competition law |
| How much does a recommendation shape actual prices? | Versioned recommendations, final offers, transactions, overrides, and deviation responses | Link recommendations to decisions over time and examine exceptions and competitor changes | Evidence about the role of the tool in business conduct; not a legal conclusion by itself |
| Is a price individualized using personal information? | Feature lineage, inference logic, data sources, notices, and price-level records | Compare decisions with and without person-specific inputs while holding relevant market conditions in view | A potential personalization, disclosure, or data-use issue requiring contextual review |
| Do customer outcomes differ in a way that needs explanation? | Prices after discounts and fees, customer segments relevant to the context, and stated business rationale | Compare suitable outcomes across relevant groups and periods; investigate unexplained differences | A signal for further analysis; the appropriate standard depends on law, sector, and harm |
| Can the system be corrected or stopped responsibly? | Change records, owner assignments, incident procedures, rollback plans, and customer challenge routes | Verify that escalation, correction, suspension, and review processes work for the deployed system | A control gap if accountable staff cannot respond to a material error or risk |
Set governance, remediation, and monitoring
Assign named owners for model and rule changes, vendor review, customer-impact review, incident escalation, and periodic monitoring. Define which findings require correction, additional analysis, or suspension of a feature or system, and establish a rollback path before it is needed. Reassess when data sources, vendors, markets, pricing objectives, model versions, or applicable rules change.
For each finding, keep the claim proportional to the evidence: distinguish a confirmed data flow from a suspected one, an observed disparity from a causal explanation, and an agency allegation or proposed policy from a binding legal outcome. The OECD’s 3 October 2025 G7 review is comparative rather than binding law, and the FTC and DOJ’s 2024 hotel-case filing and DOJ remarks describe agency positions in specific matters. A company-specific legal assessment must identify the applicable jurisdiction and sector rules.
