The right controls depend on what the technology does, whether it is experimental or in production, what data and decisions it touches, how it is sourced and changed, and how the institution monitors it.
Where AI and open-source software appear in finance
AI in financial services includes established machine-learning applications as well as newer generative AI. Financial institutions also use open-source software, vendor tools, and pretrained models; these categories can overlap. The OECD describes examples such as cloud-platform automation, machine-learning models for pricing and trading, automated trading and risk management, natural-language processing (NLP) and optical character recognition (OCR) for extracting and analyzing information, and large language models (LLMs) for analysis. Its report describes survey responses and examples, not a census of production deployments. It also distinguishes experimentation and tool development from use in service provision. The OECD report says that 95% of EU banks reportedly use and/or develop AI or machine-learning applications. That is a figure reported by the OECD, not a new census, and “use and/or develop” does not mean that every application is deployed in a customer-facing or consequential decision.

It describes generative AI’s potential as disruptive but still developing. Why “open source” and “AI” are not risk ratings
Open-source software is commonly understood through permissions to run, study, modify, and redistribute software; the exact rights and obligations depend on the applicable license. A publicly available model may likewise differ from a vendor-hosted service in how much of its components, parameters, or operating details are available. Neither openness nor a vendor relationship, by itself, establishes the system’s security, reliability, or suitability.
The Federal Reserve’s SR 04-17, issued on 6 December 2004, relayed federal banking, thrift, and credit-union agency guidance on acquiring and using free and open-source software (FOSS). It stated that FOSS risks were not fundamentally different from those of proprietary or self-developed software, while emphasizing risk management that addresses strategic, operational, and legal considerations. This is historical supervisory guidance, not a complete modern software-supply-chain or licensing framework. Federal Reserve SR 04-17
For an AI-enabled service, assess the model and its software components together with their use. A model’s risk changes with the decision it informs, the people affected, the data supplied, the amount of human review, and the consequences of errors. A component used in an internal experiment does not have the same deployment context as one embedded in a production process. This is why institutions should distinguish experimentation from actual deployment rather than treating every AI project as a live service.
How to assess an AI or open-source deployment
Use the same core questions for internally developed, open-source, and vendor-provided systems, then tailor controls to the answers. NIST’s AI Risk Management Framework (AI RMF) is voluntary; NIST says it is under revision. Its Generative AI Profile, published on 26 July 2024, recommends adapting existing controls to generative AI’s characteristics. It presents procurement and assurance measures as options, not universal legal requirements. NIST AI Risk Management Framework · NIST Generative AI Profile

| Assessment area | Questions to resolve |
|---|---|
| Purpose and impact | What task does the system perform? Does it inform or make a decision about customers, staff, trading, risk, or operations? What happens if its output is wrong? |
| Lifecycle and users | Is the system in experimentation, development, or production? Who uses the output, and what review or escalation is available before action is taken? |
| Source and change control | Who developed or maintains the model and software? What versions and dependencies are in use? Who approves modifications, patches, and upgrades? |
| Data and rights | What data enters or leaves the system? Is its use permitted, and how are data provenance, retention, and protection handled? What license obligations apply to use, modification, or distribution? |
| Evidence and monitoring | What evidence supports performance and reliability for the intended users, data, and operating conditions? How are performance, incidents, and changes monitored after deployment? |
| Continuity and accountability | Who owns the service and its risks? What happens if a maintainer or vendor stops supporting it, or the system becomes unavailable or unsafe? |
For third-party AI, NIST’s Generative AI Profile discusses due diligence and documentation that may include a software bill of materials (SBOM), service-level agreements (SLAs), and assurance reports. These can help clarify components, service commitments, and available evidence, but their value depends on what they actually cover. NIST also discusses data protection and provenance, retention, monitoring, incident response, impact assessment, and secure software development. These are guidance options rather than a blanket checklist imposed by law.
Test in the intended setting, then monitor
A passing benchmark or a successful demonstration does not establish that an AI system will be valid and reliable in a financial institution’s real operating conditions. NIST warns that pre-deployment testing may be inadequate, inconsistently applied, or mismatched to the deployment context; benchmark and anecdotal tests alone do not guarantee validity or reliability in real use. Testing should reflect the intended decision, users, data, and environment. For a system used in a consequential process, the institution should be able to explain what it evaluated, what limitations it found, who reviewed the result, and what conditions would trigger intervention or suspension. Monitoring and incident response matter because inputs, operating conditions, software dependencies, and model behavior can change after approval.
What the EU AI Act says about open-source GPAI
The EU AI Act contains a limited, conditional provision for certain providers of general-purpose AI (GPAI) models released under a free and open-source license. Under the consolidated text dated 27 July 2026, qualifying providers may be exempt from specified technical-documentation and downstream-documentation duties when model parameters, including weights, architecture information, and usage information are publicly available. The exemption does not apply to GPAI models presenting systemic risks. It also does not remove the provider’s copyright-policy obligation or the obligation to publish a sufficiently detailed summary of training content. Regulation (EU) 2024/1689, consolidated text

This is a provision about certain model-provider obligations, not a general exemption for banks or other downstream users of open-source AI. An institution’s duties still depend on its role, the system and use case, and the jurisdictions and other rules that apply. Do not infer that a model’s license settles questions of financial regulation, privacy, consumer protection, or cybersecurity.
In a 31 July 2026 announcement, the European Supervisory Authorities called for robust governance and risk management to mitigate ICT risks linked to frontier AI in EU finance and referred to ongoing and planned DORA oversight activity for critical ICT third-party providers. The announcement signals supervisory attention to technology and third-party risk; it does not, on its own, establish a broader legal exemption or a detailed set of obligations for every institution. Who should ask what inside a financial institution?
Board and senior leadership
- Where is AI used or planned, and which uses could materially affect customers, markets, risk, or critical operations?
- Is there an accountable owner for the institution’s AI strategy, risk appetite, and oversight of material deployments?
- Do governance and controls address both potential benefits and risks as applications expand?
ECB Banking Supervision’s stated expectation is that banks using new technologies, particularly AI, have strategies that reflect the opportunities and risks and robust governance and controls. The 2026–28 priorities make this a supervisory focus for banks in the ECB’s remit; they are not a universal legal statement for every financial firm or jurisdiction.
