A U.S. employer or sponsoring organization—not the artist—files the P-3 petition with U.S. Citizenship and Immigration Services (USCIS). The petition must show that the artist or entertainer will perform, teach, or coach in a culturally unique program, document the planned events, and include consultation with an appropriate labor organization. After petition approval, a beneficiary applying from abroad completes the DS-160 and follows the U.S. embassy or consulate’s visa procedures.
Who qualifies for a P-3 visa, and who files the petition?
P-3 is a temporary classification for an artist or entertainer coming to the United States individually, as part of a group, or as an integral part of a group performance. The proposed work may involve performing, teaching, or coaching under a culturally unique commercial or noncommercial program. It can include developing, interpreting, representing, coaching, or teaching a unique or traditional ethnic, folk, cultural, musical, theatrical, or artistic presentation. The event must further understanding or development of the art form.

The regulation defines “culturally unique” as “a style of artistic expression, methodology, or medium which is unique to a particular country, nation, society, class, ethnicity, religion, tribe, or other group of persons.” The P-3 regulation, 8 CFR 214.2, sets out the classification and petition requirements.

What evidence is required for a P-3 visa?
Organize the petition around both the authenticity of the artist’s or group’s skills and the cultural character of the actual events. A strong packet connects the evidence to the specific program rather than relying only on a general biography.
Evidence of authentic, culturally unique skills
Provide affidavits, testimonials, or letters from recognized experts attesting to the authenticity of the artist’s or group’s skills. Explain each expert’s credentials and how the expert knows the art form or the applicant’s work. Alternatively, include published material—such as newspaper or journal reviews—that documents the performance’s cultural uniqueness.

Evidence about the planned events
Describe the performances or presentations and show how each planned event is itself culturally unique. An itinerary and event descriptions should make the connection between the program and the relevant cultural form clear; evidence of an artist’s background alone does not establish the nature of every event.
Labor-organization consultation
Consultation with an appropriate labor organization is required for P-3 petitions involving culturally unique programs. Request an advisory opinion that evaluates the cultural uniqueness of the skills, states whether the events are cultural in nature, and addresses whether the event or activity is appropriate for P-3 classification. The regulation allows a labor organization to provide a letter of no objection instead of an advisory opinion when it has no objection. These are the regulation’s evidentiary criteria, not a guarantee that any particular submission will be sufficient.

What forms do I need for a P-3 visa?
The case has two stages, and the forms depend on which stage you are completing:
| Stage | Who acts | Form or filing |
|---|---|---|
| USCIS petition | U.S. employer or sponsoring organization | The P petition is filed with USCIS using Form I-129, with the applicable petition materials and supporting evidence. USCIS’s employment-based nonimmigrant reference guide identifies Form I-129 and P-3 procedures; check USCIS’s current form instructions and fee information before filing. |
| Visa application abroad, after petition approval | Artist or entertainer applying for a visa | Submit the Department of State’s online Form DS-160 and retain its barcode confirmation page for the interview process. |
The USCIS petition fee, filing address, and current Form I-129 edition can change. Confirm the current USCIS instructions immediately before submitting rather than relying on an older article or form. The DS-160 is for the beneficiary’s visa application abroad; it does not replace the employer’s USCIS petition.

How do I apply for a P-3 visa?
- Prepare the program and evidence. The U.S. petitioner should assemble the event descriptions and itinerary, evidence of the cultural uniqueness and authenticity of the skills, and the required labor-organization consultation.
- File the P petition with USCIS. The employer or sponsoring organization submits the P petition, including Form I-129 and supporting materials, under current USCIS instructions. A petition may not be filed more than one year before the actual need for the services, under 8 CFR 214.2.
- Wait for the petition decision. Petition approval is the prerequisite for the beneficiary to apply for a P visa or seek admission in P-3 status. Do not treat the petition and visa application as interchangeable steps.
- Complete the DS-160 if applying for a visa abroad. Submit it electronically and keep the barcode confirmation page. The Department of State says applicants do not need to print the full DS-160 application. See the DS-160 instructions.
- Schedule the interview and follow the post’s directions. The applicant schedules the interview directly and follows the selected embassy or consulate’s instructions for payment and supporting documents. Interview procedures can differ by post; check its current instructions.
- Choose an appropriate visa post. Current Department of State guidance generally directs applicants to interview in their country of nationality or residence. Applicants whose nationality has no routine visa operations should use the designated processing post. Review the Department of State interview-location guidance, updated July 15, 2026, and confirm the applicable post’s procedures.
How much does a P-3 visa application cost?
The Department of State lists a $205 nonimmigrant visa application processing fee for petition-based categories, including P visas. This is the visa application fee, is nonrefundable, and is separate from the USCIS petition fee. The State Department fee schedule was accessed in 2026; check the current fee schedule and the selected post’s payment instructions before applying. A visa issuance fee may also depend on nationality.

How long can P-3 status last, and can family members come?
Under 8 CFR 214.2, petition validity is for the time needed to complete the event or activity, up to one year. One-year extensions may be authorized to continue or complete the same event or activity.
A spouse and unmarried minor children may qualify for P-4 status while accompanying or following to join the P-3 beneficiary. They may not work unless separately granted employment authorization.
