Canada has no single approval that covers every oil pipeline. The first question is whether the proposed pipeline is federally or provincially regulated; the project’s review route and required permits then depend on its characteristics, location, and applicable laws. For projects subject to federal impact assessment, that assessment is distinct from the regulator’s authorization to build and from other permits the project may need.
Start by identifying the regulator and review route
Natural Resources Canada (NRCan) says a pipeline needs permission to be constructed from the appropriate federal or provincial regulator. Federal oversight does not apply to every oil pipeline, and the impact assessment process is not a universal national pipeline permit.

For a specific proposal, the route depends on factors including which regulator has jurisdiction, the project’s length and right-of-way, whether it is a designated project under the Impact Assessment Act (IAA), and what other authorizations its route or activities may require. The federal government’s plain-language summaries provide general markers; the legislation and regulations, applied to the project’s facts, determine the legal requirements.
Two NRCan thresholds describe different things
| NRCan summary | What the threshold refers to | What it does not establish by itself |
|---|---|---|
| 40 km or more of new pipeline | NRCan describes this as the threshold for a public hearing before a decision for a major pipeline project. | It is not the same measure as new right-of-way, and does not by itself establish that the project is subject to an IAA assessment. |
| 75 km or more of new right-of-way | NRCan’s federally regulated petroleum-pipeline FAQ says new pipelines requiring this amount of new right-of-way are subject to the IAA assessment process described there. | It is not a 75 km pipeline-length threshold. Applicability to a particular project must be checked against the law and project facts. |
These summaries should not be collapsed into a single cutoff: one concerns new pipeline length and a public hearing, while the other concerns new right-of-way and an assessment. NRCan’s pages do not show a publication year for these threshold summaries.

How a federal impact assessment proceeds
The Impact Assessment Agency of Canada (IAAC) describes a general process for projects that require federal impact assessment. It has five broad phases; the details and route can vary by project.
1. Planning and initial project description
The proponent submits an Initial Project Description outlining the proposed project, its location, and potentially affected communities and Indigenous Peoples. IAAC posts it to the Canadian Impact Assessment Registry for comment, reviews issues raised, considers potential adverse effects within federal jurisdiction, and determines whether an impact assessment is required. The Agency also discusses cooperation with relevant jurisdictions.
If an assessment proceeds, IAAC issues project-specific Tailored Impact Statement Guidelines. They set out the studies and information the proponent must provide, expectations for engagement, and permits that may be needed.

2. The proponent prepares an Impact Statement
The proponent studies potential effects, engages Indigenous Peoples and the public, and submits a technical Impact Statement in response to the tailored guidelines. The statement describes expected impacts and proposed mitigation. IAAC, federal experts, Indigenous Peoples, and public participants review it; IAAC may request additional information before the assessment phase begins.
3. Assessment and report
IAAC analyzes effects within federal jurisdiction using the Impact Statement and input from Indigenous Peoples, the public, federal experts, other jurisdictions, and other participants. Its report sets out the evidence and Indigenous Knowledge considered, analyzes direct and indirect adverse federal effects and their significance, and proposes feasible mitigation measures and conditions.
4. Decision
The Minister makes the decision or refers it to the Governor in Council. The Decision Statement tells the proponent whether the project may proceed, specifies any enforceable conditions and follow-up measures, and may set a deadline for starting the project. IAAC says the Decision Statement is a legally binding document.

5. Follow-up and compliance
After the decision, IAAC may inspect compliance with binding Decision Statement conditions and track whether predicted impacts and mitigation measures were accurate and effective. The public and Indigenous Peoples may be involved in follow-up. IAAC states that failing to comply with the Decision Statement is a violation of federal law.

The five-phase description is a general guide, not a promise that every federal review follows an identical procedure. Some projects use an integrated assessment or review panel with the lifecycle regulator. IAAC describes a panel route that can include public hearings, an assessment report, a decision, and post-decision licensing or compliance responsibilities. The applicable project record and legal regime determine whether this route applies.
Assessment is not the same as every required permit
A favorable impact-assessment decision does not automatically issue all authorizations needed to construct or operate a pipeline. Depending on the project, separate federal authorizations may be required under regimes covering matters such as fisheries, species at risk, or navigable waters. Provincial or territorial approvals may also apply.

For designated projects, IAAC develops a permitting plan describing permits, licences, and authorizations that may be required; it can be revised as project information changes. Federal permit processes can be prepared concurrently with the impact assessment, but IAAC says those authorizations may be issued only after the project is allowed to proceed under the IAA. The plan helps identify likely requirements; it does not replace the decisions of the authorities responsible for them.

Public participation can occur during planning and review, including through comments on the Initial Project Description and participation in hearings where a hearing is part of the process. IAAC’s process page states: “Meaningful engagement and consultation with Indigenous Peoples and the public is integral to the impact assessment process.”

During an impact assessment, IAAC leads federal consultation from planning through decision. It identifies Indigenous groups whose rights may be adversely affected, offers participation funding, coordinates federal authorities and lifecycle regulators as appropriate, and works with groups to understand concerns and possible solutions. The assessment considers effects on Indigenous Peoples and impacts on constitutionally recognized and affirmed rights; Indigenous Knowledge is also integrated into the process.

Consultation is tailored to potential effects and project context. It is a legal Crown process involving listening and consideration, and may involve accommodation where appropriate. It should not be treated as a guarantee of project consent or as a universal individual veto. Project-specific rights, agreements, and legal issues require attention to the relevant record and law.
How long does approval take?
IAAC’s general process page says the Agency aims to complete assessments in two years. That is an agency aim, not a guaranteed deadline for all approvals or the total time from proposal to construction. Proponent studies, panel proceedings, consultation, and separate permits can affect a project’s schedule. The official process summaries do not establish one reliable duration for every Canadian oil-pipeline approval.
Where to check a named pipeline project
For a particular proposal, use its Canadian Impact Assessment Registry record, identify the relevant federal or provincial regulator, and review the current legislation and regulations, decision documents, permitting plan, and applicable provincial or territorial approvals. The project record is necessary to establish which review route and conditions actually apply.
