Public-space CCTV captures images within a camera’s view, then may transmit them for live viewing, recording, storage, retrieval or controlled disclosure. Privacy protections should limit why cameras are used, what they capture, how long footage is kept, and who can access it. The legal guidance below is explicitly about the UK, with the Surveillance Camera Code applying to covered overt systems in England and Wales; rules elsewhere differ.
How does CCTV work in public places?
A camera captures images of people and places in its field of view and sends them to a system that may support live viewing, recording, storage, retrieval and export. A system may not be continuously watched or may not record continuously. In England and Wales, the Surveillance Camera Code applies to covered overt public-space systems whether or not they are live-viewed or recording. When footage may be used in a police investigation, the system needs to preserve useful evidence. UK police guidance calls for controlled access, logs showing who accessed recordings and when, preservation of relevant footage before it is overwritten, and usable exports that include date and time information and the software needed for playback. What privacy protections should govern a public CCTV system?
Purpose, necessity and lawful basis
An operator should identify a specific problem the cameras are intended to address, document an appropriate UK GDPR Article 6 lawful basis, and show that surveillance is necessary and proportionate. Consent is often impractical in public spaces; depending on the operator and context, legitimate interests or public task may be relevant. Operators should consider less intrusive ways to address the problem, such as improved lighting or environmental changes, rather than treating available camera equipment as sufficient justification. The Home Office Code states: “Surveillance camera systems operating in public places must always have a clearly defined purpose or purposes in pursuit of a legitimate aim and be necessary to address a pressing need (or needs).” Home Office: Amended Surveillance Camera Code of Practice, paragraph 1.1
Impact assessment and minimization
A data protection impact assessment (DPIA) is required when processing is likely to create high risk. The ICO says that this applies in most cases involving surveillance because of its inherent privacy risks. The assessment should help determine whether cameras are justified and how to reduce their impact. Camera views should be limited to places relevant to the stated purpose; privacy zones can mask areas that do not need to be monitored. ICO guidance on surveillance systems

Notice and transparency
People should be told about surveillance before they enter a camera’s field of view. Prominent signs should appear before the monitored area and identify the system’s purpose; they should also direct people to fuller information, such as a privacy notice explaining the operator and how to make contact. A notice on a website alone does not alert someone approaching a monitored space. ICO guidance on surveillance systems
Retention and deletion
There is no universal UK number of days for keeping CCTV footage. The UK GDPR and Data Protection Act 2018 do not prescribe a specific minimum or maximum retention period for surveillance recordings. Operators should set and document a retention policy tied to the system’s purpose, keep footage only for as long as needed, and delete it securely afterwards. Relevant footage may be preserved longer for a specific active investigation. ICO: How can we comply with the data protection principles when using surveillance systems?

Access, disclosure and security
Access to live and stored footage should be restricted to people who need it for an authorized purpose, and handling should be recorded. Disclosure to police may be appropriate under applicable rules; wider disclosure can expose bystanders’ personal information, so identifying details may need to be obscured. Operators should use technical and physical safeguards and audit whether those controls are working. Home Office: Amended Surveillance Camera Code of Practice
Ongoing review
Operators covered by the Code should review whether a system remains necessary, proportionate and effective at least annually. If its purpose, field of view or use changes, the operator should assess whether the original justification and safeguards still fit. Home Office: Amended Surveillance Camera Code of Practice

How can you assess a CCTV proposal?
When reviewing a proposal or asking an operator about a system, consider these points together rather than judging it by camera count alone:
Crashes, No Sound, or Screen Glitches?
Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minutePC Slower Than It Used to Be?
A free scan shows the junk files, broken settings and background clutter dragging Windows down - then fixes them in one click.Free scan · Windows 10 & 11- What defined purpose and evidence of need justify the system? Were less intrusive options considered?
- Where do cameras point, and are privacy zones used to exclude irrelevant areas?
- Is the system live-viewed, recording, or both?
- What retention period is documented, and how is footage securely deleted?
- Who can view or disclose footage, how are access and handling logged, and what safeguards protect the system?
- Where are signs placed, where can people find fuller privacy information, and how can they contact the operator?
- Does the system use ANPR or facial recognition as well as ordinary video capture?
How are ANPR and facial recognition different from ordinary CCTV?
Ordinary video records images; automatic number plate recognition (ANPR) and facial recognition can make surveillance more searchable or identifying. Connected ANPR databases and facial-recognition systems may process personal data about large numbers of people and can be particularly intrusive. Facial recognition used to uniquely identify people may process biometric special-category data, which requires additional legal conditions and safeguards. These technologies should not be treated as merely another way to record video. ICO: Video surveillance, including guidance for organisations using CCTV

Where does this guidance apply?
The Surveillance Camera Code points described here concern covered overt public-space systems in England and Wales. Covert surveillance by public authorities is governed by a different statutory regime, and UK data-protection rules should not be assumed to apply elsewhere.
