Yes. In the United States, records held by a platform, employer, business, or cloud provider can be sought and potentially used as evidence against you—but they are not automatically available, admissible, or conclusive. The rules depend on who is requesting them, what kind of record is involved, how it is obtained, and the applicable jurisdiction.
What it means when someone else holds your data
“Ownership” is not the only issue. A record may be in a provider’s possession or control even though it concerns your account. Whether it can be obtained depends on the record, the legal process, and the protections that apply. A provider’s custody does not by itself erase privacy interests, privilege, or other legal limits.

How the government may seek records from a provider
For U.S. federal government requests, 18 U.S.C. § 2703 distinguishes communications content from subscriber records and other non-content information. The process available varies with the data category and statutory conditions; there is no single rule that a warrant is required for every record or that a subpoena obtains everything. Read 18 U.S.C. § 2703.

The Department of Justice also has policies for obtaining documentary material held by third parties. Its Justice Manual says the policy is intended to protect against unnecessary invasions of personal privacy and states that, normally, a search warrant should not be used to obtain documentary materials held by a disinterested third party. That is DOJ policy, not a universal constitutional rule or an absolute prohibition; the manual describes exceptions. See the DOJ Justice Manual guidance.
Provider-held email, social media, and cloud materials can raise additional issues. DOJ guidance recognizes concerns that can arise when such material includes attorney-client communications. A provider’s possession alone does not eliminate privilege or other protections. See DOJ evidence guidance.

Preservation is different from disclosure
Under 18 U.S.C. § 2703(f), a governmental request can require a provider to preserve records and other evidence already in its possession while further legal process is pursued. The statute says the provider “shall take all necessary steps to preserve records and other evidence in its possession.” It sets an initial 90-day preservation period, with a possible additional 90 days on renewed request. These are statutory preservation intervals—not a promise that a provider retains every category of data for that long, or a description of ordinary commercial retention schedules. See § 2703(f).
How civil subpoenas differ from government investigations
A subpoena in a federal civil case is a discovery tool, not the same process as a government criminal investigation. Federal Rule of Civil Procedure 45 governs subpoenas to nonparties. It provides for objections and allows a court to quash or modify a subpoena in specified circumstances, including undue burden or disclosure of privileged or otherwise protected material. If electronically stored information is requested, the recipient must produce it in its ordinary form or a reasonably usable form if the subpoena does not specify a form. Application depends on the case, local rules, and court orders. Read Federal Rule of Civil Procedure 45.

The Federal Rules of Civil Procedure govern civil proceedings in U.S. district courts. The U.S. Courts rules page reports that Civil Rules 16 and 26 and new Rule 16.1 took effect December 1, 2025, and that the Civil Rules were last amended in 2025. Consult the current rule text and any case-specific orders when a deadline or procedure matters. Check the current Federal Rules of Civil Procedure.
Cloud records and device searches are not interchangeable
A phone or computer may hold local files while a provider separately holds account content, logs, backups, or other records. Consent or legal process to search a device does not by itself authorize collection of separate data held by a cloud provider. The Scientific Working Group on Digital Evidence (SWGDE) advises practitioners to consider provider user-notification policies where relevant; notice is not universal and may be legally restricted. Read SWGDE guidance on cloud evidence collection.

A record obtained is not automatically proof
There are separate questions: Was the record requested through an applicable process? Was it lawfully obtained? Can its source and integrity be authenticated? Is it admissible? And what does it actually show in context? A copy of a record does not, by itself, establish who created it, whether it is complete or accurate, or what conclusions should be drawn from it.
