The Union Home Secretary or the State Government Secretary in charge of the Home Department normally issues the written, reasoned order. It must identify the statutory reason, affected area and telecom service, consider reasonable alternatives, be published, and last no more than 15 days. A review committee examines it within five days, and affected people can seek judicial review, including before a High Court under Article 226.
The 2024 Rules govern new orders under the Telecommunications Act, 2023. They replace the 2017 suspension rules for new orders, while transition provisions deal with orders made earlier. The Supreme Court’s constitutional safeguards in Anuradha Bhasin v. Union of India—especially proportionality, necessity and the ban on indefinite suspension—remain essential.

What is the legal path for a new shutdown order?
The process has four linked stages: a competent authority decides whether suspension is legally necessary; the order is written and published; a statutory review committee examines compliance; and courts remain available to test legality and proportionality.

- Decision and authorization: The Union Home Secretary or the State Home Department’s Secretary is the competent authority. In an unavoidable emergency, an authorized officer of at least Joint Secretary rank may issue the order, but the competent authority must confirm it within 24 hours or the order ceases to exist.
- Written order: Reasons must be recorded. The order must state the specific statutory reason, geographical area, type of telecom service affected and a duration of no more than 15 days. Before signing, the authority must consider whether the objective can be achieved through another reasonable means.
- Publication and referral: Every suspension order must be published, and a copy must reach the relevant review committee within 24 hours.
- Independent legal challenge: The review committee can set aside a non-compliant order, but committee review does not replace access to a court. Judicial review remains available throughout.
An order therefore is not valid merely because a senior official signs it or because a public-order concern is asserted. The document must connect the stated emergency or public-safety objective to a geographically and technically defined restriction and explain why a less restrictive response would not work.

Who can order an internet shutdown in India?
Ordinary route
For the Central Government, the competent authority is the Union Home Secretary. For a State Government, it is the Secretary in charge of the Home Department. The 2024 Rules do not make a district police officer, district magistrate or telecom operator the ordinary issuing authority.
Emergency route
An unavoidable circumstance can require action before the competent authority is able to sign. In that narrow situation, an officer who has been authorized by the competent authority and is at least Joint Secretary rank may issue the order. Confirmation is mandatory within 24 hours. Without confirmation, the emergency order stops existing; it is not an open-ended delegation.
What the authority must decide
The authority must apply the statutory grounds in Section 20 of the Telecommunications Act, 2023 and record reasons showing why suspension is necessary. It must consider a reasonable alternative, such as a narrower technical restriction or a response directed at the specific service or area involved. The rule does not permit a blanket suspension simply because it is administratively convenient.
What must a shutdown order contain?
The 2024 Rules require enough detail for the public, operators and a court to understand exactly what has been restricted. A legally complete order should make each of these elements identifiable:
- Reason and statutory basis: the particular public-emergency or public-safety reason being addressed, rather than a conclusory reference to “security.”
- Recorded reasons: an explanation linking the facts relied upon to the need for suspension.
- Geographical scope: the districts, areas or other boundaries covered.
- Service scope: the type of telecom service affected; a restriction should not silently extend beyond what the order states.
- Duration: a stated end point no later than 15 days after issuance.
- Publication: public access to the order itself, not merely an announcement that a shutdown exists.
These particulars matter when residents, journalists, businesses, hospitals or schools need to determine whether their connection is covered and whether the restriction exceeds its written terms. They also make it possible to test necessity and proportionality rather than arguing from rumor.

How is an order reviewed?
Referral within 24 hours
The issuing authority must send the order to the appropriate review committee within 24 hours. This referral is a procedural safeguard, not a discretionary courtesy.
Central Government committee
The central committee is chaired by the Cabinet Secretary. Its other members are the Secretary of the Department of Legal Affairs and the Secretary of the Department of Telecommunications.
State Government committee
A state committee is chaired by the Chief Secretary. It also includes the Secretary of the state Law Department or the Legal Remembrancer in charge of legal affairs, plus another state secretary who is not the Home Secretary.
Five-day meeting and possible setting aside
The relevant committee must meet within five days of issuance. It records whether the order complies with Section 20(2)(b) and Section 20(4) of the Telecommunications Act. If the committee finds non-compliance, it may set the order aside.
The five-day schedule is the current rule’s review timetable. It should not be confused with the Supreme Court’s earlier direction for periodic review under the 2017 framework. A committee’s conclusion also does not prevent a directly affected person from approaching a court.

Are shutdown orders published?
Yes. Publication is an express requirement of the 2024 Rules. The public should be able to obtain the operative order, its reasons, the area covered, the service affected and the duration. A press statement that omits the order or its reasoning makes it harder to know what is being challenged and whether officials have exceeded the stated scope.

Publication also has a constitutional function. In Anuradha Bhasin, the Supreme Court treated access to suspension orders as necessary for effective judicial review. People cannot meaningfully contest an undisclosed restriction.
In a separate 2024 proceeding concerning Jammu and Kashmir, the Internet Freedom Foundation reported that the Supreme Court took the prima facie view that review-committee findings should be published, while committee deliberations need not be. That point should be understood as an account of the 2024 proceeding, not as a substitute for the text of the Court-hosted order. The 2024 Rules themselves expressly address publication of suspension orders.
What changed from the 2017 Rules and Anuradha Bhasin?
The 2017 Rules were the framework before the Telecommunications Act, 2023 and the 2024 Rules. In January 2020, the Supreme Court identified constitutional limits because the earlier rules did not set a maximum duration. The current procedure incorporates a defined period and a faster committee timetable, but the constitutional test still governs every restriction.
| Issue | 2017 framework and Supreme Court directions | 2024 Rules for new orders |
|---|---|---|
| Primary legal framework | Temporary Suspension of Telecom Services (Public Emergency or Public Safety) Rules, 2017, considered in Anuradha Bhasin | Telecommunications (Temporary Suspension of Services) Rules, 2024, made under the Telecommunications Act, 2023 |
| Maximum duration | No express outer limit in the 2017 Rules; the Supreme Court required periodic review and rejected indefinite suspension | Each order may run for no more than 15 days |
| Review timing | The Court supplied periodic-review safeguards to cure the absence of a time limit; a seven-working-day direction belonged to that earlier context | The statutory review committee must meet within five days of issuance |
| Publication | The Court required publication to make judicial review effective | Publication of every suspension order is expressly required |
| Constitutional standard | Restrictions must be necessary, proportionate and limited in duration | The same proportionality and necessity requirements continue to apply |
The Supreme Court stated: “An order suspending internet services indefinitely is impermissible under the Temporary Suspension of Telecom Services (Public Emergency or Public Service) Rules, 2017.” It also held: “Any order suspending internet issued under the Suspension Rules, must adhere to the principle of proportionality and must not extend beyond necessary duration.” Those quotations describe the 2017 rules before the Court; they remain important constitutional principles, while the 2024 Rules supply the present procedural machinery.

What rights are engaged by a shutdown?
The Court held that freedom of speech and expression under Article 19(1)(a), and the freedom to practice a profession or carry on a trade under Article 19(1)(g), include use of the internet. Those rights are not absolute: restrictions can be valid when authorized by law and justified under constitutional standards. The key questions are whether the stated objective is legitimate, whether a shutdown is rationally connected to it, whether a less restrictive measure could achieve it, and whether the burden and duration are proportionate.
An indefinite suspension is impermissible. Even a time-limited order must end when the necessity ends; the 15-day ceiling is not permission to suspend automatically for the full period.

1. Obtain the operative order
Use the publication required by the 2024 Rules and preserve the order, any later extension or replacement, and notices from the telecom or local administration. Record when service stopped, which services failed and where you were located.
2. Identify the decision-maker and timeline
Check whether the signatory is the competent Home Secretary or an authorized Joint Secretary-rank officer. For an emergency order, check whether confirmation occurred within 24 hours. Note the issue date, stated end date and the date the review committee should have met.
3. Test the order against its required particulars
- Are reasons actually recorded, or is the document conclusory?
- Is the statutory ground identified?
- Are the geographic boundaries and telecom service precisely described?
- Was a reasonable alternative considered?
- Does the restriction run beyond 15 days or continue after necessity has ended?
- Was the order published and sent for review within the required time?
4. Choose the forum
The Supreme Court made clear that judicial review cannot be removed or rendered ineffective. A person affected by the restriction may file before the jurisdictionally appropriate High Court under Article 226, or use another appropriate forum where the facts and relief justify it. A petition can seek production of the order, a declaration that it is unlawful, interim restoration of service, or an order narrowing or ending the restriction.

5. Present evidence and focused relief
Attach the order, proof of location or service impact, affidavits from affected users, and evidence of less restrictive options that were available. Explain the practical harm—such as inability to work, study, obtain medical information or communicate—and connect each point to a legal defect. Courts can examine both procedural compliance and proportionality; a petition is stronger when it asks for a precise remedy instead of making an unsupported claim that every shutdown is unconstitutional.
What can the review committee or court do?
The statutory committee may set aside an order that does not comply with the Act. A court can independently review the order, require disclosure, suspend its operation while the case is heard, or invalidate a restriction that lacks legal authority, reasons, proportionality or a necessary time limit. Committee review is therefore an additional safeguard, not a substitute for judicial oversight.
Why did Parliament’s communications committee call for further safeguards?
The Standing Committee on Communications and Information Technology, in a report submitted on 1 December 2021, raised policy concerns about undefined suspension grounds and review committees composed largely of executive members. It recommended clearer parameters for “public emergency” and “public safety,” a mechanism to assess whether a shutdown is warranted, uniform guidance for states, more inclusive review committees, selective restrictions instead of disabling the entire internet, and study of effects on the economy, press, education, health and shutdown effectiveness.

Those recommendations are important context, but they are not additional binding requirements of the 2024 Rules. The enforceable checklist for a new order comes from the Telecommunications Act, the 2024 Rules and the constitutional standards explained by the Supreme Court.
Quick Recap
Practical checklist for affected users and organizations
- Download and preserve the published order and every amendment.
- Map the named area and service against the actual outage.
- Write down the start time, restoration time and any intermittent pattern.
- Check the issuing officer, confirmation (if emergency procedure was used) and stated duration.
- Look for reasons, statutory grounds and discussion of reasonable alternatives.
- Track whether the review committee met within five days and whether its finding was published.
- For urgent harm, seek interim relief from the appropriate High Court under Article 226 rather than waiting for the suspension to expire.
