The key checks are who supplied the service, which Indian establishment received it, and where the place of supply falls—not whether the invoice was paid in rupees or foreign currency. The Central Board of Indirect Taxes and Customs (CBIC) says currency is immaterial in its FAQ on foreign software bought for use in a GST-registered firm.
Start with the import-of-services test
Under the IGST Act, a service is an import of services when three conditions are met: the supplier is located outside India, the recipient is located in India, and the place of supply is in India. For the registered-business example in its sectoral FAQ, CBIC says IGST is payable under reverse charge when the purchase meets this test.

Do not decide the tax treatment from the product label alone. “SaaS,” “software subscription,” “cloud service,” and “online database access” describe what a vendor sells, but the legal analysis depends on the transaction and the applicable place-of-supply rule. The general rule for cross-border services points to the recipient’s location, subject to statutory exceptions. OIDAR services have a recipient-location rule of their own.
CBIC’s FAQ answers the currency question directly: “The factum of which currency was used to pay the consideration is immaterial.” Paying an overseas supplier in Indian rupees therefore does not, by itself, remove a transaction from the import-of-services or reverse-charge analysis.

Build a transaction file before deciding how to report it
For each subscription, collect the records that establish the parties, recipient and service period. This matters especially when a company has more than one GST registration or a vendor uses a contracting entity that differs from the product brand.
- Supplier identity and location: Keep the legal name and location of the entity that actually supplies the service, as shown in the contract, invoice and relevant vendor records.
- Contracting and billing details: Retain the subscription agreement, order or renewal record, invoice, and payment evidence. Note any difference between the contracting entity, invoice issuer and payment recipient instead of assuming they are interchangeable.
- Recipient registration: Identify the Indian GST registration and establishment that receives the service. If the company has multiple registrations or fixed establishments, the IGST Act’s recipient-location definition looks to the establishment most directly concerned with receiving the service.
- Service and dates: Record what the subscription provides and the period covered, along with the dates of supply or receipt shown in the available records. These details support the place-of-supply, classification and reporting checks.
Keep this evidence together rather than relying only on a card statement or a general ledger description such as “software expense.” A payment record can help establish that money changed hands, but it does not by itself identify the relevant supplier, recipient registration, service classification or place of supply.
Apply the rules to the actual arrangement
Supplier outside India, recipient in India
Check the supplier’s location and the Indian establishment most directly concerned with the subscription. If the supplier is outside India, the recipient is in India, and the place of supply is India, the transaction can qualify as an import of services. For a GST-registered business buying foreign software for its firm, CBIC’s published answer says IGST is payable under reverse charge.

More than one Indian registration or establishment
A company should not automatically attribute every subscription to its headquarters, the entity that paid the invoice or the registration that first appears in its accounting system. Where more than one establishment receives a service, determine which is most directly concerned with it under the Act’s recipient-location definition. Preserve the operational facts used for that determination—for example, which establishment uses or manages the subscription—alongside the invoice and contract.
Check for a place-of-supply exception
The recipient-location rule is not a substitute for checking the statutory exceptions. Identify the service being supplied and determine whether an exception changes the place-of-supply result. OIDAR has a specific recipient-location rule; other service arrangements may require a different analysis. The description “overseas software” alone is not enough to establish that no exception applies.
Direct supplier or intermediary arrangement
Establish whether the company contracted directly with the overseas service provider or whether an intermediary is part of the arrangement. The distinction can matter to the legal analysis, particularly for OIDAR supplies: the IGST Act provides for rules concerning intermediaries in the section 14 framework. Review the actual contracting, billing and supply arrangement rather than treating every marketplace or reseller transaction as a direct purchase from the underlying software developer.

Keep the registered and unregistered recipient cases separate
CBIC’s FAQ says that a registered person obtaining online database access from abroad pays applicable IGST under reverse charge. It contrasts this with an unregistered recipient, for whom it describes the matter as OIDAR and says the service provider is liable to register and pay tax. That FAQ summary should not be expanded into a rule that every unregistered business is treated exactly like a consumer.
The statute defines OIDAR by the nature of the service: it is delivered through the internet or an electronic network, is essentially automated, involves minimal human intervention, and cannot be supplied without information technology. Cloud services are expressly included in the definition. Whether a particular subscription meets the definition depends on what the service actually does and how it is supplied.
The Act’s term “non-taxable online recipient” is narrower than “anyone without a GST registration.” It refers to an unregistered person receiving OIDAR for a purpose other than commerce, industry, or business or profession. Section 14 places liability on a supplier located in non-taxable territory when supplying such a non-taxable online recipient, subject to rules for intermediaries. An unregistered business receiving a service for business use should therefore be assessed against the statutory terms and the facts, not assumed to fit the consumer category.

Record the reverse-charge transaction
CBIC says a registered person liable to pay tax under reverse charge for a service received from a person located outside India must issue a self-invoice on the date of receipt. It also says the invoice is to be reported in the GST return for the month in which the supply takes place. Treat this as a recipient-side recordkeeping step, and verify the current rule and filing mechanics for the company’s circumstances before submitting a return; statutory language and filing requirements can change.
- Determine whether reverse charge applies. Complete the supplier, recipient and place-of-supply checks first. Do not create a tax entry solely because an expense is coded as a foreign software purchase.
- Create and retain the self-invoice record. For a service that is liable under reverse charge, follow CBIC’s stated self-invoicing timing—on the date of receipt—and retain the record with the underlying contract, vendor invoice and payment evidence.
- Match the record to the supply period. Track the month in which the supply takes place and reconcile the self-invoice to the return reporting required under the current rules. The relevant reporting month should not be inferred only from the date the company’s card was charged.
- Reconcile related documents. Check that the supplier, service description, recipient registration, service period and value are consistent across the contract, vendor invoice, self-invoice record, payment records and accounting entry. Investigate mismatches rather than forcing them into a convenient category.
The CBIC FAQ provides the general self-invoice statement; the sources reviewed do not establish every procedural detail for every billing cycle, contract structure or filing situation. Use the current consolidated rules and the company’s tax adviser to confirm how the timing applies to a particular subscription.
Confirm the service classification before applying a rate
CBIC’s rate schedule lists a total rate of 18% for the general category of other professional, technical and business services under heading 9983. That entry is not proof that every SaaS subscription belongs under heading 9983. The correct classification must be established for the actual service and checked against the applicable current rate entry before calculating reverse-charge IGST.
Best Value
The distinction is practical: first decide whether the transaction is taxable under reverse charge, then determine its classification and applicable rate. Calling a purchase “SaaS” does not settle either question. The published material cited here does not establish a universal classification or rate for all overseas software subscriptions.
Assess input tax credit separately
Payment of IGST under reverse charge and eligibility to claim input tax credit (ITC) are separate questions. Do not assume that the amount paid is automatically or immediately creditable. Check the current statutory conditions, the company’s business use of the subscription, required documentation and any applicable restrictions against the facts of the particular purchase.
The relevant official material establishes the import and reverse-charge framework, but it does not resolve every ITC condition for every service or business. Keep the ITC review attached to the transaction file and have the company’s tax adviser confirm the treatment where the facts, use or documentation are not straightforward.

A practical decision checklist for finance teams
- Have we identified the legal supplier and its location, rather than relying only on the software product name?
- Which Indian GST registration and establishment are most directly concerned with receiving the service?
- Do the import-of-services conditions—overseas supplier, Indian recipient and Indian place of supply—hold after checking applicable exceptions?
- Is the service OIDAR under the statutory definition, and is the recipient registered or within the narrower statutory category of a non-taxable online recipient?
- Is an intermediary involved, and does the contract and billing arrangement reflect the actual supply?
- Have we checked the service’s classification and the current rate entry rather than applying 18% to all SaaS by default?
- For a reverse-charge service, have we addressed the self-invoice and return reporting in line with the current rules?
- Have we evaluated ITC independently, using the company’s actual business use and supporting records?
CBIC’s sectoral FAQs, the IGST Act, 2017, and the current rules and rate schedule are the primary references for these checks. The FAQ contains older statutory language in places, so a company should verify filing mechanics and amendments against the current consolidated law. This general explanation is not individualized tax advice; a vendor contract, payment structure, recipient registration or service feature can change the analysis.
