Re-identification generally requires a distinctive record, another source that connects a person’s identity to matching details, and a way to link the two. Whether that is realistic depends on the data, the recipient, and information available to them.
Can de-identified health data be re-identified?
Yes, in some circumstances. Health records can contain clues that become identifying when combined with outside information or what a recipient already knows. The possibility is not proof that a particular dataset is easy to identify, or that someone will try. It means that removing obvious identifiers is not the same as proving that identification is impossible.

The U.S. Department of Health and Human Services (HHS) Office for Civil Rights puts the distinction plainly: “Although the risk is very small, it is not zero, and there is a possibility that de-identified data could be linked back to the identity of the patient to which it corresponds.” The risk depends on the dataset and how it is disclosed.
How does health data get re-identified?
HHS describes linkage as requiring three elements: a record that distinguishes someone, a source that supplies a name or identity, and a mechanism for connecting the records. A distinctive record by itself does not reveal a person’s identity; it becomes more revealing when an identity source and a workable match are available.

- Distinctive details: Combinations of demographic or geographic attributes, dates, unusual medical histories, or rare events may set a record apart.
- An identity source: A matching source might be publicly available, held by another organization, or consist of a recipient’s own knowledge.
- A way to match: The details must support a link between the health record and the source that identifies the person.
HHS illustrates how context matters: a recipient who knows about a relative’s complex series of procedures might recognize that history in a dataset, while a rare event reported in the media could help connect a record to a person. Neither example means that every unusual record is identifiable; the question is whether relevant identity information and a plausible match are available.
Why free-text notes need special attention
Structured columns can look clean while a clinical narrative contains identifying context. Safe Harbor-listed identifiers must be removed wherever they appear, including unstructured text. HHS also cautions that narratives can be information-rich enough to reveal identity indirectly.
Organizations need to understand what fields actually contain, including abbreviations, derived values, and field provenance. A column name alone may not make clear that a value encodes an identifier or a distinctive event.

What HIPAA de-identification establishes in the United States
For covered entities and business associates subject to the HIPAA Privacy Rule, HHS describes two ways to meet HIPAA’s de-identification standard. They are formal routes with different risk models; neither is a universal guarantee that data cannot be linked to a person.
| HIPAA route | How it works | Risk model |
|---|---|---|
| Safe Harbor | Remove the specified identifiers relating to the individual and certain relatives, employers, and household members, and do not have actual knowledge that the remaining information could identify the person alone or in combination. | A defined identifier checklist plus the actual-knowledge condition. It is not a general finding that every possible combination is harmless. |
| Expert Determination | A person with appropriate knowledge and experience applies generally accepted statistical and scientific principles, finds the identification risk very small for an anticipated recipient using the data alone or with reasonably available information, and documents the methods and results. | A documented, context-specific assessment. HHS does not set one explicit numerical threshold that universally defines “very small.” |
An Expert Determination is tied to its anticipated disclosure context, not automatically valid for every future release. A change in the dataset, recipient, available auxiliary information, or release design can change the risk. HIPAA de-identification requirements discussed here are not a blanket rule for every health app, data broker, employer, or researcher; applicability depends on whether the organization is subject to the Privacy Rule.
Re-identification codes are a separate case
HHS distinguishes a code controlled by the covered entity from an ordinary identifier. A code used for later re-identification must not be derived from or translatable to the individual, and the mechanism for re-identifying must be protected. HHS says that, under Expert Determination requirements, keyed cryptographic hash-derived values may be used if the keys are not disclosed.

- Privacy Screen Filter Size: If the visible area of your display has the following dimension: Width x Height (Exclude Frame/Arrow 1 to 3 mm errors): 20 15/16" x 11 13/16" (532 mm x 299 mm), then this filter is good for you. Very Important to double check your screen's Width and Height excluding frame before ordering. It's not recommended to make your selection based solely on your screen's diagonal size
- Left and Right Privacy: Not block visibility directly behind you, regardless of distance. The privacy filter makes the screen appear dark when looking at it from an angle (left and right 30 to 180 degree), but clear when looking directly at it. To change the privacy levels, simply adjust your monitor's brightness level accordingly
- Matte and Glossy Sides: It's a reversible privacy screen filter, giving you the flexibility to choose glossy or matte finish. The matte side will have less glare, however the glossy side will have stronger privacy
- Perfect for Open Workspaces: Ensure your working space is bright and well lit. Privacy screens do not work in dimly lit areas
- Two Installation Option: Option 1 uses clear double side adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to take out the privacy screen filter easily as needed
How organizations can reduce re-identification risk
Risk reduction starts with the purpose of sharing and the recipient, not with a universal redaction recipe. NIST’s 2023 Special Publication 800-188 recommends choosing a data-sharing model and appropriate methods in light of the intended use and risks.

Choose an access model that fits the use
| Sharing model | What it offers | Trade-off to consider |
|---|---|---|
| Publish de-identified data | Recipients can work with a released dataset directly. | Public release gives the organization less control over who receives the data or what outside information they can use to link it. |
| Release synthetic data | Users can analyze data generated based on identified data without receiving the original records. | It is a different data product; its usefulness depends on whether it serves the intended analysis. |
| Provide a query interface | Users can ask questions through an interface that incorporates de-identification. | The interface and its controls become part of the disclosure design. |
| Use a protected enclave | Data is shared in a non-public, controlled environment. | Access restrictions change how users reach the data; they do not themselves transform its identifiability. |
These approaches are options, not interchangeable guarantees. A public release, a synthetic dataset, an interface, and a controlled enclave offer different combinations of access, utility, and control.
Use a documented risk-review workflow
- Define the purpose and recipient. Specify the analysis to support, who will receive access, and what information they could reasonably use alongside the dataset.
- Inventory the data. Document fields, free text, derived values, and where each value came from so that hidden or indirect identifiers are not overlooked.
- Assess combinations and context. Consider distinctive attribute combinations, rare cases, unusual events, recipient knowledge, and likely auxiliary sources.
- Apply suitable controls or transformations. Depending on the release, methods may include removing direct identifiers, transforming quasi-identifiers, generating synthetic data, or restricting access.
- Review the result for the intended release. Document the assessment and use a disclosure-review function, measurable standard, and re-identification studies where appropriate to make decisions accountable.
NIST warns: “However, not all tools that merely mask personal information provide sufficient functionality for performing de-identification.” Masking or redaction may be part of a process, but it should not be treated as a substitute for a documented assessment of disclosure risk.

Balance disclosure risk with analytical usefulness
Generalizing or suppressing details can reduce the chance that records stand out, but it can also remove detail needed for analysis. There is no single transformation that works for every dataset and recipient. For a HIPAA Expert Determination, preserving utility does not replace the requirement to reach and document the applicable risk conclusion.
How de-identification differs from data security
De-identification changes the data to reduce its identifiability. Security safeguards help prevent improper access to or disclosure of electronic protected health information (ePHI). They address related but different risks, so an organization may need both.
