How Far Away Must Boats Stay From a Diver-Down Flag?

There is no universal boat-to-flag distance. Official U.S. examples range from 100 to 300 feet depending on state and waterway.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single U.S.-wide distance. The official state examples available range from 100 feet to 150 feet, while Florida requires reasonable efforts to stay 100 feet away on rivers, inlets, and navigation channels, and 300 feet away on other waters. The applicable rule depends on where you are boating, so check the current law or official guidance for your state and waterway before operating near a diver-down flag.

How far away should a boat stay?

Use the distance set by the state and waterway where you are operating—not a nationwide rule. In the U.S. examples below, Pennsylvania specifies at least 100 feet, Illinois’ boating handbook says 150 feet, and Michigan and California materials describe at least 100 feet. Florida uses different distances for different waterways: 100 feet on rivers, inlets, and navigation channels, and 300 feet on other waters.

Those figures come from a mix of regulations, statutes, and official educational guidance. They should not be treated as interchangeable legal requirements. In particular, the Michigan and California figures are presented in boating guidance or course material, whereas Pennsylvania’s distance is in a regulation. Confirm the current local rule rather than assuming a number from another state applies.

For a quick practical answer: do not assume that 100 feet is enough just because that figure appears in several states’ materials. Illinois’ handbook gives 150 feet, and Florida’s rule for waters other than rivers, inlets, and navigation channels is 300 feet. If you do not know which local rule governs, check it before you approach; meanwhile, give the marked area more room rather than relying on the shortest distance listed here.

How the state examples differ

Jurisdiction Distance and scope Source and status
Florida At least 100 feet on rivers, inlets, and navigation channels; at least 300 feet on other waters. Within those distances, proceed only as fast as needed to maintain headway and steerageway. Florida Statutes §327.331 (2025): official statute
Pennsylvania Boats not engaged in diving operations must stay at least 100 feet from areas displaying a diver-down flag or code flag Alpha. 58 Pa. Code §109.5: official regulation
Illinois Vessels not engaged in diving operations should stay 150 feet away. Illinois boating handbook: official handbook
Michigan Maintain a safe distance of at least 100 feet around the vessel displaying the flag. Michigan DNR boating guidance: official page
California Stay at least 100 feet from the diving site and vessel. California Division of Boating and Waterways course material: official course document

The wording matters. Florida’s statute says an operator must make a “reasonable effort” to maintain the specified distance, and adds a speed restriction for a vessel that enters it. Pennsylvania’s regulation states a minimum distance for boats not engaged in diving operations. Illinois’ cited handbook gives a distance, while the Michigan and California materials describe distances in guidance or course material. Check the linked source and any current local rules for the precise obligation that applies to you.

The reference point also differs in the cited wording. Pennsylvania refers to an area displaying the diver-down flag or code flag Alpha; Michigan describes the distance around the vessel displaying the flag; California names both the diving site and vessel. These are not grounds for choosing whichever point is closest or easiest to use. Follow the local wording, and keep the whole apparent dive operation clear when possible.

The table is a comparison of selected official state examples, not a complete survey of U.S. or international boating rules. The cited sources do not establish identical definitions, measurement methods, or enforcement language across jurisdictions. A figure in an educational handbook or course document is useful guidance, but it should not be presented as if it were the same kind of authority as a statute or regulation.

What to do when you see a diver-down flag

  1. Identify the signal. The flag described in the cited state materials is red with a white diagonal stripe. Pennsylvania’s boating-safety guidance also addresses the diver-down flag and related aids to navigation: Pennsylvania Fish and Boat Commission guidance.
  2. Give the marked area a wide berth. Use your jurisdiction’s required or recommended distance, measured conservatively in your approach. Do not assume the flag marks only the point where a diver entered the water; the cited rules refer variously to a displayed area, the vessel, or the diving site.
  3. Reduce speed if your route takes you inside a restricted distance. Florida specifically requires a vessel that enters the applicable 100- or 300-foot distance to proceed no faster than necessary to maintain headway and steerageway. That is a Florida rule; the sources cited here do not establish an identical speed rule for every other state.
  4. Keep watching for divers and the support vessel. A flag warns that diving is taking place; it is not a substitute for looking carefully and avoiding people in the water. Leave room to maneuver rather than passing close to the warning device.
  5. If the channel or conditions make the required clearance uncertain, choose a route that gives more room. The cited sources do not establish one universal method for measuring distance or a common exception for every narrow waterway. Consult local rules and avoid treating uncertainty as permission to pass close.

Do not treat the warning as applying only to the buoy or flag itself. A diver may be away from the displayed device, and the state materials describe the protected area in different ways. Keep a careful lookout for people in the water and the vessel supporting the dive, and avoid a close pass even if the warning device seems unoccupied.

If you are approaching a marked site in a channel, plan your route early rather than waiting until you are alongside the flag to decide how to pass. The sources reviewed do not supply a universal narrow-channel exception or a single way to measure clearance, so do not assume that restricted space cancels the local requirement. Follow the applicable authority’s instruction and favor the route that leaves the divers the greatest practical separation.

Florida’s specific 100-foot and 300-foot rules

Florida Statutes §327.331 separates waterways into two categories. On a river, inlet, or navigation channel, a vessel operator must make a reasonable effort to remain at least 100 feet from a divers-down flag. On other waters, the corresponding distance is 300 feet. If a vessel does enter the applicable distance, it must proceed only as fast as necessary to maintain headway and steerageway. The statute provides an exception for law-enforcement and rescue vessels.

The speed provision matters as well as the distance. In Florida, entering the relevant zone does not mean a boater can continue at ordinary cruising speed: the vessel must proceed no faster than needed to maintain headway and steerageway. That wording permits the vessel to retain enough movement to make way and steer; it is not an instruction to travel at a fixed speed stated in miles per hour. The statute’s exception names law-enforcement and rescue vessels, not a general exception for convenience or a narrow passage.

The statute also addresses the divers’ use of the warning device. Divers should make reasonable efforts to remain within 100 feet of it on rivers, inlets, and navigation channels, and within 300 feet on other waters. The device must be lowered once all divers are aboard or ashore. These are Florida-specific provisions; they should not be applied as a national standard. Read the 2025 Florida statute for the complete wording, and consult the Florida Fish and Wildlife Conservation Commission boating regulations for state boating information.

The Florida rule therefore has obligations on both sides of the dive warning: vessel operators must make reasonable efforts to maintain the applicable separation, and divers should make reasonable efforts to stay within the corresponding range of the device. Once every diver is aboard or ashore, the device must be lowered. The diver-range and lowering provisions are Florida-specific, just like the 100- and 300-foot distinctions.

What the flag tells you—and what it does not

A diver-down flag is a warning that divers are in the water nearby. In the official sources cited here, the familiar flag is red with a white diagonal stripe. Pennsylvania’s regulation also names code flag Alpha as a signal that triggers its stated clearance rule. Do not assume a flag’s exact legal effect, recognized alternatives, or required display is identical across state lines.

Florida law sets requirements for diver-down warning devices, including flags and buoys. If you are preparing to dive, check the applicable state’s requirements for the device itself, not just the distance boats must keep away. Size, display, and use requirements can matter; the general red-and-white description alone does not establish that a particular flag or buoy complies everywhere. Florida’s statute and FWC regulations page are the relevant starting points for Florida.

In particular, recognizing the familiar colors does not tell you whether a flag is the right size, properly displayed, or compliant with the rules for that water. Florida’s statute specifies construction and display requirements and recognizes flags and buoys as diver-down warning devices. The cited material does not give a single product specification that can be treated as valid in every state. A diver selecting or carrying a device should check the current local requirements before relying on a product description alone.

How to check the rule for your location

  1. Identify the jurisdiction. The state or country whose waters you are on is the starting point. If you are near a boundary or operating on connected waters, verify which authority’s rule applies to your position.
  2. Identify the waterway type. This is essential in Florida, where the specified distance changes between rivers, inlets, navigation channels, and other waters.
  3. Read the current official rule. Prefer a statute or regulation for legal requirements. Use official boating handbooks and course materials as guidance, while noting whether they state a binding rule or educational recommendation.
  4. Check both distance and conduct. Look for any associated speed limit, requirement to give way, exceptions, or rules for how the flag or buoy must be displayed. A distance alone may not describe every duty near a dive site.
  5. When the source is unclear, give the divers more room. A conservative route is safer than relying on the shortest distance quoted for a different state or waterway.

For example, someone boating on a Florida river should not simply carry over the 300-foot figure that applies there to other waters; the statute distinguishes rivers, inlets, and navigation channels from other waters. A boater in Illinois should not assume the 100-foot guidance cited for Michigan or California applies, because the Illinois handbook states 150 feet. These comparisons show why checking the local source is more useful than memorizing one number.

When reading an official source, note whether it is a statute, regulation, handbook, or course document and read the sentence in context. A concise distance on an educational page may omit details that appear in the controlling rule. Likewise, a state-specific speed requirement or exception should not be carried over to another jurisdiction unless that jurisdiction’s source says so.

Why one number cannot answer every case

The state examples show materially different distances and wording: Florida distinguishes waterway types and adds a low-speed requirement within its specified distances; Pennsylvania’s rule refers to an area displaying a diver-down flag or code flag Alpha; Illinois’ handbook gives 150 feet; and Michigan and California materials use 100 feet with different reference points. A bare answer such as “100 feet” would therefore be incomplete for a reader whose location is unknown.

Frequently Asked Questions

Is there one nationwide distance boats must keep from a diver-down flag?

No single U.S.-wide distance is established by the state examples here. Pennsylvania and several state guidance materials use 100 feet, Illinois’ boating handbook says 150 feet, and Florida distinguishes between 100 feet on rivers, inlets, and navigation channels and 300 feet on other waters. Check the current rule for the water you are on.

Does Florida require 100 feet or 300 feet?

Both distances apply, depending on the waterway. Florida Statutes §327.331 calls for reasonable efforts to maintain at least 100 feet on rivers, inlets, and navigation channels, and at least 300 feet on other waters. A vessel that enters the relevant distance must proceed no faster than needed to maintain headway and steerageway, subject to the statute’s exception for law-enforcement and rescue vessels.

What should a boat do if it enters Florida’s diver-down distance?

It must proceed only as fast as necessary to maintain headway and steerageway. The statute does not give a miles-per-hour figure. The requirement is specific to Florida, so check the local rule elsewhere rather than assuming the same speed wording applies.

What color is a diver-down flag?

The flag described in the cited official state materials is red with a white diagonal stripe. Recognizing the signal does not by itself establish that a device meets local size, display, or use requirements.

Do divers have to stay near the warning device?

Florida’s statute says divers should make reasonable efforts to remain within 100 feet of the device on rivers, inlets, and navigation channels, and within 300 feet on other waters. It also requires the device to be lowered once all divers are aboard or ashore. These are Florida-specific provisions, not a national rule.

Can I rely on a flag or buoy sold as a diver-down device?

Do not assume one product specification complies everywhere. Florida law sets construction and display requirements for its warning devices, and other jurisdictions may have their own requirements. Check the current official rules for the state and waterway where you will dive.

Are the 100-foot figures in every state’s source the same kind of rule?

No. Pennsylvania’s figure appears in a regulation, while the Michigan DNR page and California boating-course material describe 100 feet in guidance or course material. The wording and reference points also differ. Read the current local source to determine the obligation that applies.

The Bottom Line

Bottom line: There is no universal boat-to-diver-down-flag distance. The official examples here range from 100 to 150 feet, while Florida requires reasonable efforts to maintain 100 feet on rivers, inlets, and navigation channels and 300 feet on other waters. Florida also requires headway-and-steerageway speed if a vessel enters the applicable distance. Check the current official rule for your exact location, and give divers extra room when conditions allow.
