European defense technology companies must assess more than whether a product is on an export-control list: the rules can cover software, technical information and services as well as hardware, and the transaction’s destination, end user and intended use can change the licensing requirements. The applicable route also depends on whether a product is military or dual-use, whether it is moving within the EU or leaving it, and the national rules and sanctions in force.
Which export-control rules may apply?
There is no single EU licensing process for every defense-related transaction. The EU sets a common framework for dual-use items, while Member States control military exports through national systems. Separate EU rules address transfers of defense-related products between Member States, and sanctions can impose additional restrictions on particular destinations, goods, entities or dealings.

- Dual-use items: Regulation (EU) 2021/821 applies to exports, brokering, technical assistance, transit and transfers of items that can serve both civilian and military purposes. Its scope includes software and technology, not just physical goods. See the EUR-Lex summary of EU dual-use export controls.
- Military products: military exports are controlled through Member State systems. Do not assume that a military-designed or modified product follows the dual-use licensing route.
- Intra-EU defense transfers: Directive 2009/43/EC provides a licensing framework intended to facilitate transfers of defense-related products between Member States. National authorities retain discretion over eligible products and licence conditions. The Commission explains the framework on its EU transfers of defence-related products page.
- Sanctions: restrictive measures are a distinct layer of review. EU measures may prohibit exports of specified goods or transactions involving listed entities; the Commission’s sanctions guidance on dual-use goods describes restrictions relevant to Russia. Measures and lists can change, so check the current rules for each transaction.
How to assess a product or transaction
A useful compliance review follows the transaction from the item itself through its destination and parties. A product-list check is necessary, but it is not the whole analysis: end-use controls and national measures may still apply when an item is not on the common dual-use list.
- Classify the product and related technology. Determine whether the product is military, dual-use or outside those categories under the applicable rules. For dual-use items, compare its specifications against Annex I of Regulation (EU) 2021/821. The list covers areas including electronics, computers, information security, sensors and lasers, navigation and avionics, marine, aerospace and propulsion. Include relevant software and technical information in the review.
- Identify the transaction route. Establish whether the movement is an export outside the EU, an intra-EU transfer, transit, brokering or technical assistance. A transfer between Member States and an export to a third country may use different legal frameworks.
- Check destination, end user and intended end use. Gather enough information to assess whether an authorisation is needed, whether an end-use control applies and whether diversion risks or other restrictions affect the transaction.
- Screen the parties and transaction against sanctions. Review current measures for the destination, goods, counterparties and proposed dealings. A product’s classification does not replace sanctions screening.
- Confirm the applicable national rules and licence conditions. Identify the competent Member State authority and verify any national controls, product-eligibility requirements or conditions relevant to the route.
- Reassess when facts change. Revisit classification and authorisation decisions when specifications, software capabilities, destination, end user, end use or control lists change.
Which authorisation routes are available?
For dual-use items, the available authorisation depends on the item, destination, transaction and applicable national rules. These routes are not interchangeable; an exporter must establish that it meets the relevant eligibility requirements and conditions before relying on one.

| Authorisation route | How it works |
|---|---|
| EU general authorisation | Can cover specified destinations and transactions subject to stated conditions. |
| National general authorisation | May be available under the relevant Member State’s rules and conditions. |
| Individual authorisation | Issued by a national authority for a particular transaction or set of particulars. |
| Global authorisation | Issued by a national authority; the applicable scope and conditions depend on the authorisation. |
| Large-project authorisation | May cover a qualifying project, subject to the applicable requirements. |
Applications may require complete information about the end user, destination and end use. Exporters must retain the specified export records for five years under Regulation (EU) 2021/821, as summarized by EUR-Lex; the records include specified commercial and shipment information.
What changes for military exports and transfers within the EU?
Military exports remain under Member State control, so companies need to identify the national system and authority relevant to the product and proposed destination. The dual-use regulation should not be treated as a universal permit or classification system for all defense products.
For transfers between EU Member States, Directive 2009/43/EC provides general, global and individual licence routes and encourages general licences where risk is controlled. Member States determine which products are eligible and set licence terms. National certification of recipient undertakings can support transfers under relevant general licences; the Commission’s transfer guidance points to CERTIDER for public information about certified recipients. These mechanisms facilitate controlled transfers; they do not remove applicable end-use, end-user or national requirements.

Product development and engineering
Classification depends on technical characteristics, so compliance processes need product descriptions detailed enough to support a reasoned classification. Keep relevant specifications and software capabilities available to the people assessing controls, and revisit decisions when a design or capability changes. This makes classification part of product and engineering change management, not only a check performed when a shipment is ready.
Sales, partnerships and services
Because the dual-use framework reaches brokering, technical assistance, transit and transfers as well as exports, a review may be needed before a transaction involving a distributor, customer, project partner or recipient of technical information. Sales and service teams should involve compliance staff early enough to check the proposed parties, destination and end use before making commitments or sharing controlled material.
Licensing and shipment operations
Where authorisation is required, application information and licence conditions affect the transaction’s timing and execution. Teams need a process to collect accurate end-user, end-use and destination details, confirm the applicable authorisation route, and ensure shipment and commercial records are retained as required. A licence for one route or set of conditions should not be assumed to cover a different transaction.

National variation and smaller companies
The European Commission says differing national approaches and burdensome administrative procedures have caused problems for the European defense industry, particularly SMEs, and that the transfer directive aims to reduce obstacles while preserving Member State control over essential security interests. That describes a qualitative challenge; the cited material does not establish a representative euro cost, average licensing delay or quantified sales effect for European defense technology companies.

On 14 September 2026, the European Commission reported adopting a delegated act to update Annex I of Regulation (EU) 2021/821. Its notice identifies new or revised controls in areas including semiconductor manufacturing and testing equipment and materials, advanced computing integrated circuits and electronic assemblies, certain ceramic matrix composites, inductive rotary encoders, additive manufacturing for energetic materials, silicon-carbide fibre production equipment, and gas-turbine axial-compressor development technology.
Best Value
The Commission’s 14 September 2026 update notice says the amendments take effect upon publication in the Official Journal after the scrutiny period. The notice alone does not establish that the updated list is already in force. Before making a classification or shipment decision, verify the Official Journal publication and effective date, then assess whether the amended controls apply to the specific item.
Why list and sanctions monitoring must continue
A classification and screening decision reflects the item and transaction facts available at that time. Annex I may be amended, national controls may matter, and sanctions measures or entity listings can change. Companies therefore need a way to identify relevant legal updates and trigger a new review when the product, transaction, parties or destination changes. For sanctions-related exports, consult the Commission’s current guidance on sanctions affecting dual-use goods and the applicable measures before acting.
