They may rely on the complainant’s testimony, supported where available by other admissible evidence about the events before and after the alleged assault, the people involved, and the surrounding circumstances. Physical evidence is not always available or decisive, but its absence does not lower the prosecution’s burden: the government must still prove every element of the charged offense beyond a reasonable doubt. Whether testimony alone can support a conviction depends on the jurisdiction, the evidence, and the fact finder’s assessment.
What “no physical evidence” means for a case
It usually means there is no physical or forensic evidence that independently establishes what happened—for example, no dispositive forensic result or injury evidence. It does not mean there is no evidence at all. The complainant’s account is evidence, and testimony from other witnesses, messages, records, or other circumstances may also be evidence.

The U.S. Department of Justice’s Office on Violence Against Women says in its May 2024 Framework for Prosecutors to Strengthen Our National Response to Sexual Assault and Domestic Violence Involving Adult Victims that “Most sexual assault and domestic violence prosecutions rely on the victim’s account.” The framework notes that such crimes often occur without witnesses or video and rarely produce dispositive physical evidence. That is general federal guidance, not a rule deciding how any particular case must be charged or tried.

Can a case rest on testimony alone?
In general, the absence of a separate corroborating witness or physical evidence does not automatically make a sexual-assault prosecution legally impossible. DOJ guidance says independent corroboration requirements generally no longer apply in these cases, though local law must be checked. A complainant’s testimony may be legally sufficient under the governing law, but that does not guarantee that prosecutors will charge the case or that a jury will convict.
The prosecution must present admissible evidence capable of proving the charged offense beyond a reasonable doubt. The judge applies the law and evidentiary rules; the jury, or other fact finder, decides what evidence to believe and whether the burden has been met. A lack of physical evidence does not reduce that burden, and testimony is not automatically accepted or rejected simply because it is uncorroborated.
What other evidence can support the account?
Corroboration can support particular details—such as timing, location, or what happened afterward—without independently proving the assault. Investigators can use the account to identify questions to test and possible evidence to seek. Each item must be obtained lawfully, meet applicable admissibility rules, and be interpreted within its limits.

Witnesses and observations
People who saw the complainant or accused before or after the reported event may be able to describe what they observed, when they saw it, or the circumstances surrounding it. A witness’s observations can support a timeline or another detail; they may not have witnessed the assault itself. A witness’s impression or opinion is not a substitute for proof of the offense.
Messages, calls, and other statements
A message, call to emergency services, or account given to another person may help establish when the allegation was first reported or what was said. Its existence does not by itself prove the allegation. Whether a statement can be admitted for its truth is a legal question governed by the evidence rules and circumstances; a judge may admit it for a limited purpose or exclude it.
Records and digital information
Records such as payroll information or cell-site data may help test timing, absence from a place, or location details, as DOJ’s framework notes. They do not necessarily show a person’s precise movements or establish what happened at a particular location. The prosecution must explain what a record can and cannot demonstrate, and must satisfy requirements for lawful collection and admissibility.

Place and contextual details
Investigators may compare an account’s description of a setting or distinctive detail with other evidence about that place. A match may support a detail in the account, but it does not necessarily establish every disputed element of the offense.
Expert or clinician testimony
Forensic medical clinicians or trauma experts may be permitted to explain relevant evidence or help jurors understand behavior, subject to the rules for expert testimony and the limits of the specific case. Such testimony does not decide whether an assault occurred or whether a witness is truthful. The evidence described here does not establish how a normal or negative medical examination should be interpreted, so no conclusion about an individual examination follows from this general discussion.
How prosecutors assess credibility and decide whether to charge
When no one else witnessed or recorded the assault, credibility may be central. DOJ guidance cautions prosecutors against treating a case as unprovable merely because it is one person’s account against another’s. It recommends investigating the facts and context, evaluating admissible evidence, and avoiding assumptions based on stereotypes about how a victim should behave.

Delayed reporting, lack of resistance, continued contact, or a person’s demeanor does not automatically prove or disprove an allegation. Prosecutors should assess the evidence rather than treat any one of those circumstances as a universal credibility test. A fact finder ultimately evaluates the evidence under the instructions and law that apply in that case.
Charging is also not a finding of guilt. Prosecutors must decide whether admissible, credible evidence can support a guilty verdict under the applicable standard. The DOJ framework states: “Allegations unsupported by law and admissible, credible evidence must be declined for prosecution.” A decision not to charge, like a charge itself, does not by itself resolve what happened.
What happens at trial
At trial, the government must prove the elements of the offense charged beyond a reasonable doubt. Those elements come from the relevant statute and jurisdiction. The jury considers the testimony and other admitted evidence together; evidence that supports one detail does not necessarily establish the entire offense. If the evidence does not satisfy the burden for every required element, the prosecution has not proved the case.

Rules about what evidence a jury may hear also vary. For example, Federal Rule of Evidence 412 generally limits evidence offered to prove an alleged victim’s other sexual behavior or sexual predisposition in proceedings involving alleged sexual misconduct. The federal rule has specified exceptions, including certain evidence of sexual behavior with the accused and evidence whose exclusion would violate constitutional rights. It is not a complete statement of state law, and a judge’s case-specific ruling matters.
Why the jurisdiction matters
For a particular case, the governing jurisdiction determines the offense’s elements, any corroboration requirement, the admissibility of statements and other evidence, and the jury instructions. DOJ’s national framework offers prosecutorial guidance; it does not replace local statutes, rules, or legal advice. The absence of physical evidence is one circumstance to assess, not a standalone answer to whether a case can be prosecuted or proved.
