How Data Center Tax Incentives Work and Who Qualifies

Data center tax incentives vary by state and may depend on investment, jobs, location, eligible purchases, application timing and continuing compliance.

Data center tax incentives are state- and sometimes locally defined tax benefits, not a single nationwide program. The most common benefit is a sales or use tax exemption for specified equipment, but eligibility may also depend on a project’s location, investment, jobs and wages, application timing, and continuing compliance. A project qualifies only under the rules of the jurisdiction and program that cover it.

What a data center tax incentive does

A tax incentive reduces or removes a defined tax on eligible purchases or property. The most common form is a sales or use tax exemption for qualifying equipment. In a certificate-based program, an approved business or contractor presents the required certificate so that covered purchases are not charged the covered tax at the point of sale. The certificate does not make every purchase tax-free: the program defines the eligible property, buyer, tax, and period.

Some programs also cover energy, offer local property tax relief, or provide a credit. These are distinct benefits with distinct requirements. A purchase exemption is not necessarily a cash grant or a credit claimed on a tax return. Maryland, for example, describes its data center exemption as a purchase-time benefit. Illinois described a separate construction-worker wage credit alongside exemptions in its program terms, but its published page says the state stopped processing applications on July 1, 2026.

State and local taxes must be checked separately. Texas says its qualifying data center exemption applies to the 6.25% state sales tax, while applicable local sales and use taxes remain due. A state-level approval therefore does not establish that local tax, real property tax, or every other charge is waived.

Who qualifies: examples from different state programs

There is no universal investment, job, or facility-size threshold. A program may recognize an owner, operator, occupant, tenant, or contractor, but another may define eligible parties more narrowly. The examples below illustrate how much the tests differ; they are not a national checklist or a statement that every route is open to new applicants.

Jurisdiction and program example Core qualifying terms described by the agency or statute Benefit and important limits
Texas: ordinary qualifying data center program The owner, operator, or occupant must commit, jointly or independently, to at least $200 million in capital investment over five years and at least 20 qualifying county jobs. Jobs must be retained for five years. The ordinary exemption lasts 10 years. At least $250 million in investment extends it to 15 years. The Texas Comptroller verifies the investment and jobs. Local tax chapters are not covered, and facilities under specified former Chapter 313 value-limitation agreements are excluded.
Texas: separate large-project route A project must be at least 250,000 square feet and meet its own commitments: $500 million in investment and 40 jobs. The route has a 20-year period. Its thresholds and terms are separate from the ordinary program.
Maryland Within three years of applying, the project must invest at least $2 million in qualified personal property in a Tier 1 area, or $5 million elsewhere, and create five qualifying positions. Positions must be full-time, newly created, not transferred from another Maryland facility, filled for at least 12 months, and pay at least 150% of the state minimum wage. The Maryland Commerce page lists $22.50 per hour as the minimum qualifying wage for 2026. The benefit lasts 10 years, or 20 years after at least $250 million in qualifying investment within 10 years. Annual renewal and job maintenance apply. The application must precede project start; purchases before certification and issuance of the exemption certificate do not qualify.
Kansas The statute requires an application and commitment to at least $250 million in eligible data center costs, completed by the fifth year of operations. Construction must begin within 10 years of the state agreement. The project must commit to a 10-year electricity purchase from the certified local retail utility and follow water conservation, reuse, and replacement practices. An approved firm must enter an agreement with the Secretary of Commerce. The cited statutory subsection does not state a universal job-count threshold.
Illinois: published program terms, not a new-application route The Illinois Department of Commerce and Economic Opportunity described new or existing centers and tenants collectively investing at least $250 million over 60 months and creating 20 new full-time or equivalent operations and maintenance jobs. Those jobs had to pay at least 120% of county median wages. The page says applications stopped July 1, 2026. Treat these as published program terms and history, not an available route for a new applicant.

Indiana illustrates that a program may combine equipment and energy benefits with a separate local property-tax provision. The Indiana Economic Development Corporation describes an exemption for qualifying equipment and energy lasting no more than 25 years for investments below $750 million, and up to 50 years where investment exceeds $750 million. Indiana local governments may also provide a personal property tax exemption for qualified enterprise IT equipment when facility investment reaches at least $25 million. These are Indiana-specific program descriptions, not general rules.

Thresholds alone do not prove eligibility. The project must also match the program’s definitions of a data center, qualified property, eligible party, covered location, and qualifying investment or job. A project that exceeds a dollar minimum may still fail a timing, wage, utility, or application condition.

What the benefit covers—and what it may leave out

Before estimating a project’s tax savings, identify the tax and property in scope. Programs can differ on servers and other IT equipment, power infrastructure, electricity or other energy, construction materials, and real or personal property. A broad description such as “data center exemption” is not enough to establish that a particular server purchase, building component, or utility bill qualifies.

State and local treatment can diverge. Texas’s state exemption does not eliminate applicable local sales and use tax. Other jurisdictions may have local property tax relief or other provisions, but the existence of one benefit does not imply another. Washington’s Joint Legislative Audit and Review Committee (JLARC) notes that state approaches vary: some include security systems, electricity, or construction materials, while others impose minimum investment conditions.

Programs can also change what they cover. JLARC reported that the 2026 Washington Legislature narrowed exemptions for refurbishment and replacement server equipment. It also reported that Minnesota repealed a data center energy sales-tax exemption in 2025. These examples are reasons to verify the current rule for the specific purchase and tax year, rather than rely on an older summary or an incentive announcement.

How to check eligibility before committing to a site or purchase

  1. Identify the jurisdiction and administrator. Pin down the state, locality, and agency responsible for the benefit. Determine whether the project’s site is in a qualifying zone or whether local approval is a separate step.
  2. Read the current statute and program terms. Confirm the program is active and accepting applications, then identify covered taxes, eligible property, eligible parties, and any new-build, expansion, refurbishment, or facility-size rules. An announced benefit is not the same as an approved application.
  3. Map project entities to the program’s definitions. Establish which entity will own the facility and equipment, operate it, occupy it, make purchases, employ workers, and apply. Do not assume an affiliate, tenant, operator, or contractor is covered merely because another related party is eligible.
  4. Test every threshold and its deadline. Build a schedule for capital investment, qualifying jobs, wages, project start, construction, utility commitments, and any facility-size test. Record whether the threshold must be reached before application, within a stated number of years, or by a later milestone.
  5. Apply and obtain required approval before purchasing. Check for an application deadline, certificate, registration number, or other approval needed at checkout. Maryland expressly excludes purchases made before certification and issuance of its exemption certificate; its application must also precede project start.
  6. Model tax separately by category and level of government. Separate state sales or use tax from local sales or use tax, and distinguish equipment from energy, construction property, and real or personal property. Do not treat a utility arrangement or local abatement as interchangeable with a state purchase exemption.
  7. Plan for continuing proof and compliance. Keep purchase invoices, exemption certificates, investment records, job and wage records, and evidence of required utility or water commitments. Follow the program’s record-retention, reporting, renewal, and audit rules.

For a project with multiple companies or a phased build, document who makes each purchase and which entity satisfies each commitment. Ask the administering agency or qualified state and local tax counsel to confirm the project structure and current terms. A tax projection should not assume a benefit until the relevant approval and purchase requirements are satisfied.

What can cause a project to lose or miss a benefit

  • Starting too early: An application or certificate may need to precede project start or the purchase. Maryland’s rules make timing decisive for eligible purchases.
  • Buying the wrong property: Only program-defined property qualifies. A facility’s approval does not automatically extend to every construction or operating expense.
  • Missing job or investment commitments: A project may have to achieve and maintain minimums, not merely forecast them. Texas requires retention of qualifying jobs for five years; Maryland requires maintenance of five qualifying jobs during the benefit period.
  • Counting jobs or wages incorrectly: Programs may exclude transferred employees, require full-time positions, set a minimum wage, or prescribe a period in which a role must be filled. Use the exact program definitions rather than an internal headcount estimate.
  • Assuming local taxes follow state treatment: State approval can leave local tax due, as Texas’s stated scope demonstrates.
  • Relying on an expired or amended program description: A past threshold does not show that an application remains available. Illinois’s July 1, 2026 cutoff and the 2025 Minnesota repeal are concrete examples of program status changing.

Consequences are program-specific. Texas can revoke certification if commitments are not met, while Maryland requires annual renewal. A missed condition may therefore affect continued eligibility or certification; do not assume a tax benefit is permanent once a project receives an initial approval.

How to compare incentives without being misled by the headline

When comparing sites or proposed incentive packages, use the same questions for each jurisdiction. A larger headline duration or lower investment threshold is not necessarily the better offer if the eligible tax base is narrow, the certificate arrives too late, or the operating commitments are harder to satisfy.

  • Tax scope: Is the benefit for state tax, local tax, or both? Is it sales/use tax, energy tax, or property tax?
  • Eligible purchases: Which equipment and project costs qualify, and are energy, construction materials, refurbishment, or replacement equipment treated differently?
  • Investment test: What counts as eligible investment, how much is required, and when must it be completed?
  • Employment test: How many jobs are required, where must they be located, what wage and hours count, and how long must they be maintained?
  • Project fit: Are there location-zone, facility-size, new-build, expansion, or facility-type restrictions?
  • Timing and administration: When must the application be filed, who issues the certificate, and does approval need to precede construction or purchasing?
  • Duration and ongoing duties: How long does the benefit last, and are there annual renewals, audits, reporting, revocation, or repayment provisions?

Compare expected qualifying purchases and project obligations, not just the stated duration. Also distinguish a tax exemption from other elements of a site package, such as a utility commitment or local agreement, because they may have different counterparties and conditions.

How widespread are these programs?

JLARC’s 2026 tax preference review says at least 38 states offer preferential tax treatment specifically targeting data centers. That count indicates broad use, but it does not mean that 38 states share the same incentive or that each is open to every project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

JLARC estimated that eligible equipment purchases associated with Washington’s urban preference rose from $40.6 million in fiscal year 2023 to $141.7 million in fiscal year 2026, using beneficiary savings and a combined state and local rate just over 10%. The committee cautioned that attribution to the exemption is uncertain. Those figures are estimated associated purchases, not a definitive measure of purchases caused by the incentive.

Bottom line for a project team

Eligibility is a jurisdiction-specific match between the project, the applicant, the purchase, and the program’s timing and ongoing conditions. Confirm the current statute and agency rules before choosing a site, scheduling purchases, or relying on projected savings; then document the commitments that must be met throughout the benefit period.
