Bhanu Prakash says a CAN-SPAM warning he encountered while building marketing flows for Ages & Spices led him to create DarkLens, an AI-assisted website scanner. The FTC’s figure is a maximum penalty of up to $53,088 for each separate violating email—not an automatic fine for one missing address. DarkLens is best understood as a reported software project for surfacing potential issues, not as proof that a site is legally compliant.
What prompted the DarkLens project
In a first-person account on DEV Community, Bhanu Prakash describes building marketing flows for Ages & Spices, his AI culinary platform, when he encountered CAN-SPAM’s requirement for a valid physical postal address in commercial email. The potential penalty caught his attention and broadened his investigation to GDPR and interface practices he calls dark patterns, including “Roach Motel” flows, hidden fees, and fake urgency. He says that work led to DarkLens, an automated scanner aimed at e-commerce and SaaS sites. Read Prakash’s account.

What the $53,088 figure does—and does not—mean
The Federal Trade Commission’s CAN-SPAM business guide says each separate email that violates the Act may be subject to penalties of up to $53,088. That is a stated maximum, not a guaranteed charge, and it does not mean that sending a single email without an address automatically triggers that amount. The FTC describes several requirements for commercial email, including accurate sender information, non-deceptive subject lines, advertising identification, an opt-out method, and a valid physical postal address. The address rule does not require a business owner to publish a home street address. The FTC recognizes a current street address, a USPS-registered post office box, or a private mailbox registered with a qualifying commercial mail receiving agency. FTC guidance on valid postal addresses. The statute also addresses advertising identification, opt-out notices, and valid addresses, as well as false headers and deceptive subject lines. How the scanner is described as working
Prakash’s account describes DarkLens as a pipeline built with Next.js and Supabase. A crawler visits a target URL, extracts its DOM structure, removes unnecessary scripts and styles, and sends semantic HTML to an LLM-based heuristic engine. The engine is described as checking against a database of known dark patterns and compliance risks, then producing what the author calls an “auditor-ready report.” Project description.

In practical terms, this separates collection and cleanup from interpretation: the crawler gathers page structure, while the model looks for patterns in the material that remains. That design description alone does not show how the system handles pages rendered after load, forms, checkout flows, user-specific content, or findings that require context beyond a page’s markup. Nor does it establish the accuracy or completeness of its reports.

An LLM can help flag language or interface patterns for review, but a useful audit needs more than a plausible explanation from a model. For a scanner like the one described, a developer evaluating findings should look for:
Rank #3
- Traceable criteria: Each finding should map to an explicit rule or documented risk, rather than an unexplained model judgment.
- Evidence: Reports should identify the page, relevant DOM content, and reason for the flag so a reviewer can reproduce it.
- Coverage: The crawl should make clear which URLs and interaction states were examined, and which were inaccessible or skipped.
- Repeatability: The same pages and inputs should produce reviewable results, with changes in findings explainable.
- Error handling: Teams need a way to dismiss false positives, investigate possible misses, and record human decisions.
- Human review: Legal obligations and context-sensitive interface choices should be reviewed by qualified people rather than treated as settled by a scan.
These are evaluation criteria, not verified DarkLens capabilities. The available project description does not report test results, independent validation, or legal review.
Where an automated scanner fits in compliance work
A scanner can help teams find candidate issues across many pages and create a queue for manual review. It cannot establish, by itself, that a business complies with CAN-SPAM, GDPR, or other laws. Compliance depends on facts beyond a page snapshot—for example, how messages are sent and how opt-out requests are handled. A website scan is therefore an issue-spotting aid, not legal advice or a certification.
For developers building their own tooling, keep deterministic checks and model-assisted judgments distinct. A rule that can be tested against a specific requirement should be reported with its evidence and source; an LLM inference should be labeled as a heuristic and routed for review. This distinction helps users understand what the software observed, what it inferred, and what remains undecided.

Does CAN-SPAM require a home address in marketing emails?
No. The FTC says a valid address can be a current street address, a USPS-registered post office box, or a qualifying registered private mailbox.
Best Value
Can an AI scanner tell whether a website is legally compliant?
Not on the evidence available for DarkLens. Automated scanning can flag possible issues, but no independent accuracy or validation evidence for DarkLens is established, and a scan is not a legal compliance determination.
