They are not different kinds of cannabis or different forms of THC. “Hemp” and “marijuana” are legal categories applied to cannabis, while delta-9 THC is a psychoactive cannabinoid found in the plant. As of October 4, 2026, the federal baseline still defines hemp using a delta-9 THC threshold of no more than 0.3% by dry weight. A new federal definition is scheduled to take effect November 12, 2026, so the applicable rule depends on the date.
How the terms compare under federal law
| Question | Hemp-derived delta-9 THC | Marijuana |
|---|---|---|
| What is it? | A product described as coming from hemp and containing delta-9 THC. “Hemp-derived” does not mean THC-free. | Cannabis within the federal Controlled Substances Act’s marijuana category, unless an exception applies. |
| Is it a different plant? | No. Hemp and marijuana are legal classifications applied to cannabis, not separate species. | No. The term does not identify a separate cannabis species. |
| What is the current federal hemp threshold? | Under the 2018 Farm Bill definition, no more than 0.3% delta-9 THC by dry weight. | Cannabis outside the hemp definition generally remains within the federal marijuana framework, subject to applicable exceptions. |
| Does that classification settle whether a product can be sold? | No. FDA requirements and state and local restrictions may still apply. | No. Other applicable federal, state, and local rules still matter. |
The 0.3% figure is a statutory concentration threshold, not a claim that a product is non-intoxicating or contains no THC. It also does not, by itself, establish that a finished product complies with every law that applies to it. The Congressional Research Service describes the 2018 Farm Bill’s hemp definition and the broader federal marijuana framework.

What “hemp-derived” does—and does not—tell you
The label describes a claimed source and legal classification; it does not change delta-9 THC into a different substance. Delta-9 THC is psychoactive whether a product is described as hemp-derived or marijuana-derived. The label alone also cannot establish the product’s exact formulation, compliance, or legal status in a particular place.

The U.S. Food and Drug Administration says the 2018 Farm Bill preserved its authority over cannabis and cannabis-derived products under the Federal Food, Drug, and Cosmetic Act and section 351 of the Public Health Service Act. A product’s hemp status therefore does not amount to FDA approval or establish that it may lawfully be marketed as a food, drug, supplement, or other product.

Why production testing is not a retail legality check
For licensed hemp production compliance, USDA describes “total THC” as the potential total delta-9 THC derived from THC and THCA after decarboxylation, or calculated using a conversion factor when the testing method does not decarboxylate the sample. The result is reported on a dry-weight basis. This production-testing method should not be mistaken for a home test or a simple label check that certifies a retail product’s legal status.
Testing rules and legal questions can differ by context: a production sample is assessed under USDA’s program, while a finished product may also raise questions about its ingredients, labeling, intended use, and the laws of the place where it is sold or possessed.

The federal definition changes November 12, 2026
Public Law 119-37, enacted in November 2025, changes the federal hemp definition, but the change is not yet effective on October 4, 2026. Starting November 12, 2026, the definition shifts from the 2018 delta-9-only threshold to a total-THC approach that includes THCA and adds exclusions for certain products.

That is a statutory carve-out within the amended definition—not a general serving-size recommendation or a blanket rule that classifies every product alike. The law’s exclusions and subsequent implementation matter when assessing a particular product.

- Date: Determine whether you are assessing the product before or after November 12, 2026, when the amended federal definition is scheduled to take effect.
- Jurisdiction: Check current state and local restrictions; the federal hemp threshold does not establish legality everywhere.
- Product and purpose: Consider the exact formulation, labeling, and intended use, along with any applicable FDA requirements. A hemp label is not proof of FDA approval.
- Evidence: Do not treat a farm-production compliance test, a home test, or a label as a complete legal determination for a retail product.
This is a U.S. federal overview, not a state-by-state product clearance. The available evidence here does not establish that hemp-derived and marijuana-derived delta-9 products have different health or safety profiles. FDA says it has not approved a cannabis marketing application to treat a disease or condition, though it has approved one cannabis-derived and three cannabis-related prescription drug products.
