GST Input Tax Credit: Eligibility, Blocked Credits and Documents

GST ITC depends on business use, receipt, prescribed documents, supplier reporting, restrictions and a timely claim. See the eligibility checklist, blocked-credit categories and records to keep.

GST input tax credit (ITC) is not automatic just because a purchase invoice shows GST. For an eligible credit, the registered recipient generally needs a business-use purchase, receipt of the goods or services, a prescribed tax document, the applicable supplier reporting and GSTR-2B checks, and a timely return claim. Credit can also be restricted for exempt or non-business use, blocked for specified purchases, or lost when statutory conditions are not met.

This guide covers the Central Goods and Services Tax (CGST) framework in India, current as of 5 October 2026. State GST generally runs alongside it, but state-specific provisions are not compared here. A real claim depends on the facts, the applicable rules and the tax period.

Who can claim GST input tax credit?

Section 16(1) of the Central Goods and Services Tax Act, 2017 allows a registered person to claim input tax charged on goods or services used, or intended to be used, in the course or furtherance of business, subject to statutory conditions and restrictions. An invoice by itself does not establish entitlement.

Use this eligibility checklist

  1. Check the recipient. The claimant must be a registered person entitled to claim the credit.
  2. Confirm business use. The purchase must be used or intended for use in the course or furtherance of business. Personal or other non-business use is not creditable to that extent.
  3. Confirm receipt. The goods or services must have been received. If goods arrive in lots or instalments, the Act provides for taking credit on receipt of the last lot or instalment.
  4. Hold the prescribed tax document. This may be a valid tax invoice, debit note or another document allowed under the rules; see the documentation section below.
  5. Check supplier reporting and GSTR-2B. For invoices and debit notes that must be reported under section 37, Rule 36(4) requires supplier furnishing and communication of the details to the recipient in GSTR-2B.
  6. Screen for restrictions. Consider blocked-credit rules, personal or exempt use, and any required apportionment before claiming.
  7. Claim within the time limit. Apply the section 16(4) deadline, including the rule that the relevant annual return may make the deadline earlier.
  8. File the relevant return. Filing the return required for the claim is one of the statutory conditions.

Section 16 also requires that the tax charged be paid to the Government within the applicable statutory framework. The checklist is a practical screening sequence, not a substitute for the Act and rules.

Two conditions that can require a later adjustment

  • Supplier payment within 180 days: If the recipient does not pay the supplier the value of the supply plus tax within 180 days from the invoice date, the section 16 proviso requires an amount equal to the ITC availed to be added to output tax liability, with interest as prescribed. Credit can be taken again when payment is made. This particular 180-day condition does not apply to supplies subject to reverse charge.
  • Depreciation on the tax component: Under section 16(3), ITC is not available on the tax component of capital goods or plant and machinery if that component is included in the cost on which income-tax depreciation is claimed. The same tax component cannot support both benefits.

What is blocked credit under GST?

“Blocked credit” commonly refers to categories listed in section 17(5), but not every restriction works the same way. Some purchases are blocked subject to category-specific exceptions. Other credits are restricted because the purchase is used partly for personal or non-business purposes, or for exempt supplies. The precise statutory category, actual use and any exception all matter.

Purchases and expenses that may fall under section 17(5)

The Act identifies the following broad categories, subject to the exact wording and exceptions in the relevant clause:

This is a category map, not an “always blocked” list. For example, the law provides exceptions within some categories, and the facts determine whether an exception applies. Check the applicable clause in section 17(5) before treating a common business expense as eligible or blocked.

Apportionment for mixed and exempt use

Section 17 also restricts credit where an input is used partly for non-business purposes and partly for business, or partly for taxable or zero-rated supplies and partly for exempt supplies. In general, only the business-use and taxable or zero-rated share is available, calculated under prescribed rules. This apportionment is distinct from a section 17(5) block: a purchase may require allocation even when it is not in a specifically blocked category.

Which documents and records should you keep?

Rule 36 recognises specified documents rather than any informal proof of purchase. The record should also support that the supply was received, used for business, allocated correctly where relevant and included in the amount of credit claimed.

Prescribed documents

  • A supplier invoice issued under section 31.
  • A debit note.
  • A bill of entry or import document for integrated tax on imports.
  • Documents issued by an Input Service Distributor.

Rule 36 sets applicable particulars for these documents. Its text includes a limited proviso under which credit may be allowed when some particulars are missing, provided specified core details are present. That limited rule does not make an informal receipt sufficient; verify the document against the current rules.

Reconcile invoices with GSTR-2B

For invoices and debit notes required to be reported by suppliers under section 37, Rule 36(4) requires the supplier to furnish them in GSTR-1 or through the invoice furnishing facility and requires their details to be communicated to the recipient in GSTR-2B. Reconcile the purchase register and tax documents with GSTR-2B, and follow up with the supplier about missing or incorrect entries.

A mismatch is a reason to investigate, not proof by itself that every other eligibility condition has been satisfied or that a claim is automatically resolved. GSTR-2B does not establish business purpose, receipt, blocked-credit status or every other condition in section 16.

Maintain supporting records

Keep records of input tax and ITC claimed, tax invoices and debit notes received or issued, proof or records of receipt, the business purpose, and any allocation between business and non-business or taxable and exempt use. The Accounts and Records Rules require registered persons, subject to stated exceptions, to maintain accounts including input tax and ITC claimed and a register of relevant tax documents.

What is the ITC claim deadline?

Under the current general rule in section 16(4), ITC for an invoice or debit note cannot be taken after 30 November following the end of the financial year to which it pertains, or after furnishing the relevant annual return, whichever is earlier. CBIC Circular No. 237/31/2024-GST reproduces the amended deadline; older consolidated Act copies that show the earlier September wording do not reflect this update.

Limited retrospective relief for certain past periods

The Finance (No. 2) Act, 2024 inserted sections 16(5) and 16(6) retrospectively from 1 July 2017 for specified situations. CBIC’s Circular No. 237/31/2024-GST, dated 15 October 2024, clarifies their implementation. These provisions are limited relief for qualifying cases, not a general extension for every late claim; whether they apply depends on the period and circumstances.

The legal framework described here is based on CBIC’s CGST Act and Rules materials and the 2024 circular. Rules, notifications and portal instructions can change, so confirm the provisions applicable to the relevant tax period before filing or revising a claim.
