Business Standard reported on 5 October 2026 that proposals on input tax credit (ITC) for vehicles and checks on vehicles moving between states were expected to come before the GST Council. Its report does not establish that the Council approved them, and no official 2026 confirmation was identified.
Can a business currently claim GST ITC on a car used for work?
Not automatically. Under the current-law baseline in Section 17(5)(a) of the CGST Act, ITC is unavailable for passenger motor vehicles with an approved seating capacity of no more than 13 people, including the driver, subject to specified exceptions. The GST Council’s official material for its 54th meeting reproduces the provision: “input tax credit shall not be available in respect of motor vehicles for transportation of persons having approved seating capacity of not more than thirteen persons (including the driver), except when they are used for making the following taxable supplies”.

The exceptions described in that provision are when the vehicles are used for further supply of those vehicles, passenger transportation, or driving instruction. A vehicle being used for ordinary business travel does not, by itself, establish eligibility under those exceptions. See the GST Council’s 54th meeting material for the reproduced statutory text. Businesses should check the enacted law and applicable notifications for their circumstances.

What wider vehicle ITC is reportedly under consideration?
Business Standard’s 5 October 2026 report says a proposal could permit ITC on motor vehicles with seating capacity up to 13 people, including the driver, and extend credit to related insurance, servicing, repairs, and maintenance. The report does not provide final rule language or establish that the proposal was adopted. Its specifics rely on unnamed sources, rather than a named official statement. Read the Business Standard report.

The report also lists vehicle leasing and rentals, electric vehicles, demonstration and second-hand vehicles, and goods delivery through ecommerce platforms among the subjects under discussion. It does not settle how any of these categories would qualify, what conditions would apply, or whether they would be covered in final rules.
Has the GST Council approved the changes?
The available evidence does not establish approval. Business Standard described the measures as proposals expected to come before the Council, and its report said they were not final. No official 2026 Council material confirming adoption was identified. Until an official decision and applicable legal instrument are available, businesses should not treat the reported expansion as an entitlement or claim ITC on that basis.
The report also does not establish an effective date, detailed eligibility conditions, or how any change would interact with the existing statutory exceptions. Those points would need to be confirmed in official Council communications, amendments, or notifications.
What might change in interstate vehicle checks?
Business Standard’s report describes a possible approach in which a vehicle could be stopped for an interstate check when specific information calls for one, with prior authorization from a senior officer. It does not provide final rule language or show that this approach has been adopted. The report’s account is therefore not a basis for assuming that current checks have changed.

Historical GST Council material from its 29th meeting discusses risk-based checks, senior-level authorization, and reporting checks. That context does not verify the 2026 report or prove that a new proposal has been approved. See the 29th GST Council meeting material.

What businesses should do now
- Apply the current law and any applicable notifications to vehicle-related ITC claims; do not rely on the reported proposal as permission to claim credit.
- Keep records that establish the vehicle’s approved seating capacity, its business use, and whether a statutory exception applies.
- For insurance, servicing, repairs, and maintenance, do not assume the reported possible extension applies before official wording and an effective date are published.
- Check official GST Council and government notices for a decision, final conditions, and commencement date before changing tax treatment.
