M/s Mohit Minerals Pvt. Ltd. But that does not make every recommendation optional: a statute can require the executive to follow Council recommendations when exercising delegated rule-making powers. The distinction matters because the Council is a constitutional forum for cooperative decision-making, not a legislature with power to enact GST laws itself.
What is the GST Council?
Article 279A of the Constitution of India establishes the Goods and Services Tax Council. It brings the Union and the States together to make recommendations on GST matters. Its membership consists of the Union Finance Minister, who chairs it; the Union Minister of State in charge of Revenue or Finance; and a minister nominated by each State government. The official GST Council description lists matters such as taxable and exempt supplies, model GST laws, place-of-supply principles, thresholds, rates, floor rates with bands, disaster-related special rates and special provisions for certain States.

Article 279A also provides for a mechanism to adjudicate specified disputes between the Union and States, or among States, when those disputes arise from Council recommendations or their implementation. It further says that specified vacancies, defects in appointments and procedural irregularities that do not affect the merits do not, by themselves, invalidate Council acts or proceedings. The constitutional framework is set out in Article 279A of the Constitution of India.

How does the Council’s voting system work?
Article 279A uses weighted voting, not a simple one-member, one-vote count. A decision requires at least three-fourths of the weighted votes of members present and voting. The Union has one-third of the total vote weight, while State governments collectively hold two-thirds.
#1 Best Overall
Because the threshold is three-fourths, neither the Union’s one-third nor the States’ two-thirds reaches it alone. A decision therefore requires support across the Union-State divide among the members participating in that vote. The rule is a constitutional threshold, not an empirical measure of how often the Council reaches agreement.
Are GST Council recommendations binding?
Not on Parliament or State legislatures exercising primary legislative power. In its 19 May 2022 decision in Union of India v. M/s Mohit Minerals Pvt. Ltd., the Supreme Court concluded that Council recommendations are persuasive, rather than binding edicts, when the Union and States make primary law. The Court relied on the legislative authority conferred simultaneously by Article 246A and the absence of language making that authority subject to Article 279A. The Supreme Court judgment describes the Council’s recommendations as products of collaborative dialogue.

Justice Dhananjaya Y Chandrachud, who authored the judgment, wrote: “The ‘recommendations’ of the GST Council are the product of a collaborative dialogue involving the Union and States.” That account reflects the Council’s role in coordinating GST policy while leaving legislatures with their constitutional lawmaking authority.
Primary legislation
When Parliament or a State legislature exercises its primary lawmaking power, it is not constitutionally compelled by Article 279A to enact a Council recommendation. The Council can shape and coordinate policy, but the recommendation itself does not substitute for legislation.
Rank #3
Executive action under delegated powers
The judgment does not establish a general right for the government to disregard Council recommendations. An executive authority making rules or notifications under a statute must comply with that statute. If the statute makes Council recommendations a condition for using a delegated rule-making power, the executive is bound by that statutory requirement. Whether a recommendation binds therefore depends on the actor and the power at issue: primary legislative power is different from executive action governed by a statutory condition.
What was the Mohit Minerals dispute about?
The case also addressed integrated GST (IGST) on ocean freight in imports made on a cost, insurance and freight (CIF) basis. The dispute concerned a reverse-charge levy on the service aspect of the freight. The Court held that, in the circumstances before it, a separate levy on that service aspect was impermissible where the importer was already liable to IGST on the composite supply of imported goods, which included transportation, insurance and other components.
Rank #4
That tax conclusion was specific to the transaction and statutory treatment before the Court. It is distinct from the constitutional ruling about the force of Council recommendations: one concerned how a particular import supply could be taxed, while the other concerned the relationship between the Council and legislative or executive powers.
What the ruling means for fiscal federalism
The judgment frames the GST Council as a forum for Union-State cooperation rather than a body whose recommendations automatically override the lawmaking authority of either level of government. Its weighted voting rule encourages agreement across governments, while Article 246A preserves primary legislative authority. At the same time, statutes may channel Council decisions into executive action by making recommendations a prerequisite for delegated rules or notifications. The result is a system of coordinated policymaking whose legal effect depends on what government actor is acting and under which source of authority.
