Yes—some H-1B workers can pursue a green card without their employer sponsoring the usual labor-certification process. The main self-petition options are EB-1A extraordinary ability and the EB-2 National Interest Waiver (NIW), but both have demanding, distinct eligibility standards. Schedule A is not a self-petition, and EB-5 is an investor route rather than a substitute based on professional experience. Eligibility for a category also does not mean an immigrant visa is immediately available.
Can I get a green card without my employer sponsoring me?
Potentially. USCIS allows a qualified person to self-petition in EB-1A and, when the person first qualifies for EB-2 and meets the waiver standard, EB-2 NIW. Those routes can avoid the ordinary employer-sponsored labor-certification process. Whether either fits depends on the applicant’s evidence and proposed work—not simply on having H-1B status, a graduate degree, or a successful career.
“Without employer sponsorship” can mean different things. A worker may be asking whether they can file the immigrant petition themselves, whether labor certification can be avoided, or whether they can change jobs. EB-1A and NIW can allow self-petitioning, but job-change consequences are a separate question. Schedule A still requires an employer filing, while EB-5 is based on investment and job creation.

How the main routes differ
| Route | Can the worker self-petition? | What the route requires | Employer and labor certification |
|---|---|---|---|
| EB-1A extraordinary ability | Yes | Evidence that the applicant has extraordinary ability in the field, meeting USCIS’s high standard | No job offer or labor certification is required for this category |
| EB-2 National Interest Waiver | Yes | First, eligibility for the underlying EB-2 classification; then evidence supporting a waiver in the national interest | If the waiver is granted, the job-offer requirement—and therefore labor certification—can be waived |
| Schedule A | No | A qualifying designated occupation or category, with the required employer-filed labor-certification application | The employer submits the application directly to USCIS rather than going through ordinary Department of Labor review |
| EB-5 investor | Not an employment-based professional self-petition | Investment in a U.S. commercial enterprise and a plan to create or preserve at least 10 permanent full-time jobs for qualified U.S. workers | Not based on an employer’s labor certification; it is a separate investor classification |
| Ordinary employer-sponsored EB-2 or EB-3 | No, in the usual labor-certification pathway | An eligible job and the applicable employment-based requirements | The employer generally obtains labor certification from the Department of Labor before filing Form I-140 |
EB-1A: self-petition based on extraordinary ability
EB-1A is for people whose expertise places them among the small percentage at the top of their field, as USCIS describes the standard. A person may file on their own behalf without a job offer or labor certification. USCIS identifies a major internationally recognized award as one possible example of evidence; applicants without such an award must be assessed under the applicable evidence rules.
This is a high evidentiary threshold, not a general reward for seniority, strong performance, or years in H-1B status. The relevant question is whether the record establishes extraordinary ability under the category’s requirements. An experienced worker should not assume that a successful career alone makes EB-1A available.

EB-2 NIW: first qualify for EB-2, then establish the waiver case
An NIW petition has two stages of eligibility. The applicant must first qualify for the underlying EB-2 classification—as a professional with an advanced degree or as a person of exceptional ability—and then establish that the national-interest waiver standard is met. USCIS’s January 15, 2025 policy alert explains that USCIS may waive the job-offer requirement and thus labor certification when the work is in the national interest.
Underlying EB-2 qualification
USCIS defines an advanced degree to include a degree above a bachelor’s degree or, in certain circumstances, a bachelor’s degree followed by at least five years of progressive post-baccalaureate experience in the specialty. Exceptional ability is a separate basis for EB-2 classification. The Form I-140 instructions give examples of supporting evidence, but a generic document checklist cannot establish an individual’s eligibility.

The national-interest waiver
The waiver is not automatic just because someone has a graduate degree, works in a popular industry, or believes their work benefits the United States. USCIS’s 2025 guidance addresses how it evaluates the proposed endeavor and the relationship between exceptional ability and that endeavor. The petition needs evidence that addresses the relevant criteria and the applicant’s specific case.
Schedule A: an employer-filed labor-certification route
Schedule A is a limited process for designated occupations and categories, not a general way for any H-1B worker to avoid labor certification. The employer submits the labor-certification application directly to USCIS instead of undergoing ordinary Department of Labor review. USCIS’s April 10, 2024 alert describes this as submitting the application “directly to USCIS, bypassing DOL review.”

- Group I: registered nurses and physical therapists.
- Group II: people with exceptional ability in the sciences or arts, including a separate subset for performing arts.
Because the employer files, Schedule A does not let the worker self-petition. The worker’s occupation and evidence must fit the designated category, and the employer must participate in the filing.
EB-5: a distinct investor option
EB-5 is based on investment in a U.S. commercial enterprise and a plan to create or preserve at least 10 permanent full-time jobs for qualified U.S. workers. It is not a green-card category earned through H-1B work history or professional achievements.

The USCIS EB-5 program page lists minimum investments of $1.8 million generally and $900,000 in a targeted employment area. These figures and program rules can change; check USCIS’s current EB-5 requirements before relying on either amount or considering a filing.
What if the current employer will not pursue labor certification?
If an employer cannot or will not pursue labor certification, the ordinary employer-sponsored EB-2 or EB-3 route may not be workable through that employer. That does not by itself establish eligibility for a self-petition category. A worker can assess whether their record supports EB-1A or EB-2 NIW, or whether a different qualifying employer is willing and able to pursue an employer-sponsored case. Schedule A may be relevant only when the occupation and filing meet its requirements.

Approval eligibility and the ability to complete the green-card process are separate. Visa availability depends on the preference category, country of chargeability, and the applicable monthly Visa Bulletin. For adjustment of status, USCIS also determines which Visa Bulletin filing chart applicants must use for that month. Check the current bulletin and USCIS chart selection rather than relying on a past cutoff or a general estimate; no individual filing date or waiting time follows from the category alone.
Processing time is not guaranteed. USCIS says it varies with application volume, workload and staffing, response times, and policy or operational changes. A pending or approved immigrant petition should not be treated as a promise of a particular completion date.
Can I change jobs while an I-140 or I-485 is pending?
Do not assume that filing or approval of any petition gives unrestricted permission to change employers or alter the work underlying the case. USCIS describes an employment-based adjustment portability rule for certain applicants with approved EB-1, EB-2, or EB-3 petitions: when Form I-485 has been pending for at least 180 days, a qualifying change may be possible if the new position is in the same or a similar occupational classification.
USCIS says those portability provisions do not apply to adjustment applicants whose approved petition is based on extraordinary ability or an NIW. In particular, an NIW or EB-1A filing should not be treated as blanket approval to change the proposed endeavor without consequences. The effect of a job or endeavor change depends on the category and the facts of the case.
Quick Recap
How to compare routes for your situation
- Start with the kind of case you can document. EB-1A focuses on extraordinary ability and recognition; NIW requires underlying EB-2 qualification plus a national-interest waiver case.
- Separate self-petitioning from labor-certification exceptions. EB-1A and NIW permit self-petitioning when their standards are met. Schedule A remains employer-filed.
- Consider whether the route matches your actual circumstances. EB-5 depends on investment and job creation, not a professional-achievement record.
- Check visa availability independently. Even a strong category case does not establish that a visa is currently available for your chargeability and filing stage.
- Get case-specific advice before making employment decisions. Evidence, proposed work, category requirements, and any pending adjustment application can affect the consequences of a change.
