Google’s lawsuit against SERP-data provider SerpApi puts automated access to Search results under legal and technical pressure, but it has not ended rank tracking or established a blanket right to scrape Google. The July 2026 court ruling was limited to particular claims about copyrighted and non-copyrighted content. AI agents could increase demand for machine-readable search data, but no available figure establishes that they have caused scraping to rise.
Why Google sued a search-results provider
On December 19, 2025, Google said it had sued SerpApi for allegedly circumventing measures protecting third-party copyrighted content displayed in Google Search and disregarding website and rightsholder directives. That is Google’s account of why it brought the case, not a court finding that SerpApi broke the law.

Google General Counsel Halimah DeLaine Prado said in the company’s December 19 statement: “Google follows industry-standard crawling protocols, and honors websites’ directives over crawling of their content.” That describes Google’s stated approach to crawling; it does not resolve what obligations apply to every third-party service that collects Search results.

What Google alleged about SearchGuard and SerpApi’s requests
In its complaint, Google described SearchGuard as a measure launched in January 2025 that sends JavaScript challenges to queries from unrecognized sources. Google alleged SerpApi masked automated requests so they appeared to come from human users. These are allegations in the complaint, not findings after a trial.

Google also alleged that SerpApi generated hundreds of millions of artificial Search requests per day and that request volume had increased by as much as 25,000% over two years. Both figures come from Google’s complaint and should be treated as claimed figures, not independently verified measurements.
The complaint describes SerpApi’s Google Search API as a paid service that automates access to results and extracts features such as Knowledge Panels. That makes the dispute relevant to the broader category of SERP APIs and rank-tracking software; it does not mean Google endorses those services or that they have been legally cleared.

What the July 2026 court order decided—and left open
On July 20, 2026, the U.S. District Court for the Northern District of California granted SerpApi’s motion to dismiss Google’s original complaint. The court treated results without copyrighted content differently from results containing copyrighted components:

- Results with copyrighted components: The court dismissed the claims with leave to amend, finding Google had not adequately alleged that the relevant copyright owners authorized SearchGuard’s implementation.
This was a pleading-stage decision about the original complaint. It did not decide that every form of SERP scraping is lawful, eliminate every possible legal theory, or give rank trackers and AI agents a general right to scrape Google Search.

The case’s reported status after the dismissal
On August 25, 2026, SerpApi’s general counsel said Google had filed an amended complaint and SerpApi had again moved to dismiss. SerpApi characterized Google’s amended theory as narrower and focused on licensed content in Search results, principally Knowledge Panel images. That description is SerpApi’s characterization; the available account does not establish a later ruling on the new motion.
Could AI agents increase pressure on SERP data?
SerpApi says developers and AI companies use its service to access public search information, and its October 2026 site surfaced a post about an agent plugin. That supports the inference that AI workflows can use search-data services. It does not show how much scraping agents generate, whether their activity is increasing year over year, or whether any particular agent bypasses SearchGuard.
The forward-looking concern is that agents may create more demand for search results in machine-readable form. If that demand grows, it could add pressure to the dispute over automated access, content rights, and access controls. That is a possibility, not a measured trend—and Google’s complaint figures do not establish that agents caused the alleged request volume.

What SEO teams should compare when choosing visibility data
“SERP tracking” can refer to different data sources and collection methods. Before relying on a provider, compare the specifics rather than assuming every tool captures the same results or has the same exposure to access changes.
Best Value
- Data source: Is the information from Google Search Console reporting, a provider’s collected SERPs, or another search engine?
- Coverage: Which queries, locations, devices, languages, organic listings, and special result features are included?
- Freshness and sampling: How often are results collected, and how does the provider represent gaps or estimated positions?
- Collection method and terms: Does the service rely on an official interface, a licensed source, an API, or direct automated collection? Check its current terms and legal posture rather than inferring them from product features.
- Resilience and cost: How could access controls, request limits, or changes to collection affect reliability and pricing?
These are evaluation questions, not guarantees that a particular provider is accurate, compliant, or unaffected by Google’s controls. Functionality and legal or operational risk are separate issues.

UK fair-ranking requirements
On June 17, 2026, the UK Competition and Markets Authority imposed a fair-ranking conduct requirement on Google. It calls for organic search ranking based on objective and non-discriminatory criteria, including in search generative AI features; greater transparency about ranking and material changes; and a process for publishers to raise concerns. This is a UK-specific competition requirement, not general permission to scrape Search results.
U.S. search competition remedies
The U.S. Department of Justice has summarized remedies requiring Google to make certain search-index and user-interaction data available to certain competitors and to offer search and text-ad syndication to certain competitors. A September 2, 2025 court opinion discusses query, ranking, interaction, and query-interpretation data relevant to competition among search engines. Those remedies concern specified competitors and competition remedies; they do not create a general scraping right for rank trackers or AI agents.

The case does not establish that SERP tracking tools as a category must end. It does show why users should not treat automated access to Google’s public interface as risk-free or assume a tool’s current method and coverage will remain unchanged. The original complaint was dismissed with different outcomes depending on whether results contained copyrighted components, and the amended case’s later outcome is not established here.
For now, teams should choose monitoring data based on the coverage they need, understand how it is collected, and verify a provider’s current terms, reliability, and legal posture. AI-agent use may make machine-readable SERP data more valuable, but the evidence does not yet show that agents have measurably worsened scraping.
