What federal rules say about gas dirt bikes
The U.S. Environmental Protection Agency includes off-highway motorcycles, including dirt bikes, in its recreational-vehicle emissions framework and points to the applicable federal regulations, including 40 CFR Part 1051. A regulatory framework means the vehicle category is regulated; it does not mean every gasoline-powered model is prohibited.

Why California’s red-sticker change caused confusion
California’s rule is narrower than a nationwide ban. The state’s Off-Highway Motor Vehicle Information Bulletin says competition-labeled dirt bikes and ATVs that were previously eligible for the red-sticker program cannot be registered in California for model year 2022 and later unless manufacturers build and certify them as emissions-compliant green-sticker models. The bulletin also says the prior competition-only exemption from emissions compliance for certain public-land use no longer applies. These changes concern the covered California vehicles and model years; they do not establish a ban on all gas dirt bikes in California or elsewhere.

California’s Air Resources Board says emissions-control regulations apply to off-highway recreational vehicles with engines of 50 cc or greater, subject to distinctions for zero-emission vehicles and competition-only vehicles. Standard off-highway vehicles generally need CARB and EPA certification unless intended exclusively for competition use. A competition designation is not blanket permission to ride anywhere: registration and riding access remain subject to the applicable rules.

Gas and electric dirt bikes are not interchangeable under the rules
California DMV materials classify off-highway electric motorcycles as OHVs and describe their design as primarily for off-highway operation, powered by an electric motor, with handlebars, a straddle seat, two wheels, and no pedals. That classification does not make an electric dirt bike an electric bicycle or a street-legal motorcycle, and it does not mean electric and combustion bikes have identical registration or emissions requirements.
What to check before buying or riding
- Identify the exact bike. Confirm the model year, engine size, and emissions-certification label rather than relying on a general product description.
- Check your jurisdiction’s requirements. Registration and sticker eligibility vary by location. In California, check the state’s current OHV information bulletin and the DMV’s off-highway vehicle registration guidance.
- Verify the riding area’s rules. A bike’s competition status or registration does not by itself establish access to a particular public or private riding area.
- Confirm the model’s current status. The federal and California guidance does not establish the certification or availability of any particular gas dirt bike. Verify the specific model, model year, jurisdiction, and riding-area requirements before purchase or use.
Bottom line
Gas dirt bikes remain a regulated vehicle category, not a universally banned one. California’s model-year 2022-and-later red-sticker change affects a defined group of competition-labeled bikes; it should not be mistaken for a nationwide end to gas dirt bikes.
