France does not use one notice rule for both demonstrations and strikes. Many public-road demonstrations require an advance declaration to the mayor or prefect, while strike procedures depend on whether workers are in the private sector or a particular public service. Authorities can restrict demonstrations, and some public services have continuity arrangements—but those rules do not guarantee that services will operate normally during a strike.

Demonstration and strike rules are different

A demonstration concerns the use of public space; a strike is a work stoppage. A public-road event is generally subject to an organizer’s prior declaration, not a blanket requirement to obtain a permit. Strike notice rules, by contrast, apply to workers and vary by employment sector and service.

Activity Who gives notice General timing What the rule does
Public-road demonstration Organizer, to the mayor or prefect Normally 3 to 15 clear days before the event; Paris and customary local events have distinct rules Lets authorities assess the event and, if needed, seek changes or prohibit it on public-order grounds
Private-sector strike No general advance notice requirement is stated in the cited private-sector guide Depends on the circumstances; special rules apply to certain public passenger-transport activities Sets the legal definition and protections for a qualifying strike
Covered public-service strike Union gives notice; in certain services, individual employees must also declare an intention to strike Generally 5 clear days for covered public-service strikes; 48 hours for covered territorial employees under the applicable conditions Allows for service-specific strike rules and continuity planning; it does not ensure normal service

The demonstration rules and deadlines in this article follow Service-Public guidance verified 3 September 2024. The private-sector guide was verified 10 August 2026, and the public-service guide 3 March 2026.

Do you need permission to demonstrate in France?

For a procession, march, gathering or demonstration on a public road, the general rule is to make a prior declaration to the mayor or prefect. This is a declaration procedure, not a guarantee that authorities will approve the event as proposed. Service-Public says customary local outings may be exempt; Paris has different deadlines, so the general 3-to-15-clear-day filing window is not universal.

What the declaration must include

According to Service-Public’s guidance on public-road demonstrations, the declaration includes:

  • The organizers’ details and, where applicable, the association’s details
  • The event’s purpose, location and times
  • The route, if it is a procession
  • Estimated attendance and planned safety arrangements

Because local procedure and the event type matter, organizers should confirm the applicable filing route and deadline with the relevant authority rather than assume the general window applies to their event.

Can authorities change or ban a demonstration?

Yes. The mayor or prefect may seek changes, including to the schedule or route. The authority may prohibit a planned demonstration by order if it considers the event likely to disturb public order. Service-Public describes an expedited procedure for challenging such a prohibition, with judicial review possible in less than 48 hours; that is a review timeframe, not a promise that every challenge will be decided within a fixed period.

Service-Public says organizers may face up to six months’ imprisonment and a €7,500 fine for organizing without a declaration, organizing an event that has been prohibited, or submitting an incomplete or inaccurate declaration. Those are the stated maximum penalties for the organizer offences described in that guidance, not a claim that every procedural mistake leads to the maximum sanction.

How do strike rules differ between private and public employment?

Private-sector employees

Service-Public defines a private-sector strike as a total, collective and concerted cessation of work in support of professional demands. The cited guide says an employee generally cannot be sanctioned or dismissed merely for taking part in a strike. It notes an exception where personal serious misconduct is involved, including active participation in illegal acts. Certain public passenger-transport activities are subject to special rules, so the general private-sector description does not settle every transport case.

Public-service employees

Public officials also have a right to strike, but it is regulated by statutes and service-specific rules. For covered public-service strikes, Service-Public gives a general requirement of five clear days’ notice. In some services, an employee must also notify the employer individually in advance. Minimum-service provisions apply in certain areas, not to every public service under one universal arrangement.

The rules differ across the state, territorial and hospital public-service branches. The Service-Public public-service strike guide sets out the relevant distinctions and special cases; workers and users should check the rules for the particular branch and service rather than assume one procedure covers them all.

What continuity arrangements apply to local public services?

The General Code of the Public Service allows local authorities and unions to negotiate continuity arrangements for specified territorial services. The listed areas include household waste collection and treatment, public passenger transport, support for older and disabled people, care for children under three, after-school care, and school or collective catering. The relevant code provisions, articles L114-1 to L114-10, in the version in force from 1 March 2022, set out this framework.

Under the statutory conditions for covered services, territorial employees must notify the authority of their intention to strike at least 48 hours in advance. That individual notice is distinct from the general five-clear-day notice for covered public-service strikes. Continuity arrangements help authorities plan services and inform users; they do not require every listed service to run normally, and arrangements are not identical in every locality.

What this means for people planning an event or relying on services

  • If you are organizing a demonstration: confirm whether your event is covered by the general declaration rule, identify the competent mayor or prefect, and check the local deadline and any event-specific directions.
  • If you are attending a demonstration: a declaration does not rule out changes or a public-order prohibition. Check current instructions from the relevant authority.
  • If you rely on a public service during a strike: continuity planning may reduce disruption in some services, but it is not a guarantee of full operations. Check current notices from the local authority, transport operator or service provider.

The official pages cited here establish legal procedures and possible arrangements, not how often demonstrations are prohibited, how many people strike, or how much disruption a particular strike will cause.
