The order stops the insurer from soliciting or accepting new or renewal Florida business, but it does not automatically cancel existing Florida policies: OIR says Atlantic Coast must continue servicing them and honor its continuing liabilities.
Did Florida suspend Atlantic Coast Life?
Yes. On Oct. 1, 2026, Florida OIR announced an Immediate Final Order suspending Atlantic Coast Life’s certificate of authority (COA) effective immediately. OIR said it found the company impaired and cited rehabilitation proceedings initiated by the South Carolina Department of Insurance, Atlantic Coast’s domestic regulator, which had petitioned a court to place Atlantic Coast and a subsidiary into receivership for rehabilitation. Florida OIR’s Oct. 1 notice identifies Florida Statute 624.418 as the basis for an immediate suspension in specified circumstances, including an impairment or insolvency finding or delinquency proceedings initiated by another state insurance supervisor. The notice also refers to the agent-notice provision in section 624.420.
This is a Florida regulatory action affecting the company’s authority to operate in Florida. South Carolina’s rehabilitation process is a separate proceeding in the company’s home state.
Can Atlantic Coast Life still sell or renew policies in Florida?
No. Under OIR’s notice, Atlantic Coast must stop acting or holding itself out as an insurer in Florida and stop soliciting or accepting new or renewal Florida business. OIR also requires the company to continue statutory filings until it certifies—and OIR confirms—that Florida claims, liabilities, and obligations have been paid or settled. Insurance Journal reported that Atlantic Coast became authorized to do business in Florida in 2006 and that its Florida business was mostly annuities.

Are existing Atlantic Coast Life policies canceled?
OIR’s notice does not say existing Florida policies are automatically canceled. Instead, it says Atlantic Coast must continue servicing all Florida in-force policies and honor its liability for losses and unearned premiums for as long as those liabilities exist. That stated servicing duty is not a promise about how quickly an individual claim will be paid, nor does it determine what a particular policy covers. Policyholders should consult their policy documents and current instructions from the company or regulators about their own contracts.
What does impaired surplus mean for policyholders?
Surplus is an insurer’s financial cushion above its liabilities. “Impaired surplus” in this dispute reflects Florida’s calculation after statutory limits on investments in subsidiaries and affiliates; it is not the same figure as the company’s reported surplus before those limits are applied.

Insurance Journal, attributing the figures to Florida’s order, reported that Atlantic Coast had $47 million in reported surplus in the second quarter of 2026, compared with a $55 million statutory minimum. After Florida’s limits on affiliate investments, the order reportedly calculated about $170 million in impaired surplus as of June 30, 2026. These are figures reported from the order, not an independent assessment of the company’s current ability to pay a particular claim. Insurance Journal’s account of the order also gives this reported timeline:

Insurance Journal also reported that, as of August 2026, Florida records counted 6,001 annuity policies, 986 life policies, and 19 accident-and-health policies, and that nearly $13 million in total Florida premiums had been collected year to date in the order’s reporting. Those figures describe contracts and premiums, not a count of unique people or an estimate of any individual’s recovery.

What should Atlantic Coast Life policyholders do now?
- Keep your policy, recent statements, and correspondence together so you can refer to the contract’s terms and your account details.
- Check current notices from Florida OIR, the South Carolina Department of Insurance, and Atlantic Coast Life for instructions that apply to your policy.
- Use the contact information on your policy or a current regulator notice for questions about premiums, beneficiary details, claims, or servicing.
- Do not assume the suspension itself cancels your coverage or changes the policy terms. Do not surrender, replace, or stop paying a policy solely because of the suspension without authoritative, case-specific guidance.
What Atlantic Coast Life and Florida officials have said
OIR’s notice quotes its order as saying the suspension was issued because Atlantic Coast was impaired and South Carolina had initiated receivership proceedings for rehabilitation, “to protect current and prospective policyholders.” The notice separately states that Atlantic Coast must continue servicing Florida in-force policies and honor its liability for losses and unearned premiums while those liabilities exist.
Insurance Journal reproduced a company statement saying Atlantic Coast disagreed with Florida OIR’s action, intended to work in good faith to resolve the matter, and remained focused on policyholder obligations while pursuing a capital raise and corporate restructuring. That is the company’s position, not an independent verification of its financial capacity or the outcome of those efforts.

Why the status may change
The Florida suspension and the South Carolina rehabilitation proceeding are active regulatory matters. The Oct. 1, 2026 Florida notice establishes the suspension and servicing requirements described above; it does not establish what the South Carolina court later ordered or whether regulators subsequently issued additional policyholder instructions. Check the latest notices from both regulators before relying on the status for a decision about an individual policy.
