Flock Safety says it has tightened controls on its license-plate camera network, but its announced safeguards have not been shown to prevent misuse or mistaken identification. Congressional scrutiny has raised the stakes: lawmakers are weighing distinct proposals, neither of which was law as of October 3, 2026, while asking how Flock’s controls work in practice.
What Flock says it changed
Flock’s current public policy and product page says it has reduced its recommended default retention period for captured data from 30 days to seven. The company also says it expanded audit requirements and proactive monitoring, made multi-factor authentication mandatory for every customer, gave agencies more control over sharing data with other agencies, and increased transparency about data ownership, security and agency policies. Flock says customers control their data and every search is logged; these are the company’s descriptions of its own controls, not independent findings about their effectiveness.

An Associated Press report dated August 13, 2026, described additional announced requirements for law-enforcement customers: use of an audit tool intended to flag abnormal search behavior, with users locked out pending internal review if flagged; a case number from an agency records system linked to each search; and a seven-day standard retention period, with longer preservation allowed for data tied to a case number. AP reported that many guardrails previously optional were to become mandatory by January 1. That was a reported rollout plan, not verification that every customer had implemented every control. The company’s current page and AP’s account describe overlapping but not necessarily identical policy elements or implementation timelines.
What Congress is asking for
Senate hearing and Hawley proposal
The Senate Judiciary Subcommittee on Crime and Counterterrorism held a hearing titled “Always Watching: Flock’s Nationwide AI Surveillance Network” on September 23, 2026. Its hearing page lists testimony from Lindsey Isaacs, described as a wrongfully accused driver; Institute for Justice attorney Alasdair Whitney; Pinal County Sheriff Ross Teeple; cybersecurity engineer Benn Jordan; and ACLU Senior Policy Counsel Chad Marlow.

In a September 30 announcement, Senator Josh Hawley said Flock’s CEO declined to testify, while the company supplied written answers and agreed Congress should create a federal framework. Hawley said he would introduce the Stop Flock Abuse Act. As described in his announcement, the proposal would bar local governments from selling or sharing vehicle-location data with nongovernmental third parties; require written approval and audit records for searches; require encryption and U.S.-based storage; and generally require deletion after ten days, with exceptions for active criminal investigations. These are proposed provisions, not current law. Hawley said, “Law-abiding Americans should not be treated like criminals.”
Separate House proposal
The Flock-Off Act, H.R. 10221, is a separate measure. The Government Publishing Office legislative record says Representative Thomas Massie introduced it on September 2, 2026, with six cosponsors, and that it was referred to the House Committee on Oversight and Government Reform. Its full title describes a prohibition on federal funds for covered camera systems and associated components. It is not enacted law and should not be confused with Hawley’s proposed rules for data handling and access.

Why the safeguards face scrutiny
A mistaken identification with serious consequences
At the Senate hearing, Lindsey Isaacs described being arrested after a camera misidentified her vehicle in connection with a fatal crash in October 2025. A Senate Judiciary Democratic press release says she spent 13 days in jail facing eight felony charges, which were dropped seven months later. The release reports that Isaacs said her new car had no damage matching the crash. This is an account of one case, not evidence of a system-wide error rate.
Allegations of searches for improper purposes
A September 2026 inquiry by Senators Adam Schiff and Ron Wyden describes allegations that officers used Flock systems for unauthorized surveillance, including searches connected to reproductive health care, immigration enforcement and criticism of local police. The senators’ release attributes to a Washington Post analysis of police and court records a figure of at least 50 officers charged or accused of misuse. That is the senators’ account of the analysis, and “charged or accused” does not mean that every officer was found to have committed misconduct.

The senators’ letter asks how safeguards operate, including whether the system proactively locks out users, how it handles offense filtering and pretextual search justifications, whether agencies comply with local and state rules, whether biometric authentication is used, what data-capture error rates are, and whether the company complies with California privacy law. The letter’s questions do not establish that each alleged practice occurred or that Flock admitted it. The release says the senators requested responses by September 25, 2026; the sources cited here do not establish whether Flock responded by that date. The letter characterizes Flock’s record this way: “Despite a professed public commitment to responsible governance, Flock has repeatedly failed to implement the safeguards necessary to protect Americans’ civil liberties.” That is the senators’ assessment, not a judicial finding.

Shorter default retention, access controls and logged searches can reduce exposure only if they are deployed consistently and meaningfully enforced. The relevant test is not simply whether a feature exists, but whether it works across customer agencies, deters improper access, catches misuse promptly, and offers accountability when a system points to the wrong vehicle. Company descriptions and announced product controls do not, by themselves, establish those outcomes.

The competing concerns involve more than one setting. Law-enforcement agencies point to investigative and public-safety uses; critics and lawmakers focus on persistent location tracking, civil liberties, who can search or share information, and the consequences of a false match. The evidence cited here does not provide a common independent study resolving that dispute or measuring the effectiveness of Flock’s new safeguards. Nor does it establish an independent system-wide ALPR capture error rate. The questions lawmakers have raised about monitoring, exceptions, audits and remedies remain central to evaluating the controls.
