Fisker initially told American Lease that the connected-car systems for roughly 3,300 Ocean SUVs could not be moved to a separate server controlled by the buyer. That threatened the value of a $46.25 million bankruptcy sale, because the Ocean’s app, over-the-air updates and diagnostics relied on Fisker’s backend. The sale was not ultimately canceled: a later agreement kept the cloud services operating under a five-year arrangement, while also providing a support path for existing owners.
How the server dispute began
Fisker entered bankruptcy protection in 2024 and began liquidating its assets. American Lease agreed to buy approximately 3,300 remaining Ocean electric SUVs for about $46.25 million. By early October, it had paid roughly $42.5 million and received about 1,100 vehicles, according to reporting and the buyer’s bankruptcy-court filing.
On or around October 4, 2024, Fisker told American Lease that the vehicles could not, “as a technical matter,” be ported from Fisker’s server to a separate server owned or controlled by American Lease. American Lease filed an emergency objection shortly before a hearing on Fisker’s liquidation plan, arguing that the disclosure put the transaction and the fleet’s usefulness at risk.

What “porting the vehicles” meant
Porting did not mean physically moving the cars. It meant transferring the connected-vehicle backend: vehicle identities, account records, authentication, software-service connections and the systems that let cars communicate with apps and servers.
A useful model is:
- The Ocean is the hardware: battery, motors, computers, displays, locks and other physical systems.
- The backend is the control layer: cloud records associate each vehicle with owners, accounts, permissions and service data.
- The connection is authenticated: the car and server must recognize each other before remote commands, diagnostics or updates can work.
Moving that environment is therefore more complicated than copying a database. It may involve certificates and encryption keys, domain names, firmware settings, third-party licenses, cellular services, operational credentials and privacy controls. Fisker’s public statement established that it considered migration technically unavailable, but the court materials do not publish an architecture diagram, source-code explanation or independent engineering assessment showing exactly why.
Possible barriers—but not established facts
Several explanations are technically plausible, but none was publicly confirmed as the reason in this case:

- Vehicle firmware may have been tied to Fisker-controlled domains or endpoints.
- Vehicle identities, certificates or authorization records may have been bound to Fisker’s systems.
- Third-party software, hosting or connectivity licenses may not have been transferable.
- Fisker may not have had the staff, documentation, source code or credentials needed to recreate the service.
- Moving only American Lease’s cars could have created data-protection, security or liability problems for the rest of the fleet.
“Could not be ported” should therefore be read as Fisker’s position about a practical technical migration, not proof that a server copy was mathematically impossible.

Which Ocean functions were at risk?

InsideEVs and Ars Technica described the central distinction: a disconnected Ocean was not necessarily undriveable, but its connected features could be lost or degraded.
Why the problem was serious for American Lease
For a private owner, a failed app is inconvenient. For a commercial fleet, the backend is part of the operating system. American Lease needed centralized vehicle management, driver and account administration, remote diagnostics, service coordination and predictable control over data and commands. It had already committed most of the purchase price when it learned that it could not simply establish an independent server environment.

The timing mattered because the disclosure arrived immediately before the bankruptcy-court hearing. The buyer’s objection was an attempt to prevent approval of a transaction whose software-support assumptions had changed after substantial payment and delivery.
The sale was resolved, not canceled
The “cannot be ported” announcement was not the final outcome. In a last-minute agreement, American Lease agreed to pay an additional $2.5 million over five years to obtain control of the cloud services supporting the purchased vehicles. That arrangement preserved access to the necessary infrastructure without establishing that Fisker rebuilt or cleanly migrated its original software stack.
The agreement also contemplated access to relevant data and support services for the Fisker Owners Association, extending the solution beyond American Lease’s fleet. The U.S. Bankruptcy Court approved Fisker’s liquidation plan on October 16, 2024; the plan became effective on October 17, 2024. Five years is a defined support term, not a promise of lifetime service. The public record also does not establish that every feature, country or vehicle received identical coverage.

- The precise architecture that prevented or complicated migration.
- Whether the original infrastructure was transferred, licensed, or merely kept running under an agreement.
- Which individual services were guaranteed for the entire five-year period.
- What happens after that arrangement expires.
- Whether Oceans sold outside the United States and Canada received equivalent support.
Fisker’s response to the buyer is available in docket No. 670, but the public filings do not provide the detailed engineering documentation needed to answer all of those questions.
Checklist for someone considering a used Fisker Ocean
Price, battery condition and driving range are only part of the risk. Before buying, verify each item in writing where possible:

- Connectivity: confirm that the car currently reaches the relevant backend and that the smartphone app can be paired.
- Software: record the installed software version and ask whether over-the-air updates are still available.
- Account transfer: obtain the current procedure for removing the previous owner and registering the vehicle to you.
- Service coverage: identify a service provider in your region that can diagnose an Ocean and perform required work.
- Recalls and parts: check recall completion, outstanding campaigns, parts availability and who pays for labor.
- Support term: ask who operates the connected services, what agreement governs them and when that support could end.
- Records and title: obtain a clear title, complete service history and documentation of repairs or battery work.
An unusually low price may compensate for software-support and parts-availability risk; it is not automatically a bargain. Regional service conditions can differ, so a blanket “never buy one” conclusion is less useful than verifying the specific car and local support.
What existing owners should separate
Owners should treat these as different questions:
- Basic drivability: whether the vehicle starts, charges and can be driven.
- Convenience connectivity: app access, remote commands and status information.
- Software maintenance: over-the-air updates and security fixes.
- Diagnostics: cloud-assisted fault reporting and technician access.
- Safety and recalls: parts, labor and regulatory obligations, which are not guaranteed merely because a server remains online.
A cloud-services agreement can preserve selected functions for a period without guaranteeing permanent support or solving every repair problem.
The broader connected-car lesson
The Fisker episode shows that owning the physical vehicle does not necessarily mean controlling the software services that give it modern features. A company’s bankruptcy can threaten updates, diagnostics, account management and remote commands even when another company is willing to keep thousands of cars in service.
Cloud continuity can depend on identities, encryption keys, contracts, licenses, cellular links, data rights, privacy safeguards and personnel—not just storage capacity. Architectures differ among automakers, so this case does not prove that every connected car would fail in the same way. It does show why long-term ownership decisions should include a question that a traditional used-car inspection may miss: who operates the backend, and what happens if that operator disappears?
