The final enacted text and the law’s start date have not been confirmed in the available official record, so passage should not be taken to mean that needle-and-syringe services are already operating.
What does Fiji’s reported needle-exchange law allow?
According to The Fiji Times, the HIV/AIDS (Amendment) Bill 2026 gives authorized health workers and outreach teams legal protection for distributing and handling sterile needles and syringes in HIV harm-reduction programmes. The report identifies the measure as a targeted protection for programme activity, not a general change to drug law.
Health Minister Ratu Atonio Lalabalavu said, “This Bill does not legalise illicit drugs,” The Fiji Times reported. The newspaper also says the bill does not authorize trafficking, supply, manufacture, cultivation, importation or exportation, and does not create a general exemption from criminal law. Those descriptions reflect the minister’s reported explanation and the newspaper’s account; they should not be treated as a substitute for the final statutory text.
Has the bill become law, and are services available?
The Fiji Times reported that Parliament passed the bill on 2 October 2026. The Parliament of Fiji’s bill index lists it as Bill No. 36 of 2026, but that listing alone does not establish passage, assent, gazettal, commencement or the exact final wording. The available information therefore supports describing parliamentary passage as reported, not confirming that the measure is in force.

Nor does passage establish that a service has opened. Authorized providers, service locations, eligibility rules, distribution arrangements and safe-disposal procedures have not been established in the available reporting. The bill’s reported intent and the practical availability of needle-and-syringe programmes are separate questions.
Why is Fiji taking this step?
UNAIDS said Fiji declared HIV a national crisis in September 2026. Its 2026 release estimates that 9,100 people were living with HIV in Fiji in 2025; it says 39% knew their HIV status and 22% were accessing antiretroviral treatment that year. UNAIDS also reports that new infections rose 12-fold between 2010 and 2025. These figures describe a severe public-health challenge alongside major gaps in diagnosis and treatment.

Injecting drug use is a significant part of the picture, but it is not the only reported route. In UNAIDS’ figures for cases with a known mode of transmission, more than half were linked to sexual transmission and more than 42% to injecting drug use. The “known mode” qualification matters: those percentages should not be generalized to every person living with HIV in Fiji.
Earlier figures illustrate why dates and estimates should not be mixed. In its 2025 reporting, UNAIDS put the number of people living with HIV at fewer than 500 in 2014 and estimated 5,900 in 2024, with an uncertainty range of 4,500–8,900. That 2024 estimate is not interchangeable with the later UNAIDS estimate of 9,100 for 2025. The 2025 report also said the HIV outbreak had been declared in January 2025 and that harm-reduction programmes were not then available, despite agreement in principle on a needle-and-syringe programme.

How does needle-and-syringe programming fit into Fiji’s wider response?
The programme is one component of a broader effort, not a standalone solution. WHO says Fiji endorsed its HIV Surge Strategy 2024–2027 and later launched a National HIV Outbreak Response Plan. UNAIDS described measures announced in September 2026 that include wider prevention, testing and treatment; broader access to pre-exposure prophylaxis (PrEP), including long-acting options; community engagement; and action against stigma and discrimination.
Sterile-needle access is aimed at reducing risks associated with injecting, while testing and treatment address other parts of the epidemic. The available figures also show why prevention cannot be limited to injecting-related measures: sexual transmission accounted for more than half of reported cases with a known transmission mode.

What is the policy timeline?
- 8 August 2025: In Parliament, Health Minister Lalabalavu said obtaining a needle and syringe without prescription was “probably illegal,” described syringe exchange as under consideration, and said the government hoped to pilot a programme at one health centre while working with police.
- 16 September 2026: UNAIDS welcomed Fiji’s national crisis declaration and said legislative amendments were expected to go before Parliament to introduce a needle-and-syringe programme.
