Employee Website Monitoring: Examples, Use Cases, and Safeguards

Employers can monitor work-related website and internet use by logging sites visited, application activity, or network events. More intrusive methods may record messages, keystrokes, screenshots, or webcam footage. The appropriate approach depends on a specific, legitimate purpose, what information is necessary to meet it, the applicable law, and clear notice to workers. A monitoring tool’s availability—or a business reason by itself—does not make every method lawful.

What employee website monitoring can include

“Website monitoring” can mean a limited record of which sites or services a work account accesses, or a much broader collection of activity across a device. Before choosing a method, distinguish the information it collects from the question the employer is trying to answer.

Messages, documents, keystrokes, or screenshots Content or detailed records of what a person types, views, or creates. These methods can expose substantially more personal information than site or network metadata. Assess purpose, necessity, transparency, legal basis, and risk. Webcam or other visual monitoring Images or footage, potentially including a person’s surroundings. Consider less intrusive ways to answer the underlying question. The ICO gives checking system login times and asking about discrepancies as an alternative to webcam images for checking start times. UK ICO guidance.

Why an employer might monitor internet use

Protecting company information

An employer may consider work-account or system monitoring to protect corporate information, support data security, or investigate suspicious activity. The purpose should be concrete: for example, examining a defined security concern, rather than collecting activity “just in case.” The UK Information Commissioner’s Office (ICO) says employers should identify a clear purpose and use monitoring that is necessary and proportionate to it. Applying an acceptable-use policy

Website or internet-use records may be considered when an employer has communicated rules for work internet access and has a specific reason to check compliance. A written policy does not, by itself, justify collecting every kind of activity data. The monitoring method and scope still need to fit the stated purpose. Addressing a performance question

Activity logs can show what happened in a particular system; they do not necessarily show all the work an employee completed. The ICO warns that a case-management report could be unfair if it fails to account for work done outside that system. Start with the performance question, check whether the proposed data answers it reliably, and consider a less intrusive measure before drawing conclusions about an individual.

Risks that change the monitoring decision

Activity data may be an incomplete proxy for work

Time in an application or a record of system activity is not automatically a complete or fair measure of productivity. Work may happen in other tools or outside the recorded system. The U.S. Government Accountability Office (GAO) reviewed 217 comments submitted by 211 stakeholders to the Office of Science and Technology Policy from May to June 2023; stakeholder views on workplace digital surveillance’s effects on productivity were mixed. Home and personal devices can expose private life

Monitoring at home can capture household members or details of private life, and workers are likely to expect more privacy in their homes. A policy designed for an office or employer-owned device should not automatically be extended to personal devices or a home setting. The UK ICO discusses these risks in its worker-monitoring guidance and guidance on particular monitoring methods.

More detailed capture raises greater privacy stakes

Capturing the contents of messages, keystrokes, screenshots, or webcam footage can reveal information beyond the website or work event relevant to the employer’s purpose. For each proposed data type, consider whether a more limited record would suffice, who will see the information, how it will be secured, and how long it is needed.

How to plan monitoring responsibly

  1. Define the aim. Write down the specific question, such as investigating a defined security concern or checking compliance with an internet-use policy. “Monitor just in case” is not an adequate purpose in ICO guidance.
  2. Look for a less intrusive way to answer it. Compare the proposed collection with narrower alternatives. For a question about start times, for example, the ICO describes checking system login times and asking workers to explain discrepancies instead of using webcam images.
  3. Limit and protect the information. Decide what data is necessary, who needs access, how it will be safeguarded, and how long it should be retained. Canada’s federal privacy commissioner calls for purpose limitation, need-to-know access, safeguards, and keeping information only as long as necessary. Provincial rules may also apply, so federal guidance is not a complete account of every province’s law. See Privacy in the Workplace.
  4. Assess legal requirements and risk before collection. Identify the applicable legal basis and whether a data protection impact assessment (DPIA) or equivalent assessment is required. The UK ICO says a DPIA must be completed before processing likely to cause high risk and recommends using one more broadly to plan monitoring and reduce risks. Requirements vary by jurisdiction.
  5. Tell workers what to expect. Explain what is monitored, why, how information will be used, and where to find the policy. UK employer guidance says workers must be made aware of monitoring and its reason; Canada’s federal privacy commissioner also emphasizes transparency and accessible policies.   6. Check whether the evidence supports the decision. Before using activity records to make decisions about a worker, consider what the records omit and whether the measure fairly answers the question. A single application’s logs may not capture work completed elsewhere.

When covert monitoring may be considered in the UK

UK government guidance describes a narrow example: an employer may monitor without workers’ knowledge where it suspects lawbreaking and advance notice would make detection difficult. The monitoring should be limited to a specific investigation and stop when that investigation ends. This is UK-specific guidance, not a general permission or a rule for other jurisdictions. How to evaluate a monitoring approach

There is no universally best tool or method supported by these sources. Evaluate the proposed approach against the purpose and its consequences, not simply by how much data it can collect.

  • Data collected: Is it site or network metadata, communications content, keystrokes, screenshots, or webcam footage?
  • Fit and necessity: Does the data answer the stated question, and could a less intrusive method do so?
  • Personal exposure: Could collection reach personal devices, private activity, a home, or household members?
  • Accuracy and completeness: What activity is missing, and is the data fair to use for the intended conclusion?
  • Governance: Who can access records, how are they protected and retained, and have workers received clear notice?

These comparison questions reflect the issues raised in UK ICO guidance and Canadian federal workplace-privacy guidance. Legal obligations depend on the applicable jurisdiction and circumstances; a software product cannot establish compliance by itself.

Jurisdiction matters

The sources here cover different jurisdictions and should not be combined into a single universal legal rule. The ICO and GOV.UK materials address the UK; the Canadian Office of the Privacy Commissioner discusses federal privacy guidance and notes that provincial rules can also apply; the GAO report summarizes stakeholder comments in the United States rather than setting legal requirements. The ICO notes that some related material may be under review following the Data (Use and Access) Act. Check the regulator or government guidance applicable to the place, workforce, and monitoring practice at issue before relying on a legal conclusion.
