A transactional email is defined by its purpose: it reports or facilitates a specific transaction, service, or account event, such as an order confirmation or password reset. A message does not become transactional simply because software triggered it or because it goes to an existing customer.
How marketing automation and transactional email differ
The key distinction is purpose, not the sending technology. A platform may automate both promotional campaigns and messages tied to account activity; the platform’s label for a feature does not determine how a message should be treated. The U.S. Federal Trade Commission (FTC) describes the limited categories that qualify as transactional or relationship messages under CAN-SPAM in its CAN-SPAM compliance guide.

| Question | Marketing automation | Transactional email |
|---|---|---|
| What is its main purpose? | Promote, educate, nurture, or re-engage an audience. | Facilitate or report a specific transaction, service, or account event. |
| What usually triggers it? | A campaign schedule, audience segment, or recipient behavior. | A recipient action or system event tied to that recipient. |
| Who usually receives it? | A selected group or campaign list. | Often one recipient for each event. |
| Examples | Newsletter, product announcement, promotional sequence. | Receipt, password reset, reservation confirmation, account or security notice. |
| What needs operational attention? | Consent and list management, segmentation, unsubscribe controls, and campaign analytics. | Reliable event integration, correct recipient and event data, and timely sending. |
| What is the important qualification? | Calling a campaign “automated” does not make it transactional. | Calling a message “transactional” does not make it so if its primary purpose is promotional. |
This is a practical comparison, not a complete legal test. For examples of the overlap between the two categories, see Twilio’s comparison of marketing and transactional email.

CAN-SPAM uses a specific transactional-or-relationship category. The FTC says a message’s primary purpose can qualify when it fits defined categories, including facilitating or confirming a transaction the recipient agreed to; communicating certain warranty, recall, safety, or security information; providing notices about changes to an ongoing account or subscription; or delivering goods or services agreed to in a transaction. The categories also cover certain account statements and employment-related information. An existing customer relationship, on its own, does not make every email transactional.

Mixed content needs particular care. The FTC says that if a message combines commercial and transactional or relationship content, a subject line that would lead the recipient to think the message is commercial makes it commercial for CAN-SPAM purposes. A receipt or account notice is not automatically exempt from commercial-message requirements just because it contains necessary account information. Keep the service purpose clear and assess the message’s primary purpose against the FTC’s CAN-SPAM guidance. This is U.S. guidance and should not be treated as the legal test everywhere.
Is an automated email transactional?
Not necessarily. Automation describes how or when a message is sent; transactional describes why it is sent. A welcome series, abandoned-cart reminder, or scheduled product announcement may be automated but promotional. A password reset may be sent automatically but is tied to an account event. Classify each message by its content and primary purpose rather than by its trigger, software, recipient status, or internal campaign name.

Do transactional emails need an unsubscribe link?
Requirements depend on the message and the rules that apply. For Gmail, Google’s subscription guidance calls for one-click unsubscribe on subscription messages and recommends confirming that recipients control the address before sending subscription mail. Google says subscription opt-outs should be honored within 48 hours and recommends using different email addresses for subscription and non-subscription mail. Its FAQ says one-click unsubscribe applies to marketing and promotional messages, while examples such as password resets and reservation confirmations are excluded. These are Gmail sender practices, not a replacement for applicable law: see Google’s subscription guidelines and sender FAQ.
In the European Union, the European Commission’s GDPR guidance says that consent should be withdrawable and that withdrawing consent should be as easy as giving it; it gives a visible newsletter unsubscribe link as an example. Email marketing can also be affected by ePrivacy rules and national implementation. The Commission’s guidance on legal grounds for processing data supports the consent-withdrawal point, not a complete legal analysis for every country.

Should marketing and transactional emails use separate addresses?
For Gmail senders, Google recommends different email addresses for subscription and non-subscription traffic. That operational separation can make the two kinds of mail easier to manage, but an address choice does not decide a message’s legal classification, establish consent, or guarantee delivery. Keep the message purpose clear and apply the relevant rules to each stream.

Google’s current sender guidelines state that senders to personal Gmail accounts need SPF or DKIM authentication. For senders sending more than 5,000 messages per day to Gmail accounts, Google lists SPF, DKIM, DMARC, domain alignment, and one-click unsubscribe for marketing and subscribed messages. These are Google requirements for mail sent to Gmail accounts, not universal legal rules or a promise of inbox placement. Google’s FAQ says enforcement against non-compliant traffic has been ramping up since November 2025. Because provider policies can change, check the current Google sender guidelines and FAQ when configuring a production sender.
Setup varies by service. Mailchimp Transactional documents domain verification and DKIM and DMARC configuration for its service in its authentication and delivery documentation. HubSpot explains how to connect a sending domain and configure DNS authentication in its email authentication overview. These are vendor-specific instructions, not guarantees that another platform has the same prerequisites.
Quick Recap

A practical way to classify and manage each email
- Write down the immediate reason for the message. Identify the transaction, service, or account event it reports or facilitates, or the promotional or educational goal it serves.
- Check the actual content and subject line. If the message mixes service information with promotion, review its primary purpose rather than assuming the service element controls its status. For U.S. CAN-SPAM purposes, the subject line can affect the analysis of mixed content.
- Apply the relevant rules separately. Distinguish legal obligations in the recipient’s jurisdiction from Gmail’s subscription, unsubscribe, and authentication requirements.
- Configure the sending workflow for its job. Marketing flows need appropriate audience, consent or list controls, segmentation, and unsubscribe handling. Transactional flows need dependable event triggers, correct recipient and event data, and timely delivery.
- Configure and verify the domain for the destination and volume. Follow the current requirements of the mailbox provider and the instructions for the specific sending service; do not treat authentication setup as a substitute for consent or correct classification.
