First check whether the shipment required an e-way bill, whether transport details were complete, and what happened during transit. In India, section 129 of the Central Goods and Services Tax (CGST) Act provides for detention or seizure and statutory release routes when goods are moved contrary to the Act or rules; confiscation under section 130 has separate grounds and is not automatic.
Expired vs. not generated: what is the difference?
| Situation | Meaning | What to verify |
|---|---|---|
| Expired | An e-way bill was generated, but its validity ended before the relevant stage of movement. | Generation and expiry times, distance entered, any applicable extension or notification, movement timing, vehicle details, and records explaining delays. |
| Not generated | No e-way bill was created before movement, although the movement may have required one. | Whether Rule 138 applied or an exception covered the movement, consignment facts, who was responsible for generation, transporter role, and invoice or delivery challan. |
The key questions are whether the movement was covered, whether the bill was valid during movement, whether required transport details were supplied, and whether an officer issued a detention notice or order. The consequences turn on those facts and the applicable law, not simply on which label describes the problem.

What happens if an e-way bill expires during transit?
If the shipment required a valid e-way bill and it expires while goods are in transit, the movement may be treated as contrary to the CGST Act or rules. Section 129 allows the goods and the conveyance used to carry them to be detained or seized in such a case. The authority must follow the statutory process; the expired status alone does not establish a fixed amount payable or automatic confiscation.

CBIC’s e-way bill rules set standard validity by distance, with time running from the bill’s generation time. The periods listed by CBIC are:
#1 Best Overall
- Two-Part Carbonless Invoice Book: Each invoice book has 50 sets of invoices, each with a white/light yellow section, with the yellow section retained in the invoice book to maintain detailed records.
- Consecutively Numbered: Enlarged red 6-digit numbers in the upper right corner of each invoice receipt book help you quickly navigate through your orders.
- Wraparound Divider Flap: A thick folded cardboard divider is integrated into the back of each invoice book for use between each two-part sales order to prevent the written content from rubbing off on subsequent copies of the invoice, resulting in wasted invoices.
- 2 Packs/50 Sets (100 Sets Total): Each invoice book provides 50 sequentially numbered carbonless sets of 2 invoice books for long-term use.
- Customizable Space: Each invoice book for small business has space at the top to add a company seal or sticker.
| Distance | Standard validity |
|---|---|
| Less than 100 km | One day |
| 100 km or more but less than 300 km | Three days |
| 300 km or more but less than 500 km | Five days |
| 500 km or more but less than 1,000 km | Ten days |
| 1,000 km or more | Fifteen days |
Check the live bill and current applicable rules or notifications rather than relying on a manual calculation: the entered distance, generation time, transport details, and any notification for a specified category can affect the position. The road e-way bill is generally not valid for movement unless Part B has been furnished, subject to stated exceptions.
What is the penalty for not generating an e-way bill?
There is no single penalty figure that can safely be applied to every missing-bill case. First establish that Rule 138 required a bill for the particular goods movement and that no exception applied. Then consider the circumstances under section 129, including whether the owner comes forward, whether the goods are exempt, the tax and value involved, and the terms of the officer’s notice or order.

Section 129 provides statutory payment or security routes for release. It requires an order of detention or seizure to be served on the person transporting the goods, and provides for notice, determination and an opportunity to be heard. The provision also addresses further proceedings if the amount determined is not paid within seven days, with a proviso concerning perishable or hazardous goods or goods likely to depreciate. Because the calculation depends on the statutory route and the facts, do not assume a number without checking the current text and the actual order.
Can goods be stopped if the e-way bill has expired?
Yes. Under section 129, goods and the conveyance used to carry them may be detained or seized when goods are transported or stored in transit contrary to the Act or rules. The provision states: “Provided that no such goods or conveyance shall be detained or seized without serving an order of detention or seizure on the person transporting the goods.” If an officer stops the shipment, obtain and read the written record rather than treating a verbal explanation or a portal status as the full decision.

Confiscation is a separate matter under section 130. It has its own statutory grounds, including specified contraventions involving intent to evade tax, and the Act provides an opportunity of hearing before a confiscation or penalty order. An expired or missing e-way bill does not, by itself, make confiscation automatic.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Can an expired e-way bill be extended?
CBIC’s rules recognize validity extensions by notification for specified categories. That does not establish a general right to revive every bill after it has expired. Check the live portal and the current rule or notification for the particular shipment; do not assume that creating a fresh bill retrospectively removes a lapse that already occurred.

What to do if a bill is expired or missing
- Pause and verify the shipment. If practicable, avoid continuing movement until the responsible person or transporter checks the live record and applicable requirement. Confirm the e-way bill number, generation and expiry times, distance, vehicle number, Part B details, route, and current portal status.
- Check whether an e-way bill was required. Review the goods, consignment value, movement purpose and geography against current central and state rules, notifications, and exceptions. Rule 138 sets the general framework, but exceptions and applicable state details matter.
- Preserve documents and the timeline. Keep the invoice or delivery challan, e-way bill, transporter communications, vehicle records, route details, and evidence of delays or portal/network errors. These records help establish what happened; their existence does not by itself guarantee that a lapse is excused.
- If the goods are detained, obtain the written order and notice. Record the officer, location, time, and documents requested. Section 129 requires service of an order and describes notice, determination, hearing, payment, and security routes. Follow the actual notice and promptly consult a GST professional if the amount or business impact is significant.
- Check current law for the dispute. Confirm the relevant current consolidated statutory text, notifications and state rules, and the current portal procedure. The CBIC-hosted rules compilation is from 2020/2021, so a live dispute should not be decided from that compilation alone.
