There is no single U.S. rule or contract that makes data centers pay for every power plant and grid upgrade they require. A customer may fund generation or storage built for its load and accept minimum bills, collateral, or early-exit payments, while transmission or distribution upgrades may be allocated separately under utility tariffs and state or federal regulatory rules. The contract, the asset being built, and the jurisdiction determine who pays.
Which costs are being paid for?
“Power plant costs” and “grid upgrade costs” are not one bill. A data center may pay for new generation or battery storage procured to serve it, while transmission and local distribution work follows separate agreements, tariffs, and regulatory decisions. Retail energy, generation capacity, transmission service, local interconnection, and a generator’s own interconnection are distinct cost categories.

The U.S. Department of Energy’s January 2025 technical brief identifies fair cost allocation, stranded-investment risk, resource adequacy, and large users’ supply preferences—including carbon-free matching and onsite generation—as central large-load rate-design questions. A renewable-energy purchase or matching claim by itself does not establish who pays for the wires, local upgrades, or reliability resources.

Two cases show why contract terms matter
The Michigan and ComEd examples illustrate different parts of the cost question. The Michigan case is a state-approved retail utility supply arrangement with explicit customer commitments for new resources. The ComEd example, as described in a FERC commissioner’s concurrence, concerns transmission payments and the treatment of certain upgrades.

|---|---|---|
| Regulatory context | On October 1, 2026, the Michigan Public Service Commission conditionally approved a Primary Supply Agreement and a Clean Capacity Accelerator Agreement for a planned data center in Van Buren Township. | In a February 17, 2026 concurrence, FERC Commissioner Chang described the agreement’s transmission-payment terms and raised a concern about how certain upgrades could be funded. |
| New generation or storage | DTE is to develop, own, and operate the new clean resources, and Google pays for them under the agreement: up to 1,600 MW of renewable energy and 480 MW of battery storage. | The concurrence does not describe a comparable customer-funded generation or storage package. |
| Payment commitment | The agreement runs for 20 years and sets an 80% minimum billing demand: Google owes at least 80% of contracted electric use even if actual use is lower. The MPSC contrasted this term with five years under DTE’s general large-load D11 rate. | As Chang described it, the data center pays a load-ratio share of ComEd’s transmission revenue requirement. Payments scale with a ramp schedule tied to power use and continue if the facility is delayed or canceled. |
| Exit and financial protection | If Google cancels early, it ultimately must pay at least 15 years of minimum monthly charges. Credit and collateral requirements cover costs if it stops operating sooner than planned. | The concurrence describes payments that continue through delay or cancellation, but does not establish a comparable 15-year minimum-charge obligation or the same credit and collateral terms. |
| Upgrade allocation | The MPSC specified no cap on Google’s payment for necessary electric infrastructure upgrades in this case. It also directed DTE to propose a cost allocation and rate design so future large-load interconnection customers pay the full costs associated with interconnection. | The concurrence says the agreement does not identify specific interconnection upgrades and contemplates that upgrades triggered by the large load could be added to ComEd’s transmission revenue requirement, with costs shared among transmission customers. |
These are case-specific arrangements, not a national template. The Michigan commission said it would monitor cost outcomes and could reopen the matter if claimed affordability benefits did not occur or costs risked passing to existing customers. The ComEd upgrade concern is Commissioner Chang’s account and assessment of that agreement, not a nationwide rule or a Commission-wide holding about every upgrade.
What contract protections can limit cost shifting?
When a utility commits capital before a large facility reaches full operation, the risk is that the facility ramps more slowly than expected, uses less electricity, or closes before the investment is recovered. Contract protections can make the customer responsible for more of that risk, but the wording and covered costs matter.

Statistics of power usage in now/day/week/month/year format: the validity period of hourly exported data is 90 days, and the exported data of day/month/year data is permanent, available at any time Export from application.
- Minimum billing demand or minimum bills: require payment for a stated minimum level of contracted service even when actual consumption is lower.
- Longer contract terms and early-termination payments: can give the utility time to recover investment and address unpaid costs if the customer exits early.
- Credit support and collateral: provide financial security against default or early closure.
- Delay and cancellation provisions: determine whether payments continue if construction is postponed or abandoned.
- Explicit upgrade allocation: identifies which transmission, distribution, or interconnection work is customer-specific and how its cost is assigned.
A commitment to pay for a resource or to make transmission payments does not, on its own, answer who pays for every network upgrade. In particular, the ComEd concurrence describes a load-linked payment commitment alongside a possibility that some triggered transmission upgrades could be shared across transmission customers.

Authority is divided. State commissions generally oversee retail utility rates and service terms. FERC addresses interstate transmission and regional grid-operator tariffs. In June 2026, FERC issued orders directing six jurisdictional regional transmission organizations and independent system operators, along with transmission owners, to justify or reform their treatment of large loads. The result is an active, region-specific tariff debate, not a uniform national answer for data centers.

Two other federal rules provide relevant context but do not decide a data center’s load-service bill:
- FERC Order No. 1920: establishes long-term regional transmission planning requirements and a process for proposing how selected regional facilities are paid for. Its fact sheet describes a benefit-based principle, state engagement, default cost-allocation proposals, and a possible state agreement process. How it applies depends on compliance filings and later orders.
- FERC Order No. 2023: reforms studies for generators seeking interconnection, including cluster studies and proportional-impact allocation of certain network-upgrade costs among generation interconnection customers. Those rules concern power plants entering the generator queue; they are not a general formula for assigning upgrades needed to serve a data center’s load.
How to evaluate a data center power agreement
For a proposed project or a claim that a facility will “pay its way,” look beyond the headline contract price or clean-energy commitment. Ask what assets and charges the agreement actually covers:

- Identify the cost category: Is the payment for energy, generation capacity, transmission service, local distribution, a customer-specific interconnection, or a generator’s own interconnection?
- Check who funds new supply: Does the utility build and own generation or storage that the customer pays for, or does the customer procure resources directly?
- Find the minimum obligation: What must the customer pay during ramp-up or if its eventual use is lower than forecast?
- Read the delay and exit terms: Do charges continue through delay or cancellation, and what payment is due if the customer closes before the utility recovers its investment?
- Trace each grid upgrade: Are specific transmission and distribution upgrades identified? Does the customer pay their full cost, a defined share, or only a broader transmission charge?
- Check financial security and oversight: What collateral or credit support backs the promise, which regulator approved the terms, and can the regulator revisit the arrangement?
Without answers to those questions, neither “the data center pays for its power” nor “households will subsidize it” is a reliable conclusion. The cost allocation depends on the particular contract, applicable tariff, and regulator’s decisions.
