Before sending money to a crypto presale, verify the exact token contract, offering terms, people behind the project, and token supply and release schedule. Treat missing, contradictory, or unverifiable claims as unresolved—not as evidence that the offer is safe. A checklist can reveal information gaps; it cannot guarantee honesty, security, liquidity, or returns.
1. Identify the exact token and contract
Match the network and address
Ask which blockchain the token will use and obtain its exact contract address. Compare the address in the presale instructions with the address in the project’s primary documentation and the relevant public chain record. A mismatch, or an address that has not been published, leaves you without a reliable way to confirm which token the offer concerns.

Check the code and audit scope
Find out whether the blockchain is open and public, whether the token’s source code is published, and whether an independent cybersecurity audit exists. The SEC’s Investor Bulletin: Initial Coin Offerings recommends asking these questions. Locate the report yourself, check who performed it, and read what code and components it covers. Confirm that the audited code corresponds to the contract being offered; a project logo or the word “audited” does not establish that. An audit is evidence of a review, not a guarantee that a contract is safe or free of vulnerabilities.

2. Verify the offer and the people behind it
Read the terms before paying
Look for a clear business plan, roadmap, explanation of the token’s rights, and account of how presale funds will be used. Check the actual terms for refunds, resale, and transfer restrictions. Do not infer that you can get your money back or sell tokens freely unless the terms say so.

Check principals and affiliated entities independently
Investigate named founders, advisers, and associated organizations using sources beyond project-controlled biographies. Where the project discloses a legal entity and jurisdiction, verify those details and corroborate claimed qualifications and prior work. Check professional registration where relevant. Both the SEC and CFTC advise investigating people and entities associated with an offering: see the SEC’s ICO bulletin and the CFTC’s digital coin and token advisory.
Do not rely on a marketing label to settle legal status
Calling an asset a “utility token” or using another label does not, by itself, determine how it is treated under U.S. securities laws. The SEC’s April 22, 2026 explainer describes an investment-contract analysis that considers an investment of money in a common enterprise, a reasonable expectation of profits, and profits derived from the essential managerial efforts of others. Application depends on the facts and circumstances. Consult the SEC’s crypto-asset transactions explainer and its FAQs, updated September 28, 2026, for current U.S. guidance; legal treatment varies by jurisdiction, and this is not a legal opinion.

3. Reconcile the tokenomics
Understand total supply and issuance powers
Find the stated total supply and how tokens are created or removed. Ask who can mint additional tokens, under what conditions, and whether tokens can be burned. A stated supply cap or burn mechanism is not evidence that a token will appreciate; first establish what the code and offering terms actually permit.

Look for allocations to the presale, team, advisers, private-sale buyers, treasury, ecosystem, and community. Reconcile the allocation figures with the amount offered in the presale and the stated use of proceeds. Note any category that is missing, unexplained, or difficult to reconcile. The SEC Crypto Task Force recommendations identify offering mechanics, allocations, use of proceeds, total supply, mint and burn mechanics, and insider holdings as disclosures relevant to understanding an offering. Commissioner Hester M. Peirce’s August 15, 2025 recommendations are recommendations, not a binding checklist or legal rule.

Map every vesting and unlock schedule
For each allocation, record when vesting starts, whether there is a cliff, how often tokens are released, how long releases continue, and what happens if project milestones are delayed. Work out how many tokens could become transferable at each release point and how concentrated the unlocked supply may be among insiders or other holders. “Vested” does not necessarily mean locked: check the actual transfer restrictions and release terms.
Separate live utility from promises
Identify what the token lets a holder do now, what rights it confers, and which features remain planned. Ask what non-speculative demand or usage could exist and whether the stated roadmap supports it. Future demand, competitors, technology changes, liquidity, adoption, and hacking can all affect value, according to the CFTC advisory. A roadmap is a plan, not proof of delivery or future demand.

4. Treat promotion tactics as warning signs to investigate
Watch for pressure and unsupported return claims
Guaranteed or outsized returns, countdowns or pressure to buy immediately, jargon that obscures what the product does, unverifiable principals, and promotion that depends heavily on social media all warrant scrutiny. In a May 29, 2024 alert, the SEC described promoters attracting buyers with a crypto token and selling while interest is high, leaving later buyers exposed to a rapid decline. The SEC warns: “Never make investment decisions based solely on information from social media platforms or apps.” Read its alert on crypto-asset securities scams.
Verify identities and communications through independent channels
Find official websites, social accounts, audit reports, and regulator contact details independently rather than relying on links in a message or promotion. A polished website, apparent endorsement, small early withdrawal, or claimed government connection does not verify an offering. The SEC alert describes impersonation, fake websites, and fabricated profits as ways fraudsters build trust.

Do not pay an extra fee to release supposed funds
A request for an additional tax or fee before you can withdraw purported profits or funds matches an advance-fee scam pattern identified by the SEC. Verify any claimed obligation through an independently located, authoritative source; do not treat payment as proof that the original offer was legitimate.
5. Decide what to do with unresolved claims
Before making any decision, be able to explain in your own words which contract is being offered, what rights the token gives you, how supply can change, and when different holders may be able to transfer tokens. If you cannot independently verify a core claim, find contradictory information, or are being rushed, pausing and seeking qualified advice is more prudent than filling the gap with assumptions.
No checklist can establish that a presale is honest, that a contract has no vulnerability, that a market will be liquid, or that funds lost to fraud or theft can be recovered. The CFTC describes buying solely in the hope of selling later at a higher price as speculation and highlights risks including liquidity, demand, technology changes, and theft in its customer advisory. The SEC also warns that recovery after fraud or theft may be limited in its ICO bulletin. This is general educational information, not investment or legal advice.
