Congress has restricted some NASA-related cooperation with China, but “bars NASA from working with China” overstates what the rule says. The restriction is principally about how specified federal funds may be used for bilateral activity—not a ban on every conversation between NASA-affiliated people and Chinese researchers. Whether the policy is a mistake depends on whether its security and compliance benefits justify the scientific access it limits.
What the restriction covers
The provision commonly called the Wolf Amendment originated in 2011. A later version, Section 310 in the September 23, 2024 Congressional Record, restricts use of funds authorized by that act by NASA, the Office of Science and Technology Policy, or the National Space Council to develop, plan, implement, or execute specified bilateral activity with China or a Chinese-owned company. It also restricts using those funds to host official Chinese visitors at NASA facilities.

The provision describes an exception for activity specifically authorized by a later law and includes a certification procedure. Its legal object is therefore covered federal funding and defined bilateral activity, rather than all contact between every NASA-affiliated person and every Chinese national. The precise scope depends on the statutory terms and applicable appropriations law.

NASA’s current Science FAQ for ROSES explains how the agency applies the restrictions. It says bilateral participation, collaboration, or coordination can be covered even when no funds are exchanged. That matters: an arrangement does not fall outside the restriction simply because researchers pay their own way or no money changes hands.

What NASA says can still happen
General scientific discussion
NASA’s FAQ says: “General scientific discussions do not constitute a bilateral policy, program, order, or contract and thus are permitted. However, these discussions must not involve discussions of bilateral collaboration between NASA and Chinese entities.” In practical terms, discussing a scientific question is distinct from agreeing to conduct a NASA-China project.
Publicly available data
NASA says researchers may use publicly available Chinese data when they can obtain it without an agreement with a Chinese organization. The relevant distinction is not simply who produced the data; it is whether access requires a covered bilateral arrangement.

Past work and multilateral projects
The FAQ addresses co-authorship of papers describing earlier work conducted with Chinese-institution investigators when no restriction applied at the time. It also recognizes that some activity can be genuinely multilateral rather than bilateral. Neither point makes every paper or international project automatically permissible: a project’s actual participants, arrangements, and relationship to NASA funding matter. A third-country participant does not by itself establish that an activity is meaningfully multilateral.

Chang’e-5 shows what scientific access can be at stake
Chang’e-5 returned lunar samples that NASA’s Planetary Science Advisory Committee described as a young mare basalt from a site unlike earlier sample-collection locations. The committee said the material could help change understanding of lunar volcanic and impact history. This is a concrete example of why access to unique samples can matter; the available sources do not quantify the total scientific opportunity cost of the restrictions.

In November 2023, NASA Administrator Bill Nelson certified to Congress NASA’s intent to let NASA-funded researchers apply to China’s space agency, CNSA, for access to Chang’e-5 samples. NASA’s May 2024 planetary science town hall described this as a limited exemption and said there had been no change to the funding restrictions. The pathway allowed applications; it did not give NASA control over sample distribution, repeal the restriction, or open routine bilateral cooperation.
The security and compliance case
There is a serious argument for restricting some cooperation: research involving sensitive information or technology can create risks, and an agency must be able to identify and enforce the boundaries of permitted work. The House Select Committee on China’s May 2026 report release raised concerns about NASA’s monitoring and enforcement, institutional disclosure, and identification of activity under NASA-funded awards.

The committee characterized certain publications as potentially involving prohibited collaboration. That is an allegation of potential violations in a committee report, not proof that the publications violated the law. Its concerns nevertheless point to a real implementation question: NASA and recipient institutions must be able to distinguish allowed scientific exchange from covered bilateral activity, including in arrangements with no exchange of funds.
Legislative activity should also be separated from law in force. H.R. 4360 is an introduced bill containing proposed restriction language, and the House Science Committee reported a markup of the NASA Reauthorization Act of 2026. Those developments alone do not establish that either proposal became law. The 2024 statutory text and NASA’s guidance provide the sources for describing the rule here; the available material does not establish the final enactment status of every 2026 bill or the full FY2026 appropriations text.

How to judge whether the restriction is worth keeping
The headline’s “likely a mistake” is a defensible policy argument, not a conclusion established by the evidence. A sound judgment turns on four practical questions:
- Scientific access: Which samples, observations, expertise, or data are actually unavailable or delayed? Chang’e-5 illustrates a possible cost, but does not measure the policy’s overall effect.
- Security: What sensitive information or capabilities could be transferred through a particular activity, and what safeguards would reduce that risk? The House committee emphasizes this concern, but its report release is not an independent audit establishing every alleged failure.
- Enforceability: Can NASA and institutions reliably identify covered work across funded projects, subrecipients, and no-funds arrangements? Broad rules may be harder to administer consistently; weak monitoring could leave genuine risks unaddressed.
- Multilateral substance: Does each participant make a real contribution, or does a nominally international project function as bilateral cooperation? Drawing that line is more useful than treating either all international research as permissible or every contact as prohibited.
A narrower, well-monitored policy could preserve legitimate scientific access while limiting sensitive transfers, but the sources cited here do not establish that such a policy would be easier to enforce or safer in practice. Conversely, a broad restriction may simplify some boundaries while blocking beneficial work that presents little security risk. Congress and NASA should evaluate the rule against specific risks, scientific losses, and enforcement capacity—not treat the slogan “work with China” as though it described the law’s full reach.
