Congress has a strong case for investigating how wartime defense contracts are awarded and overseen—but the case should be built on evidence, not on an assumption that contractors as a group are conspiring to profit from war. The 1934–1936 Nye Munitions Committee offers a useful precedent for scrutiny, not proof of a modern conspiracy.
What was the Nye Committee?
The Nye Munitions Committee was a U.S. Senate special committee chaired by North Dakota Senator Gerald P. Nye. Its remit was to investigate the manufacture and sale of munitions and the economic circumstances surrounding U.S. entry into World War I. The Senate dates its hearings from September 1934 to February 1936.
The inquiry grew amid reports that arms makers had unduly influenced the decision to enter the war. At the opening, Nye framed the investigation around the concern that war and preparation for war might serve private profit rather than national defense. That concern was a rationale for investigating, not a finding the committee could simply presume.
What did the Nye Committee find—and what did it accomplish?
The Senate Historical Office says the committee held 93 hearings and questioned more than 200 witnesses. Its retrospective also makes an important distinction: the investigation found little hard evidence of an active conspiracy among arms makers. Public suspicion of munitions interests remained strong, but suspicion and proof were not the same thing.

The committee did not nationalize the arms industry. The Senate Historical Office says its work helped inspire three neutrality acts, while its funding was cut after Nye criticized Woodrow Wilson. The episode shows both why congressional inquiry can shape policy and why an investigation’s reach depends on political support.
What later congressional precedent is there?
In 1941, the Senate created the Truman Committee to investigate the National Defense Program. It examined defense contracts and, according to the Senate, uncovered waste, corruption, and fraud. The contrast with the Nye inquiry is instructive: investigations can expose specific failures without proving that every contractor, contract, or wartime expenditure is improper.

What does a documented modern case establish?
In October 2024, the U.S. Department of Justice announced that Raytheon would pay over $950 million to resolve investigations involving defective pricing, foreign bribery, and export-control schemes. That is a substantial, officially documented enforcement action involving a defense contractor. The figure and description are DOJ’s account of the resolution; they do not, by themselves, establish generalized “war profiteering” across the defense industry.
That distinction matters. “War profiteering” can describe a political concern about private gain from conflict, but an investigation should test specific questions: whether prices were properly disclosed, whether contract terms were followed, whether prohibited payments or exports occurred, and whether public controls worked. A single enforcement case can justify scrutiny of relevant practices; it cannot substitute for evidence about other firms or the industry as a whole.

Should Congress open a new investigation?
Yes, if it defines a verifiable oversight problem and gives investigators the means to examine it. The historical record and the DOJ case support the value of scrutiny; neither independently establishes the current scale of improper profits or proves that a new inquiry is warranted on every claim advanced in contemporary commentary.
Hank Kennedy’s May 25, 2026 article argues for a new inquiry and makes claims about a proposed defense-budget increase, Iran war costs, missile and drone prices, and taxpayer spending. Those figures are not independently corroborated by the cited Senate and DOJ sources, so they should be treated as claims in Kennedy’s argument rather than established findings here. A congressional inquiry should verify such figures against underlying budget, contract, and military records before using them to support conclusions.

What would make an inquiry credible?
A useful investigation would define its scope before announcing its verdict. Congress could examine procurement and wartime contracts, but it should state what time period, agencies, contractors, and types of conduct fall within the mandate. It should distinguish legal violations from waste, poor value, policy choices, and ordinary profit—different findings that require different evidence and remedies.
- Clear mandate: Identify the contracts, decisions, and alleged practices under review rather than treating all defense spending as one case.
- Access to evidence: Secure relevant documents and testimony so investigators can compare contract terms, pricing disclosures, and performance with what was delivered.
- Independence and bipartisan support: Build procedures that make the inquiry credible beyond its sponsors and reduce the risk that findings are shaped to fit a political conclusion.
- Defined referral authority: Specify how evidence of possible legal violations will be referred to the appropriate authorities.
- Transparent findings: Publish methods, substantiated findings, and limits, while protecting information that cannot responsibly be made public.
- Actionable recommendations: Connect documented problems to specific oversight or statutory changes and explain how Congress would assess whether those changes work.
Those tests would make an inquiry more than a slogan. They would also honor the most useful lesson of the Nye Committee: investigate claims about private influence and public spending, but let evidence—not suspicion—determine what the investigation proves.
