A federal court ruled on September 29, 2026, that Continental Casualty Company (CNA) must provide insurance coverage to Guidehouse Inc. for its defense and its settlement of allegations tied to New York’s pandemic-era rental assistance program. The coverage is subject to a $5 million policy retention; the ruling does not mean CNA must pay the full $7.6 million settlement. It is an insurance decision—not a new finding that Guidehouse committed fraud.
What the court decided
Judge Rossie D. Alston Jr. of the U.S. District Court for the Eastern District of Virginia granted Guidehouse’s motion for judgment on the pleadings and denied CNA’s cross-motion. The dispute concerned whether Guidehouse’s Enterprise Liability Policy covered costs arising from a U.S. Department of Justice matter, including defense costs and the settlement payment.
The policy covered October 15, 2022, through October 15, 2023, and had a $5 million retention. Contemporary coverage reports described CNA’s obligation as covering the settlement subject to that retention. The order should therefore not be read as requiring CNA to pay the entire gross settlement, or as establishing a simple net payment by subtracting the retention from the settlement amount.

The 2026 ruling addresses the insurance contract, not whether the underlying allegations were true. The settlement agreement did not include an admission that Guidehouse committed fraud or was liable.

What the allegations involved
New York created ERAP to provide federally funded rental assistance to people affected by the COVID-19 pandemic. The court’s account says the program’s online portal went live on June 1, 2021, and was shut down about twelve hours later after the state’s Office of Temporary and Disability Assistance determined that some applicants’ personally identifiable information had been exposed online.
The DOJ investigation concerned allegations under the False Claims Act about Guidehouse’s services for the program’s implementation. The settlement described allegations involving cybersecurity testing before launch, the information-security incident, and the use of unauthorized software. These were allegations resolved by settlement; they were not findings of liability in the later insurance ruling.

What Guidehouse agreed to pay—and what it did not admit
The May 13, 2024 settlement required Guidehouse to pay $7.6 million plus interest. The relator’s attorney fees were later set at $50,000. The court’s account says Guidehouse did not agree to fines, penalties, taxes, sanctions, or forfeitures, and the agreement did not contain an admission that it committed a dishonest, fraudulent, criminal, or malicious act or knowingly violated a contract.
In a June 17, 2024 public announcement, Guidehouse likewise said the settlement included no admission or acknowledgment of liability and stated that the company believed its conduct was lawful and appropriate. That is Guidehouse’s characterization of its position, not a finding by the court in the coverage case.

What happens next in the coverage action
The September 29 order dismissed Counterclaim Counts II and III and stayed the case while the parties pursue a settlement conference. They were directed to contact Magistrate Judge Ivan D. Davis within fourteen days to schedule the conference and to file a status report within fourteen days after it. The stay means the order did not itself establish that all proceedings had ended.
As of October 3, 2026, the available case information did not establish whether the conference occurred, whether the coverage dispute settled, whether the stay was lifted, or whether an appeal followed. The ruling is therefore best understood as a decision for Guidehouse on the pleadings, with the case still subject to the ordered next steps.
