Anthropic’s announced policy update goes further in one specific direction: it expressly bars sustained and needless abusive or cruel behavior toward its models. That Anthropic clause is scheduled to take effect on November 12, 2026; as of October 9, 2026, it had been announced but was not yet in force.
The comparison below is about published policy language and stated safeguards—not a test of how Claude or ChatGPT responds in every conversation, or proof that the providers enforce similar cases identically.

What do the policies prohibit?
OpenAI: threats and harassment involving people
OpenAI’s Usage Policies, effective October 29, 2025, say use of its services must follow the policies and prohibit “threats, intimidation, harassment, or defamation.” The same page also prohibits terrorism or violence, including hate-based violence, and malicious or abusive cyber activity. The cited policy frames the relevant rule around harmful conduct such as threats or harassment. It does not separately name cruelty directed at the model itself. That observation applies to this Usage Policies page; it should not be read as a claim about every OpenAI term, product response, or enforcement decision.

Anthropic: sustained cruelty directed at models
Anthropic’s revised Universal Usage Standards include a section titled “Do Not Engage in Cruel, Abusive, or Psychologically Harmful Conduct.” Its listed prohibited use is to “Engage in sustained and needless abusive or cruel behavior toward our models.” The policy covers Anthropic apps, developer platforms and APIs, access through cloud providers and resellers, and products that integrate Claude. What does Anthropic say is outside the new clause?
Anthropic says the model-directed abuse rule is not intended to cover ordinary user frustration, pushback, dark creative themes, or model testing and research. The distinction is the conduct’s sustained and needless nature, not simply whether a user criticizes Claude or uses harsh language in a legitimate context. Anthropic’s 2026 Usage Policy update
These stated boundaries describe the announced clause’s intended scope. They do not guarantee how every individual interaction will be classified.

How do the stated enforcement measures differ?
Anthropic: account controls and a rare conversation-ending safeguard
Anthropic says its Safeguards Team may warn a user or throttle, limit, suspend, or terminate access when it suspects a policy violation. It also distinguishes a real-time safeguard block from a policy violation: seeing a block alone does not establish that a user broke the policy. Anthropic Usage Policy
Anthropic has separately described a conversation-ending feature as a last resort in rare, extreme cases after repeated harmful requests or abuse and redirection attempts. Its August 15, 2025 explanation specifically identified Claude Opus 4 and Opus 4.1 in consumer chat interfaces, and said the feature should not be used when a user may be at imminent risk of harming themselves or others. The 2026 policy announcement says conversation ending will remain the primary enforcement mechanism for the new rule. OpenAI: access penalties and appeals
OpenAI says policy violations or attempts to circumvent its policies may result in loss of access or other penalties. Users who believe enforcement was mistaken may appeal. The cited policy links developers to moderation tools, but it does not establish whether ChatGPT has a conversation-ending feature comparable to Anthropic’s. OpenAI Usage Policies

What this comparison can—and cannot—tell you
The written rules establish a difference in emphasis: OpenAI’s cited Usage Policies expressly list harmful conduct toward people, while Anthropic’s announced update adds a defined prohibition on repeated, needless cruelty toward its models. The policies do not show that either provider will make the same decision in every similar exchange, nor do they establish comparative refusal rates or model behavior.
For the Anthropic rule, the date matters: its policy page is labeled with a future effective date, and the provider’s announcement says the new wording takes effect November 12, 2026. The comparison here reflects the announced update as of October 9, 2026.
