The CFTC says a federal court entered a default judgment totaling $31,484,910 against Brian Early and Alisha Ann Kingrey in the Fundsz case: $15,732,455 in restitution and a $15,752,455 civil monetary penalty. The judgment concerns an alleged digital-asset and precious-metals trading operation; it does not establish that investors have been repaid.
What was the Fundsz case about?
Fundsz was an unincorporated entity that solicited contributions for purported trading in digital assets and precious metals. The CFTC filed its action in the U.S. District Court for the Middle District of Florida in July 2023. In August of that year, the agency announced an initial asset freeze, an order to preserve records, and the appointment of a temporary receiver. That complaint alleged that Fundsz advertised returns above 3% a week, did not trade customer funds, and reported fictional weekly returns. It also alleged that a one-time $2,500 contribution could grow to $1 million in 48 months without additional deposits. Those claims describe the complaint’s allegations; the later judgment against Early and Kingrey addressed specific conduct and findings about them.
What did the court find about Early and Kingrey?
The court’s September 15, 2026 judgment says Early and Kingrey served on Fundsz’s advisory board and moderated the Telegram group used to communicate with participants. It found that they promoted purported average weekly returns above 3%, understated risks, claimed Fundsz used a proprietary algorithm, and promised withdrawals with interest after 180 days. They also cited seven years of timely and accurate payments, although Fundsz had existed for less time.

The court found the reported returns were fictional and that Fundsz had weeks with no trading. It further found that Early and Kingrey knew their statements were false or acted with reckless disregard for their truth, including by failing to investigate whether the claims were accurate. How much did Fundsz participants lose?
The judgment states that Fundsz had more than 10,000 participants and that 9,138 participants lost a total of $15,732,455.40. This is the figure stated in the court’s September 2026 judgment, not an independently verified count or total. The CFTC’s 2023 announcement had described the complaint as alleging more than 14,000 participants; that earlier allegation and the judgment’s figures come from different documents and should not be treated as interchangeable.

What does the $30 million judgment include?

The headline’s “$30 million” is a rounded description of the $31,484,910 combined award. The court also permanently enjoined Early and Kingrey from further charged violations and imposed permanent registration and trading bans. How did the court enter a default judgment?
This was a default judgment, not a judgment entered after the defendants contested the case at trial. The judgment says their answers were struck after they failed to participate in the case, make initial disclosures, and respond to discovery. The court reviewed the well-pleaded allegations and evidence. It explained that default admits well-pleaded facts, but does not automatically admit legal conclusions.

What happened to the other defendants?
The CFTC says the court separately entered consent orders concerning Rachel Larralde, personal representative of Rene Larralde’s estate, and Juan Pablo Valcarce. The estate representative was ordered to relinquish to the court-appointed receiver rights in a residence Rene Larralde bought with investor funds, along with more than $2.7 million in other assets. Valcarce was permanently enjoined and received permanent registration and trading bans. The CFTC says the judgment and consent orders resolved all remaining claims in the action.
Did victims get their money back?
The available orders establish amounts awarded, not amounts distributed. A restitution order does not guarantee repayment: the CFTC warned in its 2023 announcement that defendants may not have enough funds or assets to repay victims. The agency’s 2026 release does not establish how much, if any, has actually been distributed under these orders.

What the case means for crypto-investment claims
The court’s findings in this case concerned specific representations about profits, risk, trading activity, an algorithm, and withdrawals. They are not a finding that every digital-asset investment is fraudulent. For this action, CFTC Enforcement Director Ian McGinley’s warning when the agency announced the 2023 complaint was: “Though the products fraudsters purport to trade and their methods of attracting victims—in this case through social media—may have changed, the old adage ‘if something sounds too good to be true, it probably is’ remains as valid as ever.” That was a statement made in 2023 alongside the complaint announcement, not a comment on the 2026 judgment.
