Can Your Employer Require Proof When You Call in Sick?

An employer may sometimes require proof of a sick absence, but the rules vary by jurisdiction and leave type. A doctor’s note is not the only possible evidence.

Sometimes. Whether an employer can require proof when you call in sick depends on where you work, what kind of leave you are taking, how long you are absent, and any applicable workplace policy or agreement. Proof does not always have to be a doctor’s note, and there is no single rule that applies to every worker.

Start with your location and the type of leave

Ordinary sick leave, leave protected by a specific law, and leave to care for a family member can have different documentation rules. A manager’s request for a note under a general attendance policy is also different from formal medical certification for protected leave.

Ask which policy or law applies, what evidence is acceptable, and when it must be provided. Check your employee handbook, award or registered agreement, collective agreement, and local labor authority. The examples below apply only to the jurisdictions and worker groups identified.

What the rules say in specific jurisdictions

Australia

Fair Work Ombudsman guidance says an employer can request evidence that illness or injury made the employee unable to work, or that a qualifying immediate family or household member needed care. The request can cover an absence of one day or less. Evidence may include a medical certificate or a statutory declaration; it must be reasonable in the circumstances and sufficient to convince a reasonable person that the employee was entitled to the leave. Awards or registered agreements may specify when and what evidence is required. If an employee does not provide requested evidence, they may not be entitled to paid sick or carer’s leave. Fair Work Ombudsman guidance does not consider it reasonable for an employer to attend an employee’s medical appointment unless invited, or to contact the employee’s doctor for more information. Fair Work Ombudsman: Notice and medical certificates

United States

There is no single U.S. rule that means every employer can—or cannot—demand a doctor’s note for every sick day. Several distinct rules may apply:

  • FMLA leave: For a qualifying serious health condition, an employer may require certification from a health-care provider. The employee generally must be given at least 15 calendar days to obtain it. If the certification is incomplete or insufficient, the employer must identify the deficiency and generally allow at least seven calendar days to correct it. Employees do not have to provide medical records or disclose a diagnosis, but the certification must be complete and contain sufficient medical facts. U.S. Department of Labor: FMLA FAQs
  • FMLA call-in procedures: Employees generally must follow the employer’s usual call-in procedures unless unusual circumstances prevent them from doing so; in that case, they must notify the employer as soon as practicable. U.S. Department of Labor: FMLA FAQs
  • Federal-contractor paid sick leave: Under the limited rule for covered federal contractors, an employer may require certification or documentation only after at least three consecutive full workdays of leave, and only if it gave notice of the requirement before the employee returned to work. This is not a nationwide threshold for all U.S. sick leave. U.S. Department of Labor: Executive Order 13706 FAQs
  • Other sick-leave explanations and disability inquiries: EEOC guidance says an employer may ask for a doctor’s note or other explanation after sick leave if it has a policy or practice of requiring one from all employees. Broader disability-related inquiries are constrained; the EEOC describes a job-related and business-necessity standard. United Kingdom

GOV.UK guidance discusses fit notes completed by eligible healthcare professionals after an assessment. An assessment may take place face-to-face, by video or telephone, or through consideration of a written report from another healthcare professional. The guidance also addresses other medical evidence and workplace procedures for absence disputes; it does not establish one proof threshold for every short sickness absence. Canada: federally regulated workplaces

For employees covered by federal labour standards, an employer may require a certificate from a health-care practitioner when a medical leave, paid or unpaid, lasts five days or longer. This rule applies to federally regulated industries and workplaces; it does not establish the requirement for every provincial or territorial workplace. Government of Canada: Leave from work

A request for your note is not the same as permission to contact your doctor

In the United States, HIPAA generally does not protect employment records held by an employer, even when they contain health information. An employer can ask an employee for information to support a sick-leave request. But a covered health-care provider generally cannot give information directly to the employer without the employee’s authorization unless another law requires disclosure. U.S. Department of Health and Human Services: Employers and health information in the workplace

That distinction does not mean an employee must disclose a diagnosis. For FMLA leave, the certification must provide sufficient information to establish the need for leave, but employees need not supply medical records or the diagnosis. Disability-related questions are also subject to the EEOC limits described above.

What to do when your employer asks for proof

  1. Notify your employer promptly. Follow the normal call-in process and say how long you expect to be away if you can. For FMLA leave, usual call-in rules generally apply unless unusual circumstances prevent compliance.
  2. Ask what rule applies. Request the written policy or the specific law, award, agreement, or leave process the employer is relying on.
  3. Confirm acceptable evidence and the deadline. Ask whether alternatives to a doctor’s note are accepted, how to submit the evidence, and when it is due. Keep a record of the request and your response.
  4. Share only what is required. If the request concerns protected leave, confirm what the certification must establish and whether the employer is asking for information beyond that. A request for a note does not itself authorize the employer to obtain your medical information directly from your provider.
  5. Seek local advice if the request seems inconsistent with the rules. Contact the labor authority for your jurisdiction or a qualified employment adviser, especially if the employer threatens discipline or denies leave.
