Usually, yes under OpenAI’s terms: as between you and OpenAI, and to the extent permitted by applicable law, you own the Output. But that does not guarantee copyright protection, exclusivity, permission to use everything in the source image, or compliance with disclosure rules. Before using an edit in an ad or other commercial material, check the input rights, the applicable law, and the context in which you will publish it.
What OpenAI’s terms say about commercial use
OpenAI’s Terms of Use say: “As between you and OpenAI, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output.” The terms also assign to you OpenAI’s right, title, and interest, if any, in Output. This is a contractual allocation between you and OpenAI; it is not a guarantee that every result is copyrightable, exclusive, or clear of third-party rights.

The terms make you responsible for the Content you submit and receive, and you represent that you have the rights, licenses, and permissions needed to provide your Input. They also warn that outputs may not be unique: other users may receive similar results. So ownership under the contract does not mean you have the only copy or an exclusive claim to every element in an edit.

OpenAI’s Business Terms – May 2025 similarly say that the customer retains ownership rights in Input and owns Output, subject to applicable law. They say OpenAI will not use Customer Content to develop or improve its services unless the customer explicitly agrees, and place responsibility for the customer’s use and evaluation of Output on the customer. Check the agreement that actually governs your account: terms can vary by product and change over time.

Check rights in the source image and any person shown
Having an image file does not necessarily give you the right to submit it to an image-editing service or use the edited version in an advertisement. Confirm that your intended use is covered by the rights you hold in photographs, stock images, client assets, logos, artwork, and other third-party material.
OpenAI’s Service Terms prohibit using visual capabilities to reproduce a person’s likeness without express consent and all necessary rights. This is especially relevant when an edit creates or changes a recognizable person’s appearance. The permissions you need depend on the jurisdiction and use; an edit does not itself clear them.

Ownership under the terms is not the same as copyright
OpenAI’s contract addresses the relationship between OpenAI and the user. Copyright law separately determines whether a work has protectable authorship and what that protection covers.

For U.S. copyright context, the U.S. Copyright Office’s January 29, 2025 summary of its Part 2 AI report says that AI assistance, or AI-generated material included in a larger human-created work, does not by itself bar copyrightability. Protection depends on a human author determining sufficient expressive elements. Human-authored expression perceptible in the output, or creative human arrangements and modifications, may qualify; prompting alone does not. Do not assume an entirely machine-determined result receives copyright protection simply because the service’s terms assign Output to you.

Do you have to disclose that an image was AI-edited?
There is no single answer for every country, platform, image, and use. A disclosure obligation depends on the applicable law and publication context. Do not treat OpenAI’s technical provenance signals as a substitute for checking those requirements.
EU: the rule covers deepfakes, not every AI edit
Article 50 of the EU AI Act addresses deployers of AI systems that generate or manipulate image, audio, or video content constituting a deepfake: they must disclose that the content was artificially generated or manipulated. For evidently artistic, creative, satirical, fictional, or analogous work, the disclosure should be appropriate and should not hamper the display or enjoyment of the work. The provision also includes an exception for content that has undergone human review or editorial control where a natural or legal person holds editorial responsibility for publication. See the European Commission’s Article 50 text and check current guidance for the specific use. This EU rule should not be generalized to all edits or other jurisdictions.

Provenance signals can help identify origin, but do not settle the legal question
OpenAI says images generated with ChatGPT, Codex, or the OpenAI API include Content Credentials and SynthID watermarks. Its provenance guidance cautions that provenance signals can provide information about origin but do not guarantee accuracy, legal ownership, or correct context. Their presence does not, by itself, establish that you have met a disclosure duty.

A practical check before publishing a GPT Image edit
- Identify the governing terms. Check the current OpenAI agreement for the product and account you used, including whether consumer or business terms apply.
- Clear the inputs. Confirm you have the rights and permissions to submit the source image and use its contents for your planned commercial purpose.
- Review likeness and third-party material. Get the required consent and rights for recognizable people, and review any stock, client, brand, or other protected material in the image.
- Separate contractual ownership from copyright claims. Do not promise exclusivity or copyright protection for machine-generated elements without a basis under the relevant law.
- Check local and platform disclosure requirements. Consider what the edit depicts, how it will be presented, where it will be published, and whether a specific rule applies. For consequential campaigns, get advice for the relevant jurisdiction.
