Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Yes—but choosing a region in an AI cloud console does not, by itself, prove that a service meets your data-residency or cross-border-transfer obligations. You need to identify which data must stay where, check where the selected service stores and processes it, and establish a valid legal basis for any transfer or access that crosses a relevant border.
What does “data must stay in the region” actually require?
Translate the requirement into specific boundaries before comparing cloud services. “Regional residency” can refer to different things, and a service may meet one boundary while crossing another.

- Storage location: where prompts, responses, uploaded files, logs, backups, vector stores, and abuse-monitoring records are stored.
- Processing location: where inference and related operational or safety processing take place. A regional storage commitment does not necessarily limit processing to that region.
- Access: which provider staff, subprocessors, or support systems can access the data, and from where. No foreign access is a distinct requirement from regional storage.
- Transfers and onward transfers: whether data is disclosed or made accessible in another country, including through subprocessors or later transfers.
- Retention and use: how long data persists, whether specific features retain it, and whether inputs or outputs are used to train or improve models.
Also identify the data involved: personal, non-personal, mixed, confidential, or subject to special-category or sector-specific rules. If the requirement is “single-country inference with no foreign access,” a provider’s promise to store data in a broad region is not enough.

Does residency settle whether cross-border AI use is lawful?
No. Residency is a technical or contractual commitment about the location of specified data. Transfer rules address whether personal data may be transferred or made accessible across borders. For personal data covered by the GDPR, Article 44 requires transfers to a third country or international organization to meet the conditions in GDPR Chapter V, including rules for onward transfers. The European Commission identifies several possible routes, including an adequacy decision, standard contractual clauses (SCCs), binding corporate rules, certification mechanisms, codes of conduct, and limited derogations. Which route applies depends on the parties, destination, and circumstances.

SCCs are not a blanket permission for every cross-border AI deployment. They are one possible transfer mechanism; the organization still needs to determine whether it fits the actual data flow and parties. The Commission’s GDPR transfer guidance and the text of GDPR Article 44 are the relevant legal starting points.
Within the EU, non-personal data can generally be stored or processed anywhere in the Union under the EU free-flow framework, subject to narrow, justified national restrictions, including certain public-security cases. Mixed datasets may remain subject to GDPR where their personal and non-personal components are inextricably linked. These EU-wide principles do not answer every national, sectoral, or non-EU requirement.

Can an AI provider process data outside the region shown in its console?
Yes. Provider controls use different definitions of “regional.” A geography can include multiple countries or cloud regions, and some deployment types allow processing beyond the resource’s home region. Compare the exact model, endpoint, deployment type, and retention behavior—not just the location of the account or cloud resource.
| Service and setting | Processing boundary | Storage and retention notes | What to verify |
|---|---|---|---|
| Amazon Bedrock geographic cross-Region inference | AWS says processing stays within the selected geography, such as US, EU, or APAC. Prompts and outputs may move from their source Region to another Region within that geography. | AWS says data ordinarily remains stored only in the source Region. Where abuse-detection retention applies, inputs and outputs are stored in the destination Region where processing occurred. | Check the inference profile, model, included Regions, and whether abuse-detection retention applies. Geographic processing does not mean single-Region processing. |
| Microsoft Foundry models sold by Azure: Regional | Prompts and responses are processed within the customer-specified geography, potentially across regions within that geography for operational reasons. | Microsoft says stored-at-rest data remains in the designated geography. | Confirm the deployment type and the exact geography selected for the model. |
| Microsoft Foundry models sold by Azure: Global | Prompts and responses may be processed in any geography where the relevant model sold by Azure is deployed. | Microsoft says stored-at-rest data, including the abuse-monitoring store for Global and DataZone deployments, remains in the designated geography. | Do not treat the Azure resource’s location as a processing boundary. Confirm the model’s deployment locations and the applicable designated geography. |
| Microsoft Foundry models sold by Azure: DataZone | Processing may occur anywhere in the specified zone. Microsoft’s example is an EU DataZone deployment that may process in any EU Member State. | Microsoft says stored-at-rest data, including the abuse-monitoring store for Global and DataZone deployments, remains in the designated geography. | Check which countries the zone covers and whether that boundary satisfies the requirement. |
| OpenAI API: eligible project with residency controls | Regional processing is available only for specifically listed regions and supported requests, endpoints, models, and snapshots. | Where persistence is needed for supported requests, customer content is stored at rest in the selected region. System data is excluded; some transmission or storage outside the region may result from customer or end-user access location, and third-party offerings are outside OpenAI’s control. | Confirm current region availability, project eligibility, and support for the exact endpoint, model, and snapshot. Do not extend a customer-content residency claim to system data. |
These are service-specific descriptions, not a guarantee that every model, feature, or deployment behaves alike. Review the current Amazon Bedrock, Microsoft Foundry, or OpenAI API data-controls documentation for the exact configuration. The provider descriptions establish different storage and processing boundaries; they do not establish that one service is suitable for every legal or contractual requirement.

Can a cloud AI provider process data in another EU country?
EU-wide rules do not generally require non-personal data to remain in one Member State, and the GDPR does not make movement of personal data within the EU equivalent to a transfer to a third country. That does not remove other obligations: national rules, public-sector procurement terms, sector regulation, confidentiality duties, or a contract may impose narrower limits. A service that processes in any EU country can therefore meet an EU-wide boundary but fail a single-country commitment.
Does the EU AI Act require AI data to stay in the EU?
The cited EU AI Act scope provisions do not create a general rule that all AI data must be stored or processed in the EU. The Act has extraterritorial scope in defined circumstances, including where output from an AI system is used in the Union, but that is not the same as a blanket data-localization requirement. Data protection, transfer, sectoral, and contractual rules still need to be assessed separately.

- Map the data flow. List the data sent to the model and the related files, responses, logs, backups, vector stores, safety records, and support artifacts. Classify the data and identify the controller, processor, and other relevant parties.
- Write the boundary precisely. State the permitted countries or regions for storage, inference, support access, and onward transfer separately. Specify retention limits and whether training or model improvement is allowed.
- Select the exact deployment. Record the provider, model, endpoint, deployment type, region or zone, and inference profile. Check whether failover or cross-region routing can occur and whether it can be disabled.
- Check retention and subprocessors. Read the model- and feature-specific terms for abuse monitoring, optional persistence, deletion behavior, and subprocessors. Do not infer one feature’s rules from another deployment tier.
- Establish the legal and contractual route. For GDPR-covered transfers outside the EEA, determine which Chapter V mechanism applies and ensure the relevant data-processing and transfer terms cover the actual parties and flows. Assess any stricter national or sectoral requirements with qualified counsel.
- Validate operational controls. Confirm model availability, latency, quotas, failover behavior, access controls, encryption and key options, and whether the configuration can be audited against the promised boundary.
- Keep evidence current. Retain the provider’s applicable terms and configuration details, and recheck them when the model, endpoint, deployment, retention mode, or provider documentation changes.
What to conclude before putting sensitive data into an AI service
A regional AI setting can be part of a compliant design, but it is not proof on its own. Make the required locations explicit, verify storage and processing separately for the chosen deployment, and document the legal transfer route where personal data leaves the EEA. If your requirement is stricter than the provider’s documented boundary—or the provider does not establish where a relevant data category is handled—do not treat the deployment as meeting that requirement without further contractual and technical confirmation.
