It depends on your state and what you want to photograph. Permission to take a picture of your own ballot does not automatically let you photograph other voters, poll workers, voting equipment, or the polling-place interior. State law, court rulings, election-office guidance, and sometimes county procedures can all affect the answer. Before taking a photo inside, check with your state or local election office.
What the state-by-state rules cover
The clearest national comparison is about ballot selfies: photos of your own ballot. The National Conference of State Legislatures (NCSL) updated its summary on October 1, 2026. Its categories do not establish blanket permission to photograph everything inside a polling place, and NCSL cautions that some laws do not directly address ballot images and that implementation may vary by county.

These categories describe NCSL’s ballot-selfie classifications, not a comprehensive ruling on every type of photography inside polling places.

Does permission for your ballot selfie cover the room?
No. A rule about photographing your own ballot is not necessarily a rule about photographing the polling-place interior. Florida illustrates the distinction: NCSL says voters may photograph their own ballot at the polling place, while other polling-place photography is not permitted.

Rules may also distinguish your ballot from someone else’s. NCSL says Utah permits a photo of a voter’s own ballot but not another person’s ballot. Do not include another voter’s marked ballot or selections in a photo unless the applicable rules clearly allow it.
Can you take a selfie in the voting booth or photograph other people?
Check the rule for the specific place and action before using a phone or camera. Some states restrict recording people in the voting area independently of rules about ballot selfies. North Carolina law, for example, prohibits recording a voter within the voting enclosure without required permissions and prohibits photographing a voted official ballot unless otherwise permitted by law. That is why permission to photograph your own ballot should not be treated as permission to photograph voters, poll workers, equipment, or the room.

Georgetown University Law Center’s Institute for Constitutional Advocacy and Protection noted in 2024: “Laws governing the use of recording devices inside the polls vary from state to state.” Its guidance advises voters and local officials to consult state election officials about whether and under what conditions recording devices are permitted.

They can. NCSL identifies Arizona, Maryland, Michigan, Tennessee, Texas, and West Virginia as states where selfies are prohibited for in-person voting while treatment of absentee ballot photos is unclear. A rule about photographing an absentee ballot away from a polling place does not, by itself, answer whether you may take a picture inside one.

Can a county or polling place set additional procedures?
State law is not always the only consideration. Pennsylvania’s Department of State said in its April 2025 guidance that the Election Code does not address electronic-device use in the polling place and recommended county rules that preserve order and unimpeded voting. It also recommends that voters avoid disclosing other voters’ selections and wait until they have left the polling place to post a ballot selfie: “The Department recommends that voters wait until after they leave the polling place to post ballot selfies on social media.”

What to do before taking a photo
- Identify what you want to photograph. Your own ballot, another person’s ballot, a person, equipment, and the room may be covered by different rules.
- Check current state election guidance and law. Treat NCSL’s October 1, 2026 summary as a ballot-selfie snapshot, not a permission matrix for all photography.
- Ask your state or local election office if the rule is unclear. County procedures may matter, and guidance can be more specific than a broad state-level classification.
- Follow instructions from election officials at the polling place. Do not photograph other voters or their selections unless the applicable rule allows it.
