Safe workplace use depends on the exact model and service, what employees submit, where data is processed and retained, the provider’s current terms, your technical controls, and the laws that apply to your organization. “Chinese AI model” is not a single risk category, and a familiar brand name does not establish acceptable data handling.
DeepSeek illustrates the questions employers must answer. Its consumer policy, developer terms, downloadable models, and Harness product describe different data flows and responsibilities. Use the framework below to evaluate any provider rather than assuming that one product’s practices apply to every model or deployment.

The short answer: approve a specific data flow, not a nationality
A Chinese-developed model can be used safely for some low-risk work, while the same model may be inappropriate for confidential, regulated, or export-controlled information. The decision should be made for a named model version, account type, deployment architecture, user group, and business purpose.
- Consumer chatbot: Treat prompts, uploaded files, images, voice input, and conversation history as data leaving your controlled environment unless the provider’s current terms and settings prove otherwise.
- API: An API is only an interface. It does not automatically provide local processing, zero retention, contractual deletion, or exclusion from service-improvement use.
- Self-hosted weights: Local inference can reduce provider access, but it does not remove risks from telemetry, outbound connections, plugins, logs, backups, compromised hosts, or weak access controls.
For high-impact decisions, personal data, trade secrets, source code, health information, financial records, or customer content, require documented approval from privacy, security, and legal owners before use.

Why the service surface matters more than the label
One provider can operate several different products
Consumer applications, developer APIs, hosted enterprise tools, and downloadable weights may have different controllers, contracts, retention practices, subprocessors, and support access. Do not copy an answer from one product into another.
DeepSeek’s consumer privacy policy, last updated February 10, 2026, names Hangzhou DeepSeek Artificial Intelligence Co., Ltd. as controller. It says the service may collect text and voice input, prompts, uploaded files and photos, feedback, and chat history. The policy says personal data may be stored outside a user’s country and that it directly collects, processes, and stores personal data in the People’s Republic of China.
The policy does not promise one universal deletion period. Retention varies with the amount, type, and sensitivity of data, the purpose of processing, and legal requirements. Keeping data while an account exists is given as an example for service provision. Therefore, do not tell employees that prompts disappear when a chat ends or after a fixed number of days unless a current, written term for the exact service says so.
Developer terms shift responsibilities to the customer
DeepSeek’s Open Platform terms, released April 22 and effective April 29, 2026, cover API and developer use, including internal organizational applications. They state that downstream developers are responsible for their own systems and applicable legal obligations and must establish organizational and technical data-security measures.
The reviewed terms do not establish a universal promise of local hosting, zero retention, or exclusion from improvement use. Procurement should obtain written answers tied to the actual account, endpoint, contract, and model version. Ask who is the controller or processor, where requests and support data are handled, how deletion works, which subprocessors are used, and whether data can be used to improve services.

Hosted orchestration tools create another data path
DeepSeek’s Harness privacy policy, last updated September 20, 2026, describes interaction session logs that may include inputs, uploaded or authorized content, model outputs, tool-invocation information, plugin configuration, and conversation data. It distinguishes official models from user-configured custom-model APIs. If your organization uses an orchestration product, review that product’s policy separately; the model provider’s chatbot policy is not enough.
What data can employees safely submit?
Start with your organization’s existing data-classification scheme. Map each proposed use to the highest sensitivity of the input, the generated output, and any data retrieved by connected tools.
Usually lower-risk examples
- Public material that is already approved for external processing.
- Generic brainstorming with no customer, employee, or proprietary details.
- Synthetic or irreversibly anonymized examples that cannot reasonably be reidentified.
- Non-sensitive code samples stripped of credentials, internal URLs, and unique business logic.
Require explicit approval or prohibit by default
- Personal data, especially health, financial, identity, children’s, or employment records.
- Trade secrets, unreleased product plans, source code, credentials, private keys, and security incidents.
- Customer content governed by confidentiality, data-processing, residency, or sector contracts.
- Information subject to export controls, litigation holds, banking rules, or government restrictions.
Redaction is not automatically anonymization. Removing a name while leaving a rare job title, date, location, and transaction details may still identify a person. A safer workflow uses synthetic values and tests whether the original record can be reconstructed.
Compare the main deployment choices
| Option | Questions to answer | What the available evidence establishes |
|---|---|---|
| Consumer chatbot | What content is submitted? Where is it processed and stored? How long is it retained? Is it used to improve services? | DeepSeek’s policy says prompts, files, and chat history may be collected; processing and storage occur in China; retention varies by data, purpose, and legal requirements. |
| API integrated into an employer system | Which entity controls the data? What contract governs retention, geography, support access, subprocessors, deletion, and improvement use? | The Open Platform terms place responsibilities on downstream developers and require technical and organizational safeguards. No universal residency or zero-retention promise was established. |
| Self-hosted open-weight model | Does inference stay on controlled infrastructure? Are egress, telemetry, plugins, logs, backups, updates, and administrator access controlled? | DeepSeek says its weights and inference code are downloadable and deployable under the MIT License. That disclosure does not prove that a particular installation is local, secure, or compliant. |
Consumer access
A browser or mobile app is the easiest path for staff and the hardest for an employer to govern consistently. Users can paste information outside approved systems, and browser history, screenshots, exported chats, or shared links may create additional copies. If consumer access is allowed, use an approved account, publish a prohibited-data list, disable integrations that are not assessed, and log usage where lawful.
API integration
An API can centralize identity, filtering, logging, and rate controls, but the employer remains responsible for how its application sends and stores data. Review request and response bodies in application logs, traces, error queues, analytics tools, and backups. Confirm that debugging or support workflows do not create an unapproved second retention system.

Self-hosting
Downloadable weights change who operates inference; they do not create a compliance certificate. Pin the model version, verify the repository and license, block unnecessary outbound traffic, inspect dependencies, protect the host, encrypt storage, limit administrator access, and define a patch and rollback process. Match hardware to the selected model and workload; no specific configuration is established here, and buying a workstation does not make a deployment secure.

European Union: GDPR still applies to transfers
In a June 2, 2025 answer, the European Commission stated that “any transfer of personal data to China by DeepSeek needs to take place in compliance with the EU’s General Data Protection Regulation (GDPR).” This is not a blanket prohibition and not an automatic approval. The organization must establish a lawful basis, transparency, purpose limitation, minimization, security, rights handling, and a lawful transfer mechanism where required. Member State data-protection authorities enforce the GDPR.
The Japanese Personal Information Protection Commission’s February 2025 notice stated that data, including personal information acquired through use of DeepSeek, was stored on servers in China and subject to Chinese laws. That is an official Japanese regulator notice about the described service and period, not a universal ruling about every Chinese model or every deployment.
EU AI Act: model origin does not remove obligations
The European Commission’s AI Act materials describe progressive application. Its enforcement page, last updated October 6, 2026, lists August 2, 2026 for specified enforcement powers and later dates for other provisions. The Commission’s FAQ explains that the framework can apply to actors inside or outside the EU that place a model or system on the EU market or put a system into use in the EU.
Assess the particular actor, model or system, role in the value chain, and use case. An open-weight release does not remove duties that arise from deploying an AI system in a regulated context.

Regulatory action can be narrow and temporary
European Data Protection Board meeting minutes record that Italy’s authority issued a provisional measure on January 30, 2025 limiting processing of Italian users’ data by Chinese companies providing DeepSeek chatbot services. Treat this as a recorded provisional measure, not as a statement about the current legal status of every DeepSeek service throughout Europe.
Other jurisdictions
Outside the EU and Japan, identify the countries of the users, data subjects, provider, hosting region, and support staff. Then check sector rules, cross-border transfer requirements, employee-monitoring limits, government-contract clauses, and records-retention duties. A contract that is acceptable in one country may not satisfy another country’s transfer or notice requirements.

Privacy compliance does not guarantee that a model will resist manipulation. NIST’s Center for AI Standards and Innovation announced simulated evaluations on September 30, 2025 covering DeepSeek R1, R1-0528, and V3.1, four U.S. reference models, and 19 benchmarks.
- Agents based on R1-0528 were, on average, 12 times more likely than the evaluated U.S. frontier models to follow malicious agent-hijacking instructions in the simulated tests.
- With a common jailbreak technique, R1-0528 responded to 94% of overtly malicious requests, compared with 8% for the U.S. reference models.
These are NIST findings for named versions and test scenarios. They do not prove that every Chinese model, later release, or locked-down deployment has the same weaknesses. They do justify testing the exact workflow you intend to authorize.

- Prompt injection through retrieved documents, web pages, email, and uploaded files.
- Attempts to exfiltrate secrets, personal data, system prompts, or hidden context.
- Tool misuse, excessive permissions, unsafe code execution, and unauthorized transactions.
- Access-control failures between tenants, projects, roles, and environments.
- Logging, alerting, human approval, incident response, and rollback.
When a model can call tools, treat its output as untrusted input. Use allowlists, least-privilege service accounts, isolated execution, confirmation gates for consequential actions, and deterministic validation before a tool accepts model-generated parameters.

A practical approval process for employers
- Name the service precisely. Record provider, product, model version, endpoint, account type, integrations, and deployment region.
- Define the use case. State what employees want to do, what decisions the system may influence, and whether it can take actions.
- Classify inputs and outputs. Set prohibited categories, redaction rules, retention limits, and an owner for exceptions.
- Map the data flow. Include prompts, uploads, retrieved documents, logs, backups, support access, subprocessors, and cross-border transfers.
- Read current terms and obtain contract answers. Confirm roles, deletion, retention, improvement use, residency, security commitments, incident notice, audit rights, and termination assistance.
- Run threat and quality tests. Test prompt injection, exfiltration, tool abuse, harmful outputs, access control, and human-review checkpoints against realistic data.
- Apply technical controls. Enforce SSO and role-based access, secrets filtering, egress controls, encrypted storage, logging, rate limits, and separate development and production environments.
- Document user guidance. Tell staff exactly what they may enter, how to report an incident, when human review is mandatory, and how outputs must be verified.
- Reassess on change. Trigger a new review when the model, terms, hosting region, integrations, retention behavior, law, or use case changes.
Bottom line for a workplace policy
Permit Chinese AI models only through an approved service and data flow. Low-sensitivity experimentation may be acceptable after basic controls; confidential or regulated work requires stronger contractual, architectural, and legal evidence. The decisive questions are where data goes, who can access it, how long it remains, what the model can do, and whether your organization can monitor and stop misuse—not the model’s country of origin alone.
Frequently Asked Questions
Does the MIT License mean a self-hosted model has no privacy obligations?
No. The MIT License addresses rights to use and modify the released software or weights. It does not decide whether your collection, storage, employee monitoring, cross-border transfer, security, or sector-specific obligations are lawful.
Is a signed enterprise contract enough to approve the model?
Not by itself. Verify that the contract matches the production account and endpoint, then confirm that the implementation actually enforces its promises for retention, deletion, geography, subprocessors, support access, and improvement use.
Recommended Free Tools
Do the NIST jailbreak figures prove the model cannot be used at work?
No. The figures are scoped to NIST’s 2025 simulated tests and named model versions. They are warning signals that support workflow-specific testing and least-privilege controls, not a universal verdict on every deployment.
When should an approved deployment be reviewed again?
Review it whenever the model or provider changes, terms or hosting locations change, a new plugin or tool is connected, the use case expands, a security incident occurs, or applicable law changes.
