Often, yes—but using an AI game generator does not automatically give you permission to sell or publish what it creates. Check the generator’s terms, clear the rights for every asset in the game, and meet the rules of the store or platform where you plan to release it. Those are separate requirements: platform acceptance does not grant you a commercial license from the generator or permission to use someone else’s material.
What determines whether you can publish or sell the game?
There is no universal rule for games made with AI. Your answer depends on the specific generator and its terms, what material went into the game, the destination platform’s policies, and applicable law. Since no particular generator or game is identified here, its commercial-use terms cannot be assumed.

- Generator terms: Check whether your plan permits commercial use and what rights or license you receive for outputs. Look for attribution duties, redistribution limits on bundled assets, and restrictions tied to account tier or region.
- Asset rights: Confirm that you have the necessary rights for every shipped element, including generated and imported art, music, code, fonts, names, and other content.
- Platform rules: Check the requirements for the actual store or publishing platform. Rules differ, especially when players can generate content during play.
- Copyright: Permission to use an output commercially and the ability to claim copyright in it are different questions.
Keep a record of the generator, the relevant terms and account tier, asset sources and licenses, and any human-created or edited contributions. That makes it easier to assess rights and complete platform disclosures accurately.

These platforms address different publishing issues. Their rules are examples, not interchangeable or exhaustive requirements. A feature used only during development can be treated differently from one players encounter in the released game.
#1 Best Overall
| Platform | What its guidance requires or addresses | What to check for your game |
|---|---|---|
| Steam | Steamworks requires developers to complete the Content Survey and describe applicable AI use. Steam reviews shipped AI content under the same standards as non-AI content. Its guidance also covers live-generated content and asks developers to describe guardrails. | Identify whether AI-made material is pre-generated and shipped with the game, or generated live for players. For live generation, be ready to explain the safeguards and how the feature complies with Steam’s rules. |
| Roblox | Roblox says creators are responsible for third-party AI content. Player interactions with a generative model must be disclosed in the Content Maturity questionnaire. Extended interactions can require a Restricted label. | Determine whether players interact with the model, how extensive those interactions are, and whether the feature retains memory across sessions. Development-only AI use is different from player-facing interaction. |
| Google Play | Google Play’s AI-generated-content policy places safety and policy-compliance obligations on covered generative AI apps. Its guidance says those apps must also follow other Play policies and gives examples of prohibited generated content; it does not treat every limited-scope case identically. | Establish whether the app itself generates content for users or simply includes fixed assets made with AI. Check how the policy applies to that specific functionality. |
For Steam, the Content Survey disclosure is not a substitute for rights clearance or compliance. Steamworks says: “In our prerelease review, we will evaluate the output of AI generated content in your game the same way we evaluate all non-AI content – including a check that your game meets those promises.”
Does the generator’s output belong to you?
Do not assume that a generated image, soundtrack, character, or code snippet is yours to use commercially just because a tool produced it. Read the specific generator’s terms for the relevant account, plan, and region. Confirm what the terms say about commercial use, output licenses, attribution, and redistribution of included assets.

Then review every other component of the game. A generator’s terms cannot grant rights to third-party material incorporated into an output if the generator did not have those rights to grant. Keep provenance and license records for both generated and imported material, and review names and other content as well as obvious assets such as art and music.
Can AI-generated game content be copyrighted?
In the United States, commercial permission and copyright protection are separate. The U.S. Copyright Office’s March 2023 guidance says copyrightability depends on human authorship. If a machine determines the traditional expressive elements of an output, that output may lack the human authorship required for copyright. Human creative selection, arrangement, or modification may support copyright in the human-authored aspects; the assessment is case-specific.
The Office describes the inquiry this way: “This is necessarily a case-by-case inquiry.” For a U.S. copyright registration application covering a mixed work, its guidance says to disclose AI-generated material and describe the human contribution. More-than-de-minimis AI-generated material should be excluded from the claim. This guidance concerns U.S. registration; it does not establish commercial permission under a generator’s contract or resolve rights in every jurisdiction.

Steam monetization has its own onboarding and payment requirements. Steam Direct currently lists a $100.00 fee per product. Valve says the fee is not refundable, but can be recouped after that product has at least $1,000.00 Adjusted Gross Revenue for Steam Store and in-app purchases. These are Steam’s published thresholds, reviewed in 2026, not universal publishing fees.

If the game relies on an external live-generation service with ongoing costs, Steamworks says developers can account for those costs in the base price or charge through supported in-game purchases, a subscription, or one-time DLC. Developers must manage service access and payment through Steam-supported methods. Choosing a payment model does not change the game’s disclosure, rights, or content-compliance obligations.

What to check before submitting the game
- Identify the exact tools and terms. Record the generator, account tier, region, and terms that apply to your outputs. Confirm commercial use and any attribution, redistribution, or other restrictions.
- Inventory the shipped content. Track where each asset and other element came from, including generated material and content imported from other sources. Verify rights or licenses for each.
- Map every AI feature to player experience. Note what is fixed in the released game and what can be generated live or encountered through player interaction. For live or interactive features, document safeguards and the content they can produce.
- Complete the destination platform’s disclosures. Answer its current questionnaires and follow its content, safety, and rights rules. Do not treat disclosure as permission to publish material that otherwise violates those rules or another party’s rights.
- Separate your commercial and copyright decisions. A generator’s commercial-use terms do not determine whether an output qualifies for copyright protection. If you intend to register a work, assess the human-authored contributions under the rules that apply in your jurisdiction.
- Recheck policies before release. Generator terms and platform procedures can change. Review the versions that apply when you submit, not just those you saw when you started making the game.
