Can You Pass a Stopped School Bus on a Divided Highway? Rules by Road Type

A divided highway does not automatically let you pass a stopped school bus. State laws differ, and the divider, roadway, travel direction and bus conditions can all matter.

It depends on the state and the road’s physical layout. U.S. law does not create one universal “divided highway” exception. Florida expressly exempts opposite-direction traffic when a specified divider separates it from the bus; Texas uses a separate-roadway test. Check the current law where you are driving, and do not assume a painted line or turn lane counts as a divider.

How the answer depends on the road

Two questions matter: what kind of separation the state’s law recognizes, and whether the bus is on the same roadway as you or on a separate one. Your direction of travel relative to the bus also matters. Even when an exception applies to traffic moving in the opposite direction, drivers approaching the bus on its roadway may still have to stop.

A U.S. Department of Transportation report reviewing selected rules in 54 jurisdictions warns that states can differ in what counts as a divided highway. Its summary classified five jurisdictions as requiring a stop on divided roadways and 40 as not requiring one; those counts cover selected provisions, do not account for every jurisdiction, and are not a complete verification of current state law. Examples: Florida and Texas

Road situation Florida Texas
Traffic traveling opposite the bus No stop is required if an unpaved space of at least five feet, a raised median, or a physical barrier divides the highway. Florida Statutes § 316.172(2). A driver on a highway with separate roadways need not stop for a bus on another roadway. Texas Transportation Code.
Traffic approaching the bus on its roadway Drivers approaching a bus displaying its stop signal must stop while it is stopped. Drivers approaching a bus stopped to receive or discharge a student must stop when it displays the required visual signal.
Other condition specified in the law The opposite-direction exception identifies the divider types and the five-foot minimum for an unpaved space. The statute separately addresses certain controlled-access-highway loading zones where pedestrians are not permitted to cross.

These are examples, not a nationwide rule. Florida’s statute states: “The driver of a vehicle upon a divided highway with an unpaved space of at least 5 feet, a raised median, or a physical barrier is not required to stop when traveling in the opposite direction of a school bus which is stopped in accordance with the provisions of this section.” That is Florida statutory language, not a rule that applies in every state.

Does a median or painted turn lane count?

There is no nationwide answer. Florida’s cited provision names a raised median, a physical barrier, or an unpaved space at least five feet wide. Texas’s cited provision instead refers to separate roadways. A painted center line or turn lane should not be treated as sufficient without confirming that your state’s current law recognizes it as a qualifying divider.

What to check before relying on an exception

  1. Find the law for the state where you are driving. Use the current state motor-vehicle code or official driver guidance; a rule from another state may use a different test.
  2. Identify the road configuration. Check whether the law requires a particular divider, a minimum unpaved width, or separate roadways.
  3. Compare your direction and roadway with the bus. An exception for opposite-direction traffic does not necessarily apply to drivers on the bus’s roadway.
  4. Check the bus and location conditions. The applicable rule may depend on the bus’s stop signal and, in some circumstances, a controlled-access loading zone or pedestrian-crossing restrictions.

New York bill S716 is a proposal, not proof of a current exception

The New York Senate page for bill S716 in the 2025–2026 session lists it as referred to the Transportation Committee and describes a proposed exception for opposing-direction drivers when a physical barrier is present. That page establishes the bill’s listed status and proposal; it does not establish that the proposal became law or state the full current New York rule. Check New York’s current statute or official guidance before relying on an exception. View the S716 bill page.
