Can You Legally Receive Crypto From a Sanctioned Wallet?

Whether you can receive crypto linked to a sanctioned wallet depends on U.S. jurisdiction, the parties’ interests, the sanctions program, and any authorization—not an address label alone.

Can you legally receive crypto from a sanctioned wallet? Not enough is known from the wallet label alone to answer yes or no. Under U.S. sanctions administered by the Treasury Department’s Office of Foreign Assets Control (OFAC), the answer depends on jurisdiction, whether a blocked person has an interest in the crypto, the applicable sanctions program, and whether an exemption or license authorizes the transfer. If a transfer may involve blocked property, do not move or spend it until a qualified sanctions lawyer or OFAC has assessed the facts.

Why a wallet address does not decide whether receipt is legal

OFAC defines a wallet as a means of holding, storing, and transferring digital currency, and an address as an identifier associated with a wallet. A flagged address can be important evidence for screening, but it is not by itself the legal conclusion: sanctions obligations concern blocked persons, property interests, prohibited activity, jurisdiction, and the rules of the specific sanctions program. OFAC applies the same obligations to digital currency and fiat currency; there is no general crypto exemption. See OFAC FAQ 560 and its virtual currency guidance.

Blocking is also not the same as confiscation. OFAC says title to blocked property remains with the blocked person, while transfers and other dealings are prohibited unless authorized. Property can include financial and intangible assets. The relevant question is therefore whether a blocked person has an interest in the crypto and whether the transaction falls under a prohibition—not simply whether an address appears on a list. See OFAC FAQ 9.

When U.S. sanctions may apply

This framework describes U.S. sanctions administered by OFAC, not every country’s laws. U.S. persons and others subject to OFAC jurisdiction generally may not engage in unauthorized transactions involving blocked persons or property. Property in which a blocked person has an interest that is in the United States or in a U.S. person’s possession or control generally must be blocked. Separate prohibitions may require rejecting a transaction even when there is no property interest that calls for blocking. The program’s rules and any applicable authorization matter. See OFAC FAQ 401, FAQ 9, and FAQ 30.

Do not assume an entity is clear just because it is not individually named on a sanctions list. Under OFAC’s 50 Percent Rule, an entity is treated as blocked when one or more blocked persons own, in aggregate, 50 percent or more of it. See OFAC FAQ 401.

What facts determine whether you can receive the transfer?

Before treating a transfer as permissible, establish the relevant facts. An address match can justify caution and investigation, but it does not alone establish that the sender owns the funds, that a blocked person has a legal interest in them, or that a particular prohibition applies.

  • Intermediary action: If an exchange or other intermediary has frozen the funds, ask what it blocked, why, and what reporting or release process it requires.

The rules of other countries may also be relevant, but the OFAC materials cited here do not establish which law governs a particular person or transfer outside the U.S. framework.

What to do if an exchange freezes crypto sent from a sanctioned address

A freeze is an intermediary’s action, not a final ruling that every recipient or transfer is unlawful. Do not attempt to route around it or access the funds through another wallet. Ask the intermediary for the stated reason, the status of the funds, and its process for submitting information or requesting release. OFAC says an institution may notify a customer that it blocked digital currency, and the customer may apply to OFAC for release. See OFAC FAQ 646 and OFAC FAQ 598.

If the block appears to result from mistaken identity or a typographical error, OFAC describes a correction process. Provide evidence through the institution’s or OFAC’s stated channel rather than moving the funds yourself. Releasing property in which a blocked person actually has an interest without authorization can expose U.S. persons to civil penalties. See OFAC FAQ 401 and FAQ 598.

What to do if you accidentally received crypto that may be blocked

  1. Do not transfer, spend, swap, or otherwise deal with it. A U.S. person who determines that virtual currency must be blocked must deny all parties access and use controls to prevent unauthorized release.
  2. Preserve the transaction details. Keep the transaction hash, timestamps, address information, exchange notices, and any communications that explain how the transfer occurred. These details can help a lawyer or intermediary assess the facts.
  3. Contact the exchange or custodian, if involved. Ask whether it has blocked the funds and what information or reporting process applies. Do not try to bypass its controls.
  4. Get case-specific advice. A qualified sanctions lawyer can assess jurisdiction, the sender’s identity and ownership, the program’s rules, and possible authorization. A wallet-address match alone is not a substitute for that assessment.

When a U.S. person determines that virtual currency must be blocked, OFAC says the initial report is due within 10 business days, with annual reporting while the property remains blocked. The 10-business-day deadline is OFAC’s stated deadline for that initial report; it is not a general deadline for every recipient who merely encounters an address match. Blocked virtual currency need not be converted to fiat or held in an interest-bearing account. See OFAC FAQ 646.
